Security officials attached to Muhammadu Buhari have barred African Independent Television (AIT) from covering the functions of the president-elect till further notice.

Buhari Clamps Down On AIT

The security team according to Punch cited security reports and ethical issues as reasons for their action.

The directive which took effect on Monday, April 27, was enforced when members of AIT crew, who were at the Defence House to cover of a meeting between Buhari and a visiting Cuban delegation, were asked to leave.

Confirming this to Punch, the crew said: Yes, we were told but we cannot just leave; we have a job to do. In any case, we have not been officially informed about what we have done wrong.

On why AIT was restricted from covering functions of the president-elect, Mallam Garba Sheh, the director of press of the All Progressives Congress Presidential Campaign Organisation, noted that security concerns informed the decision.

He said: “AIT has been asked to stay aside based on security and family concerns. In addition, General Buhari has decided that they will have to resolve some issues relating to issues of standard and ethics.

“We will be talking with them to try and resolve the matter but for now, the station has been asked to stay aside because, like I said, there are some family and security concerns.

“They have been asked to step down their coverage until we resolve the matter with them on ethics and standards.”

In weeks building up the presidential election, AIT was criticized for airing a documentary, “The Real Buhari” which x-rayed the retired general’s past military regime as one that become the first to sentence a woman to death by firing squad.

The documentary was described by the All Progressives Congress (APC) as a“fabricated and hate broadcast” against its presidential candidate, Muhammadu Buhari.

The National Broadcasting Commission (NBC) also indicted the African Independent Television (AIT) and the National Television Authority (NTA) for the airing several documentaries which maligned the image of Muhammadu Buhari.

President Goodluck Jonathan has ordered the immediate release of the full audit report of the Nigerian National Petroleum Corporation, NNPC, accused of diverting $20 billion oil money.
The president gave the directive Monday, a day after the president-elect Muhammadu Buhari, pledged to launch an investigation into the claim made by a former governor of the Central Bank of Nigeria, Lamido Sanusi.
The government immediately released the report following the president’s directive. The presidency criticised the All Progressives Congress, APC, for accusing Mr. Jonathan of indulging in last minute illegal acts ahead of handover of power on May 29.
“President Jonathan is also deeply concerned by the continuing suggestions that his administration still has anything to hide about the unproven allegation that about $20 Billion is unaccounted for by the NNPC during his tenure,” said a statement by presidential spokesperson, Reuben Abati.
“To lay the matter to rest, President Jonathan in line with Section 7(2) of the NNPC Act, has directed that the full report of the PWC Forensic Audit of the NNPC accounts be released immediately to the public so that all Nigerians will be properly informed on the matter.”

President-elect Muhammadu Buhari has short-listed 18 persons across Nigeria’s six geo-political zones, who will make up his transition committee ahead of the May 29 handover date. The committee will be headed by Mallam Ahmed Joda.

It will be made up of three persons from each of the six geo-political zones. Sources told Thisday that the South-west has the highest representation (four persons).

The sources also hinted that the shortlist was not decided by Buhari alone; party leader Bola Tinubu also had a major and significant input in the list.

Thisday further quoted sources to have said that the committee will be inaugurated next week.

Other officials of the committee, according to Thisday sources, are Dr. Doyin Salami, who has been selected as Vice-chairman and Malam Adamu Adamu as secretary.

A female staff of popular eatery, Sweet Sensation, Oluremi Olayinka was on Wednesday convicted and sentenced to 266 years imprisonment by Justice A.A Akinyemi of Ogun State High Court, Abeokuta, for stealing N8million belonging to her employer.

The offence is contrary to sections 390(6)(7)(cool, 467 and 468 respectively of the Criminal Code Law Cap 29, Laws of Ogun State.

The court found the convict guilty on all the 34-count charges. She was sentenced to seven years on each of 30 counts and 14 years on the remaining four charges. The sentences are to run concurrently.

Additionally, Justice Akinyemi ordered her to return the money she stole in restitution to her victim.

Ms. Olayinka was arraigned before Justice Akinyemi on May 13, 2014 following a petition, alleging that she stole the sum of N8,000,000 (Eight Million Naira), which she received on behalf of her employer.

When the convict was confronted with the allegation, she admitted the crime only for her to dramatically pleaded not guilty upon arraignment.

In the course of trial, the Economic and Financial Crimes Commission presented four witnesses and tendered 16 exhibits to prove its case against the convict.

ILLEGAL POLICING OF THE REPUBLIC

Since you were appointed the Acting Inspector-General of Police by the President of the Republic on July 31, 2014 the Nigeria Police Force has been involved in partisan politics to the detriment of law and order in the country. Permit me to draw your attention to three glaring cases of political bias recently displayed by the Police under your leadership.

Firstly, the Osun State governorship election which took place on August 9, 2014 was almost marred by the Police and other security forces which arrested and detained over 700 leaders of the All Progressive Congress (APC). Indeed, some electoral officers who were assumed to be members of the APC were also railroaded to police custody. But for the personal intervention of Professor Attahiru Jega, the Chairman of the Independent National Electoral Commission, the said electoral officers would not have been released. Thus, the election would have been disrupted by the police and other security forces whose duty it was to maintain law and order during the democratic exercise. However, the detained APC leaders who were released after the election have not been charged to court for breaching the provisions of the Electoral Act or any other law whatsoever.

Secondly, Mr. Joseph Mbu, the controversial Assistant Inspector-General of Police in charge of Zone 7 of the Nigeria Poilice Force announced a ban any rally demanding for #bringbackourgirls within the federal capital territory. The ban was designed to assuage the feelings of some officials of the Federal Government who are embarrassed by being reminded of their constitutional duty of rescuing the over 200 Chibok girls who were abducted 6 months ago by the nihilist boko haram sect. In a judgment delivered last week, the Federal Capital Territory High Court declared the ban illegal, null and void on the ground that it constituted an infringement of the fundamental rights of the patriotic campaigners to freedom of assembly and expression guaranteed by the Constitution. In spite of the judicial indictment you have not deemed it fit to call Mr. Mbu to order for the reckless abuse of police powers.

Thirdly, you caused the security details of Honourable Aminu Tambuwal, the Speaker of the House of Representatives to be withdrawn last week on the ground that he had decamped from the Peoples Democratic Party (PDP) to the APC. As if that was enough, you decided to usurp the judicial powers of the federation which are exclusively vested in the courts by section 6 of the Constitution when you claimed that the Speaker had lost his office and seat as a federal legislator having contravened section 68 (1) (g) of the Constitution. By your illegal pronouncement you disregarded section section 50 (2) (c) thereof which stipulates that the Speaker of the House of Representatives can only be removed by a resolution passed by votes on not less that two thirds majority of the members of the House.

No doubt, your actions and utterances in the circumstance have exposed the Police to unwarranted ridicule as Nigerians are not unaware of the fact that when the Ondo State legislators elected on the platform of the Labour Party (LP) decamped to the PDP last month your office did not declare their seats vacant. In particular, you did not withdraw the security details of Honourable Jumoke Akindele, the Speaker who led her colleagues to dump the LP for the PDP. In the same vein, Honourable Ahmadu Fintiri, the Speaker of the Adamawa State House of Assembly and his colleagues who decamped from the PDP to the APC and have since returned to PDP. You did not have cause to declare their seats vacant. Neither have you withdrawn the security details of the Honourable Fintiri.

Thus, by subjecting Honourable Aminu Tambuwal to selective persecution on ground that he decamped from the ruling party you violated his fundamental right to freedom from discrimination. As you are no doubt aware, it is a breach of section 42 (1) of the Constitution and Article 2 of the African Charter on Human and Peoples’ Rights to subject any citizen of Nigeria of a political opinion to disabilities, deprivation and restrictions to which other citizens who hold alternative views or opinions are not made subject. Since the security details of other Speakers who decamped from the APC and LP to the PDP have not been withdrawn those of Honourable Tambuwal were illegally withdrawn. They ought to be restored without any further delay.

From the information at my disposal your harassment of the Speaker was instigated by the Presidency. But having regard to section 215 (3) of the Constitution which enjoins you to carry out the “lawful directions” of the President of the Republic with respect to the maintenance and securing of public safety and public order the actions taken on the Speaker are illegal and unconstitutional in every material particular. Therefore, you should withdraw your pronouncement on the office and seat of Honourable Aminu Tambuwal and advise the ruling party to seek redress in the Federal High Court on the constitutional implications of the defection. Furthermore, unless he is removed by his colleagues in the House of Representatives or by a competent court in the land Honourable Tambuwal remains the Speaker of the House. Neither the Police nor any other agency of the Federal Government can be allowed to resort to self help on the matter.

As law and order in the country cannot be maintained by a compromised Police institution you may want to resign your appointment if you are not prepared to discharge your onerous constitutional responsibilities without fear or favour, affection or ill-will. Before making up your mind may I remind you of the eternal injunction of the Supreme Court in the case of Attorney-General of the Federation v Atiku Abubakar (2007) 10 NWLR (pt 1041) 1 at 183. As the undisguised bias of both the INEC and the Police could not be justified over the illegal removal of the Vice-President for decamping from the ruling party to one of the opposition political parties the apex court held inter alia:

“Having regard to the nature of the function which the Nigeria Police Force also performs, that
body must also insulate itself such that impartiality and fairness may at all times be ascribed to
it. A situation where both of them ( the Inspector-General of Police and the Independent National
Electoral Commission INEC) appeal in the instant case is very much in bad taste.They have both
thrown the quality of impartiality and fairness which they must possess to the winds. Their acts
capable of eroding the public confidence in them. Unknown tob them, they may be said, by the
the public, to be biased and therefore not worthy to be regarded as impartial umpires. This trend
must not repeat itself for the good of the nation.”

Finally, if the trend of subverting the Constitution, the Police Act and the Electoral Act by your good self and other top police offices continues unabated we shall not hesitate to approach the Federal High Court to determine your competence and suitability to superintend and manage the Nigeria Police Force in the public interest.

Nigerians are at the losing end again after MultiChoice Nigeria, a South African satellite TV company implemented its 20 percent subscription hike despite court order stopping it from taking such action pending the determination of a suit filed against it by some lawyers.

DAILY POST recalls that a Federal High Court sitting in Lagos state had ordered DSTV to revert to its old subscription fee. The order followed a suit filed by two lawyers challenging what they termed an arbitrary increment in subscription rates imposed by MultiChoice Nigeria, operators of DStv and GOtv pay-TV platforms, on their subscribers.

Justice C.J. Aneke, in an interim order asked MultiChoice to revert to its old subscription rates pending the determination of the suit on the legality of its new tariffs.

Just as Nigerians were celebrating the court order, MultiChoice waved the order aside and has continued to charge customers based on its new subscription rate.

DAILY POST’s visit to MultiChoice head office in Wuse 2, Abuja on Friday revealed the company’s exploitative tendencies and its determination not to back down from its current subscription rates as customers who raised the issue of the existing court order were either escorted by team of security men from the vicinity or harassed by some of its officials kept at the entrance to monitor customer’s reaction.

When our reporters approached one of the staff whose identity we could not ascertain, we were told that nobody was ready to speak with us on the said subject. However, due to our reporters’ insistence, a team of policemen and SSS led them to have a brief session with a man who also refused to divulge his identity to us. While speaking with our reporter, the male official who is of average height told DAILY POST that he was not in any way aware of any court judgment and was not ready to react to what he had considered mere rumours being peddled by some unidentified persons.

The following conversation ensued between our reporters and the DSTV officials:

DAILY POST: We have just gathered that despite a court order that DSTV should revert to its old subscription rate, you have continued to charge customers based on the new tariff. As one of your customers, I just got a text message that my bouquet is now N3600 as against N3000 (makes to switch on the voice recorder)

DSTV official: You do not need to record as we have a formal procedure that we follow. You may need to get a reaction from our cooperate headquarters in Lagos. That’s the right channel. However, I will explain to you as a customer. You can give me your details so I can forward their contacts to you; then you can contact them.

DAILY POST: But you can also speak to us.

DSTV official: Like I said, we have a procedure. I can only talk to you as a customer, I will send you our cooperate coms number or I will forward your numbers to them so they can contact you. Then, you can get all your answers. We are aware of an injunction, but we have not received any order with relation to that. We have been hearing the rumour on the said order, but nobody has told us anything yet. So I will get them your details so you can get other information on this from them.

DAILY POST: Okay, that’s fine…

DSTV official: Any other thing? You said you want to make payment

DAILY POST: Yes, I will make payment now

Police: You want to make payment or you have already made?

DAILY POST: I would like to make payment, but I have just received a text message that payment is now 3600 against the 3000 that I was paying before now. Am I going to be charged for that now?

DSTV official: (Silent, appears confused)

Woman on black suits presumed to be DSS: (In obvious doubt) let’s see the SMS.

DAILY POST : Here…( stretches his mobile phone) You see, I was right.

DSTV official: You are already aware of the new subscription rate

Woman (DSS): Exactly!

DAILY POST: But I said I just got this text message, but there is nothing I can do, I’m already a customer, so I will make payment.

DSTV official: Is your payment altered? Have you been disconnected? (Still suspicious of the reporter’s motive)

DAILY POST: Not at all. It’s just because you people won’t be working on Saturday, so I need to make payment as my subscription would be altered on Sunday. (Brings out money from his pocket and counts) Three Thousand Six hundred (3,600)

Woman (DSS): (Calling a staff name) Go with him to counter six let them attend to him. Go with him…go with him to counter six, let them attend to him, and give him his receipt. (Woman follows to counter six and embarrassingly said: Please attend to this customer so we can free him from the environment.

Reporter: Madam (No response) Madam (referring to the woman)

Woman: Sirdam!

DAILY POST: Are we being harassed?

Woman: Tell us if we are not being harassed.

DAILY POST: You are turning the table round

Woman: You are done now

DAILY POST: Okay…thank you very much…

Also speaking to DAILY POST on Tuesday, a female senior staff at MultiChoice head office in Lagos said the company cannot respond “for now”.

Preferring anonymity, she said: “We cannot react for now because the case in court. Anything we say now may be use against us in court.”

Reminded that the new price regime was already in effect, she responded: “Sorry I cannot comment. There is a suit in court and that is the only place we are allowed to speak.”

Meanwhile, angry reactions have trailed the decision by MultiChoice Africa in disregard of a court order. Many subscribers interviewed by DAILY POST were enraged by the decision. They complained that it was unimaginable that DSTV could go ahead with the move despite the palpable opposition that the increment has generated from Nigerians.

Daniel Oleji said that, “it goes to show that they have no regard for their customers. How can they not because of the resistance of Nigerians cut down the increment to like 10 per cent and not the 20 per cent addition they have now effected.”

Another subscriber, who gave his name as KC called for the “arrest of those in charge of DSTV in Nigeria. Don’t you know what happens when you go against the court? For me, those guys should be arrested for showing contempt for our judiciary.”

Muhammed Yusuf on his part lampooned the government agencies that are supposed to track and control the excesses of companies, stressing that, “if they had been checking DSTV all these while and punishing them for the various times they have let Nigerians down in the services they provide, it wouldn’t have gotten this. But I don’t think it is too late for government to come hard on them. Let it use this opportunity to deal decisively with the organization so that they would think twice before exploiting Nigerians again.”

When told that such punitive action by the government can make the company quit operating in Nigeria thereby denying the country of the benefits of hosting the company, Yusuf said, “believe me, DSTV would on their own never want to leave this country as it knows what it is gaining. Even if it leaves, it wouldn’t take long before another company takes its place. Government just has to intervene for the sake of Nigerians.”

Ahmadu James says he is no longer concerned about whatever DSTV does as he has switched to another service provider, adding that, “I can assure you that there are many people like me who have migrated to other substitutes. Thank God, MultiChoice is not the only company operating cable television in this country. I am very sure that they would have noticed the decrease in the population of their subscribers lately.”

When accosted, Emeka Obi rather asked, “Tell me what would make them (MultiChoice) to increase their subscription fee. Are they in any way directly affected by the falling value of Naira? What exactly could have been behind this their greed when we still see many shortcomings in their services? Me, I have abandoned mine since it expired. Even if I subscribe now, where is the light with which to watch their programmes? Me I cannot pay their new price and they had better stopped sending me SMS reminding me to go and pay.”

Kunle Osofisan, a businessman residing in Oniru Estate, Lagos, lamented the decision of MultiChoice to go ahead with the new rates despite a court case.

“I’m aware that the court ruled on the case in the first week of April after they had implemented the new price regime,” he said.

“But as soon as the Judge ruled, a sensible company should have reversed and wait till the determination of the suit.

“Now, they are acting like there is no case on this matter. People who go to their offices to subscribe pay the new rate.

“Has our national identity or honour gone so low that a South African company now call bluff a ruling by a Nigeria court?, he quipped.

Another subscriber identified as Dora said, ‘’ you see… are we even supposed to be paying monthly to DSTV. Isn’t that an exploitation on its own? We have been enduring this. You could pay for 30 channels and you are only able to watch maybe five or ten channels. Why can’t we pay for what we watch? DSTV should stop exploiting us in our own country. Let them go to South Africa and do that.


Meanwhile, DAILY POST was at the Consumer Protection Council, CPC, in Abuja to confirm what the Council is doing to stop the alleged exploitative tendencies of MultiChoice. A source who pleaded anonymity told our reporter that a letter is currently being worked on and that very soon, it will be delivered to DSTV.
