The constitution doesn't limit the number of Supreme court justices we can have but what of the process of packing the courts? You forget that any attempt to pack the courts is going to result in a legal battle and the conservatives will be having a 6:3 majority on the supreme court by the time Ginsburg's replacement is appointed.
