The North West Zonal Vice Chairman of the All Progressives Congress (APC), Alhaji Inuwa Abdulkadir, has served a fresh suit seeking N500 million as general damages from the Kaduna State Government, which allegedly demolished his property. Abdulkadir had withdrawn a different suit seeking to stop the demolition of his property so as to serve the notice which included his demand for the half a billion naira damages. The earlier suit was to stop the Kaduna State Urban Development Agency (KASUPDA) and the Kaduna State Government from demolishing his property. In the build up to the demolition, Abdulkadir had accused Governor Nasir el-Rufai of witch-hunt, saying he was being targeted over his stance on the crisis bedevilling the APC in Kaduna and the North West in general. Counsel to Abdulkadir, Barrister Festus Okoye, explained that the earlier suit was withdrawn because while a motion restraining KASUPDA from demolishing the said property was pending, the defendants mobilised bulldozers, mobile policemen and other security agencies to pull down the entire structure. Okoye had pleaded for an adjournment of the case in view of the fact that the defendant had demolished the property, despite being aware of the pendency of the suit and the order seeking for injunctive relief. “In the suit in court, our claim was just for N3 million and an injunction and order compelling them to carry out their statutory duty of using approval for the building plan,” he said. “Based on the new reality, we have served KASUPDA with a new 30-day pre-action notice. In the notice, we are claiming N120 million in actual damages and N500 million in general damages. “This is because we don’t want to be caught in the web of abuse of court process,” he said. Justice Mohammed Tukur Aliyu of Kaduna High Court had earlier adjourned the case when it was mentioned on April 24, following Okoye’s motion for adjournment in order to appraise the case because of new developments. The matter has been adjourned to May 22. https://www.dailytrust.com.ng/news/politics/demolition-apc-chieftain-sues-el-rufai-for-n500m-damages/197691.html

There was confusion in Senate yesterday over President Muhammadu Buhari’s letter on his medical trip to the United Kingdom. Senate President Bukola Saraki had at the commencement of the plenary read President Buhari’s letter dated May 5. The letter read; “ In compliance with section 145 (1) of the 1999 constitution as amended. I wish to inform the distinguished Senate that I will be away for a scheduled medical follow-up with my doctors in London. The length of my stay will be determined by the doctor’s advice. “While I am away the vice president will coordinate the activities of the government. Please accept the distinguished Senate president the assurances of my highest consideration. “ Soon after the letter was read, Senator Mao Ohuabunwa (PDP, Abia) raised a point of order, saying the President letter was ambiguous for not declaring the vice president as acting president. “Mr President I don’t think in our Constitution we have anything like coordinating president or coordinating vice president. Is either you are vice president or you are acting president and any letter should be unambiguous and very clear. “So, am saying that this letter really does not convey anything because coordinating has no space or any place in our constitution,” Ohuabunwa said. Countering the observation, the Senate Leader, Senator Ahmad Lawan (APC, Yobe) said there was no ambiguity in the President’s letter. He said, “I still rely on the first paragraph of that letter, which Mr President wrote to this Senate and read by the president of the Senate. I therefore feel that Mr President has done what the Constitution requires him to do and I urge this Senate not to go ahead to discuss this because it’s not an issue”. Saraki ruled Ohuabunwa out of order, saying, “I think it is a very clear issue and what we should be guided by is the Constitution and I think that it is clear, the letter has referred to the Constitution and there’s no ambiguity in the constitution.” https://www.dailytrust.com.ng/news/general/confusion-in-senate-over-buhari-s-letter/197058.html
