Members of the Joint Action Committee of Non-Academic Staff Union and Senior Staff Association of Nigeria Universities, University of Lagos branch are currently protesting against the sudden suspension of its strike by their executives.
The PUNCH had reported that the aggrieved members said they were not duly carried along by their leaders before the strike was suspended last Saturday.
The leadership of JAC of SSANU/NASU in the statement on Saturday had asked all its members nationwide to resume today, however, the UNILAG branch members took to protest against the suspension of the strike.
On Wednesday and as of press time, members of SSANU/NASU UNILAG, carried various placards with inscriptions, ‘We are tired of general secretary Adeyemi Peters and Mohammed Ibrahim of SSANU, they must go!’, ‘We are not civil servants.’
The JAC of NASU and SSANU embarked on a National Industrial Action on March 27, 2022, and called it off on August 20, 2022.
It also called on its members to resume duties on Wednesday, 24th August 2022, however, the members told our correspondent that they felt slighted saying they were not duly informed.
Some members of JAC of SSANU and NASU who spoke with our correspondent all said they were not told, adding that a congress was supposed to be held before the suspension of the strike.
A former chairman of SSNAU, UNILAG, Mr Oriwaye Adefolalu, said JAC of SSANU and NASU goofed by calling off the strike they embarked upon, towards pressurising Federal Government to perform its constitutional duties, without carrying along their members at their respective branches.
He said, “I am not the kind of person that can deceive you, records are there, the incumbent leadership of SSANU is not truthful. Initially, I thought they didn’t know what they were doing but they do.
“All they are after is their personal gain. The situation is getting worse every moment. I am 100% convinced that the suspension of the strike was stage-managed by the Minister of Education, Adamu Adamu, to save his job. Indications emerged yesterday that the Federal Government may consider the option of proscribing the Academic Staff Union of Universities, ASUU if it fails to call off the prolonged strike after an offer was made to it.
The Federal Government has also approved an additional N100 billion for the university sector as part of the understanding in the re-negotiation of the 2009 Agreement. Besides, N50 billion was equally approved to be shared by the university-based unions as earned allowances.
The four university-based unions that have been agitating for the payment of earned allowances are ASUU, which calls its own Earned Academic Allowances, the Senior Staff Association of Nigerian Universities, SSANU, the Non-Academic Union of Education and Associated Institutions, NASU, and the National Association of Academic Technologists, NAAT.
Recall that ASUU embarked on a month warning strike on February 14, 2022 and has been rolling over the strike till date, while the other three unions, starting with NAAT, downed tools in March.
Among the contentious issues are the non-release of revitalization funds, earned allowances, problems associated with payment of salaries through the use of Integrated Payroll and Personnel Information System, IPPIS and the re-negotiation of the 2009 Agreement.
While ASUU has insisted that its members should be paid through its preferred platform, the University Transparency and Accountability Solution, UTAS, the non-teaching staff, especially SSANU and NASU, have designed their own payment platform, the University Peculiar Personnel and Payroll System, U3PS.
All the the three platforms have been submitted to the government through the National Information Technology Development Agency, NITDA, which has subjected them to integrity tests.
ASUU adamant
While SSANU and NASU through their umbrella, Joint Action Committee, JAC, on Saturday signed agreement to suspend the strike on Wednesday for two months, ASUU has remained adamant, insisting that the government should pay its members the withheld five months salary before it would suspend the six months strike.
The Federal Government had invoked the ‘no work, no pay’ policy for the striking public university workers and the Minister of Education, Mallam Adamu Adamu on Thursday told journalists that there is no going back on its total implementation.
Banning ASUU on the cards
Multiple sources in the Presidency and the Ministry of Education told Vanguard that if ASUU refused to reciprocate the Federal Government’s gesture by calling off the strike, the government would consider the option of prescribing the union.
One of the sources who spoke on condition of anonymity, said: “Because of the priority President Muhammadu Buhari has paid to education, he has approved additional N100 billion for the universities and about N57 billion for the Polytechnics and Colleges of Education.
“This is part of the understanding with the unions on the re-negotiation of the 2009 Agreement. The government has also approved 35 per cent increase in salary for professors and 23.5 per cent increase for other lecturers. Government also approved N50 billion for earned allowances for the striking unions.
“It will be unpatrotic on the side of ASUU not to reciprocate the government gesture and call off the strike for our children to go back to school. The government is not also unmindful of the cooperation of SSANU and NASU for being patriotic.
“It is part of the labour laws that the unions, especially ASUU, should apply cessation of strike once a trade dispute is apprehended and conciliation is ongoing.
From available information, the Minister of Labour and Employment apprehended the strike on February 22, 2022, and subsequently held conciliation meeting on that day with ASUU and on March 1, whereas, the disputes with SSANU and NASU were apprehended on May 3 by the Minister of Labour and Employment.
“Why should ASUU say that the Federal Government has done nothing? You should also recall that the President co-opted his Chief of Staff, Professor Ibrahim Gambari, and the Secretary to the government of the Federation, Mr. Boss Mustapha, to join in the negotiation to end the strike. Why is ASUU recalcitrant and daring everybody?”
Expressing disappointment that ASUU had allegedly not appreciated the government efforts, the sources said the federal government had many options before it, which include prescribing the union.
“The government has so many options if ASUU refuses to be patriotic. One of the options is the proscription of ASUU which is contained in the Trade Unions Act and even in the Trade Disputes Act.
“The President can proscribe an association whose action is inimical and constitute economic sabotage to a country. In the Trade Unions Act, the President can withdraw the certificate of any organization whose conduct is not in tandem with the terms for their registration.
Also, Section 17 of the Trade Dispute Act permits the Minister of Labour to approach the National Industrial Court. CAP 78, laws of the Federal Republic of Nigeria 2004, to refer the matter to the National Industrial Court for adjudication to enforce the legality or otherwise of the ongoing prolonged strike by ASUU and to interpret in entirety the provision of Section 18 of the Trade Dispute Act as it applies to cessation of strike once a trade dispute is apprehended by the Minister of Labour and Employment and conciliation is ongoing.”
Attempts made to confirm the option of prescribing ASUU or dragging it to National Industrial Court if it fails to suspend the strike after the alleged government offer from the Minister of Labour and Employment, Senator Chris Ngige, was unsuccessful at press time yesterday.
NASU, SSANU shelve strike for 2 months
Recall that the Joint Action Committee, JAC, of the Non-Academic Staff Union of NASU, and SSANU, had on Saturday, announced the suspension of strike effective from Wednesday, August 24, 2022, for initial two months.
The suspension of the strike, according to a statement issued by the JAC’s spokesman, Prince Peters Adeyemi, followed the conclusion of negotiation between the two unions and the Federal Government team, led by the Minister of Education, Mallam Adamu Adamu.
The statement explained that the two months was to allow government implement the agreements reached.
“Part of the agreement is the decision of the government to set aside the sum of N50 billion for the payment of earned academic and earned allowances, cogent decision on the University Peculiar Personnel Payroll System (U3PS), release of the white paper on university visitation panel and funding of the universities.
“On the poor funding of federal institutions, the Minister said he directed the National Universities Commission, NUC, to ensure that all the schools are up-to-date on what they are supposed to do, otherwise sanctions will be visited on any institution that defaults.
“The Minister of Education also gave an assurance that no member of the unions that participated in the strike will be victimised.
“The Minister said President Muhammadu Buhari is committed to devote 15 per cent of the national budget to education.
“On the salary payment system, the Minister said the alternative payment systems provided by ASUU JAC of NASU and SSANU did very well. He added that the Federal Government is awaiting the report of the technical committee it set up before taking action on the matter.”
The JAC spokesman further said: “After a very prolonged negotiations and dialogue between the two unions and the Federal Government, led by the Minister of Education and after the meeting, the two unions decided to suspend the strike for the initial period of two months.
When we presented the offers that the government made to our members, they think that since the majority of the issues that are in contention have been substantially addressed by the government, the strike should be suspended, effective this Wednesday, August 24, 2022.”
Similarly, SSANU in a statement signed by its President, Comrade Mohammed Ibrahim, said: “Nigerians would recall that the Joint Action Committee of NASU and SSANU embarked on a National Industrial Action on March 27, 2022.
“The National Industrial Action was for an initial two week period, but owing to the nature of response which we considered almost non-existent, had to be renewed for another two weeks, leading to another one month and subsequently three months to allow concrete decisions to be taken on our demands.
“The purpose of the strike which entered it’s 146 days today was to drive home our demands.
Poor funding, governance of state universities
“In the course of the industrial action, we had engaged with various organs of government, including the Presidency, represented by the Chief of Staff to the President.
“We had also had meetings with the Minister of Labour and Employment, Minister of Education and heads of various governmental agencies in order to ensure a speedy resolution of the impasse.
“As responsible unions, we have always guided ourselves with the principle that in collective bargaining, no party takes all and no party should lose all. We are not deluded in any winner-takes-all philosophy but consideration for what is best for our members, what is best for our Nigerian university system and, indeed, what is best for the Nigerian nation.
“This strike would have been avoidable if both parties, the government and the union(s) had kept to their parts of the bargain. Unfortunately, the bane of industrial harmony in the university system has been the issue of not honouring agreements freely entered into.
‘Govt has committed to respecting agreements’
“Today, (Saturday) after series of engagements with the Minister of Education and having considered the issue that led to the strike, and having satisfied ourselves that government, this time around, has committed itself to agreeing to respect the agreements that have been reached at the meetings, we believe that it is only honourable that we give the government the benefit of the doubt, while the needful is being done at the government’s end.
“To this end, we hereby inform you of a two months window given to the government to actualize the agreements that have been reached. The two months window is in the nature of a ceasefire and does not represent a closure on the industrial action.
“It is our sincere prayer, given the assurance made by the Minister of Education and our commitment to ensure an end to the ongoing impasse, that the two months opportunity will suffice for actions to be taken and the entire matter laid to rest.
“We wish to thank all Nigerians, the Nigeria Labour Congress and affiliates, the media and all stakeholders in the Nigerian educational system for their various roles so far and plead with them to continue to prevail on government to play its own side of the bargain in the interest of peace in our universities and Inter-university centres.
“In view of the above, NASU and SSANU members are hereby directed to resume duties on Wednesday, August 24, 2022.” NAAT to meet on Thursday
Meanwhile, the National Association of Academic Technologists, NAAT, is expected to meet on Thursday to take a decision on whether to sign an agreement with the government to suspend strike.
President of NAAT, Conrade Ibeji Nwokomma, in a telephone chat with Vanguard yesterday, said: “We held a zoom meeting on Saturday and directed our branches to call a congress for a referendum and come for a physical NEC (National Executive Council) meeting on Thursday August 25.
“ After the meeting, we will be in a better position either to suspend the strike or to continue with it. Once the branches give the go ahead, we will suspend the strike for three months.
“The referendum will be on the release of enabling circular for the Consolidated Salary Structure for Tertiary Institutions, CONTISS 14 and 15. Tuesday’s meeting between the leadership of the Academic Staff Union of Universities (ASUU) and the Federal Government has again ended without an agreement.
This means the six-month old strike by public university lecturers is set to continue.
The striking lecturers had met with the Professor Nimi Briggs Committee on Tuesday at the National University Commission in Abuja with high hopes of resolving the impasse.
A senior member of ASUU, who craved anonymity told Channels Television that members of the Briggs renegotiation committee did not come with any new offer on the table.
Instead, the ASUU source said, the committee plead with the lecturers to suspend the ongoing strike, with promises that their concerns will be included in the 2023 budget.
According to the source, the meeting, which started at about 12pm, lasted for about three hours without any agreement reached.
ASUU’s Demands ASUU embarked on a four-week warning strike on February 14.
On March 14, the union extended the industrial action by another two months to allow the government meet all of its demands. A 12-week extension was announced on May 9.
Since May 9, the union has remained on strike, vowing to persist until its demands are met.
The academics are seeking improved welfare, revitalisation of public universities and academic autonomy among other demands.
One bone of contention for the academics is the non-payment of university revitalisation funds, which amounts to about N1.1 trillion.
But the Federal Government has said it doesn’t have the money to pay such an amount, citing low oil prices during the Muhammadu Buhari administration.
The agreement was struck in 2009.
Another is the issue of the Integrated Payroll and Personnel Information System (IPPIS).

I don't know what people are saying here. State universities were represented by state pro-chancellors in the renegotiation between ASUU and FG. ASUU fought for TETFund and today state universities are enjoying the benefits of TETFund. Some state governors are creating new universities and sourcing for TETFund in building lecture halls and other related facilities in those universities.

Pay rise: FG excludes state varsities, ASUU kicks The industrial dispute between the Federal Government and the Academic Staff Union of Universities may worsen following the insistence of the Federal Ministry of Education that its proposed agreement with the union will not be binding on state universities.
The spokesman for the Federal Ministry of Education, Ben Goong, in an interview with one of our correspondents in Abuja on Wednesday, explained that the Federal Government could not dictate to states on education as it is on the concurrent legislative list.
A committee led by the Pro-Chancellor of the Federal University of Lokoja, Prof. Nimi Briggs, had reportedly recommended a 180 per cent pay rise for lecturers, but the government was said to have favoured a 100 per cent increase.
It was gathered that the ministries of finance, education, labour and employment, Budget Office of the Federation, Office of the Head of Service of the Federation and the National Salaries, Income and Wages Commission were still working out the final details of the proposal.
The ASUU President, Prof. Emmanuel Osodeke, insisted that any agreement reached with the Federal Government would be binding on the states, thus opening another battle front between the union and the government.
The PUNCH reports that members of ASUU, including federal and state universities, had embarked on a strike on February 14, 2022.
Following the inability of the Minister of Labour and Employment, Chris Ngige to resolve the strike, the President, major General Muhammdu Buhari (retd.), two weeks ago directed the Minister of Education, Adamu Adamu, to take over the negotiation with the ASUU leadership.
To compel a quick resolution of the crisis, the Nigeria Labour Congress held nationwide protests on July 26 and 27 in solidarity with the union.
However, ASUU on Monday extended the industrial action by another four weeks.
Responding to a question from The PUNCH on whether the proposed agreement would be binding on all universities in the country, Goong said, “The agreement between the Federal Government is not binding on state universities. Education is on the concurrent list, the Federal Government cannot tell states what to do when it comes to the management of their institutions.
“Any agreement made with ASUU is only binding on the institutions owned by the Federal Government. The state government will handle their own institutions.”
But reacting to the government’s position in an interview with The PUNCH on Wednesday, the ASUU president stated that the university system is a single entity, arguing further that there was no disparity between state and federal universities.
Osodeke said, “I don’t know who you spoke to but that person doesn’t know what he is saying. I can tell you that the renegotiation team is made up of pro-chancellors of state and federal universities. So, how can anyone say the agreement won’t be binding on state universities? The person doesn’t know what he is saying.”
The ASUU leader contended that the few institutions that did not join in the strike were not their members. He also warned that Nigeria had just one university system and as such the issue of salary is personal to the union.

Osodeke stated, ‘‘Whenever ASUU is on strike, it is not about state ASUU or federal ASUU. We have one ASUU representing all universities in the country; those schools that are not participating in the strike are not our members.
‘‘The issue of salary should be left to the union to decide because when there was minimum wage adjustment, both federal and state schools were a part of it; even TETFund, it funds both state and federal institutions. Do we have a federal NUC or state NUC?
‘’The issue of salary negotiation is exclusive to the union. If a state can increase it, good; but we have one university system in Nigeria, and the state cannot even pay lesser than what the Federal Government is paying.’’
Commenting on the controversy, Ekiti State Commissioner for Information, Akin Omole, said on Wednesday that the state was not part of the ongoing negotiation between the FG and ASUU, hence, any agreement reached could not be binding on it as far as ASUU members in Ekiti State University were concerned.
Omole said, “If Ekiti State must have any dialogue at all, it can only be with the ASUU in EKSU. The ASUU negotiation with the Federal Ministry of Labour and Federal Ministry of Education is not done with the concurrence of Ekiti State Government. It is a national issue and it is the FG that is involved.
“With the principle of federalism, it is the employer and the employee that determine the pay. The salaries of workers in all states of the federation are not the same, then the issue is that what happens in another state cannot be binding on them.”
Likewise, the Benue State Commissioner of Information, Culture and Tourism, Michael Inalegwu said the state government was not involved in the ongoing negotiation between the FG and the university lecturers.
While acknowledging the lean resources of the state, the commissioner said that any agreement reached between the FG and ASUU may have serious consequences on the resources of the state but expressed optimism that both the state government and the state chapter of ASUU would reach a compromise.
He said, “The Benue State Government is not involved in the negotiation; whatever agreement they reached may not be binding on us because they are different structures. But you should know that our state government places its lecturers in the state university at par with their counterparts at the federal level.”

But the Anambra State Commissioner for Education, Prof. Ngozi Chuma-Udeh, said the state wass involved in the negotiations and would implement the outcomes.
She said, “We have a governor who takes education seriously and he is also a unionist. We are involved in the negotiations of the Federal Government with ASUU and anything they arrive at will be duly effected in Anambra. “Whatever negotiations other states are into, Anambra is also in it; we are not backbenchers in matters that have to do with education and especially when it has to do with progressivism.”
Speaking with one of our correspondents, the Special Adviser to the Osun state Governor on Education, Jamiu Olawumi, said if the lecturers’ salary was reviewed, states would expect the FG to assist them in meeting the demand.
On his part, the Gombe State Commissioner for Higher Education, Meshack Lauco, said out of the eight demands highlighted by ASUU, the state government had defaulted only in the earned allowances, adding that they had reached an agreement.
The Ogun State Government explained that it would wait for ASUU to present the agreement reached with the FG before it would commit itself to any arrangement.
The state Commissioner for Education, Science and Technology, Prof. Abayomi Arigbabu said the government would need to know the nature of the arrangement first.
He said “The question is loaded, I cannot answer yes or no. I should know what I want to agree to. Education is on the concurrent legislative list. If it is acceptable, we can now see what to do.
“When they come back and see what we can do; immediately, we will always try to make sure we do something so that our institution will not be inferior to others. So, let’s see what they agreed on and see how to work it out.”
Meanwhile the National Association of Nigerian Students on Wednesday called for the resignation of the minister of education.

Education / Strike Continues As ASUU NEC Fails To Suspend Action by AAA593: 10:39am On Aug 01, 2022 |
The industrial action by members of the Academic Sftaff Union of Universities, ASUU, will continue as members of the National Executive Council, NEC, of the union did not consider the option of suspending the action at its meeting which ended in the early hours of Monday in Abuja.
Checks by Vanguard showed that the national leadership of the union only briefed the meeting on their interactions and submissions made to the Prof. Nimi Briggs Committee set up the Federal Government to renegotiate the 2009 Agreement with the union.
A source said the leadership also told the meeting about the intervention of the Nigeria Labour Congress, NLC, in the matter and the subsequent nationwide solidarity rallies held by the Congress and its affiliates last week.
“Since there is no sign of any serious commitment on the part of the government, there was no need for the NEC to consider suspending the strike. Can anybody say this is what the goverement is offering? They were the ones who set up the Briggs Committee and it made recommendations and the government jettisoned the report.
“The government is not sincere. Let us assume that we are asking too much, which is not even the situation, is it not that the government will come out with its offers and we will deliberate whether to accept or not. We have been saying it that they want to kill the university system just as they did public primary and secondary schools.
“How many Nigerians are now proud to send their children to public primary and secondary schools that we all attended in those days? The national leadership of the union will soon come out with our decisions,” the source said.
Recall that the union has been on strike since February 14 this year and non-teaching staff unions later embarked on their own strike.
