Recently, the Nigerian Senate overwhelmingly refused to confirm the nomination of Ibrahim Magu as the substantive Chairman of the anti-corruption body, EFCC. While some of the legislators predicated their position on an intelligence report forwarded by the DSS, others maintained that his performance at the Senate chamber was far below average. They concluded that he lacked the competence to head the all-imporetant body. Despite the rejection of his nomination, the Presidency appears not to be willing to renominate or replace Magu. Consequently, it has engaged the services of some known lawyers including Femi Falana to interprete the constitution in a manner that would support its position. Recall that Falana had argued that it was an abberation for the Presidency to have forwarded Magu's name to the Senate, since the President has the powers to unilaterally make some extra-ministerial appointment without recourse to the Senate. This argument has since been adopted by the Osinbajo.

The refusal to replace Magu will ultimately pitch the Presidency against the Senate. Weeks ago, the Senate , apparently in power play, stood down the confirmation of some Ambassadorial nominees following Presidency's refusal to act on one of its resolutions. Now that it is refusal to accept their position on the Senate, what are the likely outcome? Is Magu really irreplaceable? Should the country be held to ransom because of ensuing power play between the executives and legislatiors over Magu? Note that the House of Reps have all thrown their weight behind the Senate.

MY PERMUTATION:

The NASS Would delay passage of the 2017 budget. note that the life span of the previous budget is due to elapse in days. Consequently, possible use of unbudgeted funds becomes illegal and ultimatley an impeachable offence. This could shutdown the economy and ground the country;

2. The Senate might also consider withholding confirmation of appointees of the Presidency

3. The Senate along with the Reps could attempt to frustrate the Administration's drive to give nigerians the change we yearn for;

4. Elements not favourable to the antics of the Prsidenecy could exploit the situation of projec t the executives as tyrannical and bent on eroding or violating the principle of separation of powers;

5. Nigerians could feel that there is no single person in the police with integrity to head the EFCC hence the reluctance to replace Magu

6. Dramas of loot recoveries would continue all in a bid to ensure job security

My humble assessment of the situation. My submission is that the man should go. Another ruthless Police officer should be nominated
