The Federal Government has dissolved the Secretariat of the Advertising Standard Panel (ASP) over its approval of billboards termed as blackmailing the Presidential Election Petition Tribunal with the title: ‘All Eyes on The Judiciary.’

The Director-General of the Advertising Regulatory Council of Nigeria (ARCON) Dr. Olalekan Fadoləpo, announced the dissolution of the Panel in a statement released on Tuesday. Fadolapo said the Council has also suspended its Director and Deputy Director in charge of Regulations to allow investigations into the issue.

While noting that some of the adverts were not approved by the ASP, he said the Panel erred in the approval of one of the concepts as the advertisement failed vetting guidelines.

The ASP is the Statutory Panel under the Council charged with the duty of ensuring that advertisements conform to the prevailing laws of the Federation as well as the Code of advertising ethics of the advertising profession.

The statement
Highlighting the grounds on which the advert should not have been allowed, the ARCON DG in the statement said:

“The attention of the Advertising Regulatory Council of Nigeriə [ARCON) has been drawn to the “All Eyes on the Judiciary” advertisements exposed on some billboards across the country. The concepts exposed were not approved by the Advertising Standərds Panel, hence, the Council has directed that all the materials being exposed be brought down immediately and the violators sanctioned.
“The Advertising Standards Panel of the Council also erred in the approval of one of the concepts as the advertisement failed to vet guidelines on the following grounds:

“The cause forming the central theme of the campaign in the advertisement is a matter pending before the Presidential Election Petition Tribunal. Hence, it’s jus pendis.

“A matter being jus pendis and awaiting judicial pronouncement is, by virtue of the Nigerian legal system, precluded from being a subject of public statement, debate, discussion, advertisement, etc.
“The advertisement is controversial and capable of instigating public unrest and breach of public peace.

“The advertisement is considered blackmail against the Nigerian Judiciary, the Presidential Election Petition Tribunal, and particularly the Honourable Justices of the Tribunal who are expected to discharge their judicial functions without fear or favour over a matter that is currently jus pendis.”

The ARCON DG said the Council would set up a committee to investigate the circumstances leading to the “erroneous approval” of one of the concepts of the advert and the breach of the vetting guidelines.

“Consequently, the Director and Deputy Director, Regulations have also been suspended. The suspension is to enable an unprejudiced investigation of the issue. The Advertising Standards Panel (ASP) Secretariat failing to diligently exercise its function as the gatekeeper of advertising, advertisement, and marketing communications is hereby dissolved,” he said.

The ‘All Eyes on the Judiciary” narrative started as a social media campaign by the supporters of the Presidential candidate of the Labour Party in the last Presidential election, Peter Obi.

The campaigners are alleging plans by the judiciary to favour the incumbent President Bola Tinubu.

The Senate on Monday finally concluded the screening of 45 of the 48 ministerial nominees of President Bola Tinubu, confirming them as cabinet members after a week of intense grilling for some and cursory introductions for others.

Senate President Godswill Akpabio put the nominations to a series of voice votes, of which three are said to still be undergoing security clearance, including former Governor of Kaduna State Nasir El-Rufai, Stella Okotete (Delta State), and Abubakar Danladi (Taraba State).

The confirmation comes over a week after Tinubu’s transmission of a 28-member list to the red chamber for confirmation on July 27.

Last Monday, the Senate screened former governor of Rivers State, Nyesom Wike; Abubakar Kyari from Borno State; Nkiruka Onyejeocha (Abia State); Bello Muhammad (Sokoto State); Sani Abubakar Danladi (Taraba State); and Badaru Abubakar (Jigawa State).

Others are Joseph Utsev (Benue State), Olubunmi Tunji Ojo (Ondo State), Betta Edu (Cross River State), Uju Kennedy Ohaneye (Anambra State), Abubakar Momoh (Edo State), John Enoh (Cross River State), Iman Suleiman Ibrahim (Nasarawa State), and Yusuf Maitama Tuggar (Bauchi State).

The Senate on Tuesday screened ex-governors Nasir El-Rufai (Kaduna) and Dave Umahi (Ebonyi); Wale Edun, Uche Nnaji, Stella Okotete, Adebayo Adelabu, Ekperikpe Ekpo, Hannatu Musawa, and Musa Dangiwa.

The following day, the red chamber screened Dele Alake, Lateef Fagbemi and Muhammad Idris, Ali Pate, and Doris Uzoka.

Tinubu went on to send a supplementary list of 19 nominees to the Senate last Wednesday. Two days later, the President withdrew the nomination of Maryam Shetty of Kano State from the list, replacing her with Festus Keyamo and Mariya Mahmoud.

On Friday, the Senate screened Zephaniah Jisalo, Shuaibu Audu, Yusuf Sununu, Bello Matawalle, Alkali Saidu, Ahmed Gwarzo, Atiku Bagudu, Simon Lalong, Ibrahim Gaidam, Aliu Abdullahi, Gboyega Oyetola, Heineken Lokpobiri and Tunji Alausa.

The screening continued at Senate on Saturday with Lola Ade-John, Bosun Tijani, Isiak Salako, Tahir Mamman, and Maigari Ahmadu.

The exercise concluded today with the screening of Mahmoud and then Keyamo

Amid heightened tensions of a potential military invasion of the Niger Republic, which could escalate into a full-blown war, there are serious concerns that President Bola Tinubu could postpone presidential elections by four years should the Supreme Court order a rerun.

Mr Tinubu was, on March 1, declared the winner of the presidential poll adjudged fraudulent, with other candidates challenging his victory at the tribunal, where the case has been lingering for months. Nonetheless, the court will give a verdict no later than September 16 per the provisions of the Electoral Act, which states that petitions must be determined after 180 days.

Aggrieved parties are expected to take the tribunal’s outcome to the Supreme Court for a more robust judgment, which must be issued within 60 days, about mid-November.

Given the crucial nature of the matter and the trove of documents already admitted as evidence by the three candidates, the apex court may order a rerun among the top three contenders, Mr Tinubu (8.1 million votes), Atiku Abubakar of PDP (6.9 million votes) and Peter Obi of the Labour Party (6.1 million votes) to resolve the dispute.

But wielding the powers of the presidency, Mr Tinubu, who may have already invaded the Niger Republic by November, has the constitutional right to delay an election if the National Assembly grants his request.

It is highly unlikely that the Senate, led by Godswill Akpabio, a strong ally of Mr Tinubu whom he staunchly backed to clinch the position, would say no.

Also, members of the ruling All Progressives Congress (APC) make up most of the Senate, boasting 59 of 109 senators. They would give the president all the necessary support to ensure his requests are speedily acceded, even if it means delaying a court order.

On Friday, Mr Tinubu briefed the National Assembly on ECOWAS’ proposed military action and other sanctions against the coup plotters in the Niger Republic. Obtaining approval to delay the election, if required, seems to be a matter of thunderous ayes over minority nays.

Section 135 (3) of the constitution states that “If the federation is at war in which the territory of Nigeria is physically involved and the President considers that it is not practicable to hold elections, the National Assembly may by resolution extend the period of four years mentioned in subsection (2) of this section from time to time; but no such extension shall exceed a period of six months at any one time.”

While it may be wondered that the Niger Republic, with a small population of about 25 million people, would be easy to defeat, one can never be too certain in wars, particularly the one that now enjoys the alliance of Mali, Burkina Faso and rumoured support of Russia.

A valid case is that the U.S. invaded Afghanistan in 2001 to topple the Taliban following the September 11 attacks in which thousands were killed in coordinated bombings masterminded by Al-Qaeda terrorist Osama Bin Laden.

An invasion presumed to last a few weeks lasted decades, which saw the U.S. government eventually withdraw their troops from Afghanistan in disgrace and humiliation after 20 years.

Operation Iraqi Freedom is another example that captures the uncertainty of the duration of a war.

This was how Otueke bomboy allowed Boko to fester so that he would suspend the constitution and postpone the elections. They are so predictable. It is always wash, rinse, and repeat with these toddlers. When they tire, they will still PACK AND GO. At the end of the day, the royal that cunningly gave them the Greek gift idea will get to use this as leverage to bargain from another Royal. The Royal who puppeteered the Boko wahala got all he wanted.
