As stated in The Truth Part 2, it is the absence of TRANSPARENCY and ACCOUNTABILITY, not hard work which is responsible for issues plaguing Nigeria. Accordingly, section 23 & 24 of the Fundamental Objectives and Directive of State Policy and paragraph 8 of the code of conduct for public officers, the burden to effect changes in Nigeria lies with every citizens at home and abroad. THE FIFTH SCHEDULE - CODE OF CONDUCT OF PUBLIC SERVANTS is highlighted in sections 66, 107, 172, 173, 209, 292 and 318 of the Constitution. The Acting President (henceforth AP) admitted that public servants particularly the Executive, Judiciary and Legislative arm are the “group of people who have the special burden of providing and preparing for the future”. But this can only be achieved by ensuring that the provisions enshrine within the Constitution are upheld. To echo what was written in the post titled, The Nigeria Constitution Simplified, “solution proffer outside the constitution will NEVER work.” A constitution is the system of fundamental principles according to which a nation, state, corporation, or the like, is governed. Nigeria to a large extent has a good Constitution but, why are the provisions enshrine within not being upheld particularly by the Executive, Legislative and Judiciary who bears that “special burden”? It was argued by Robert Clark (SAN), in an interview given on Channels Television, and others that the Constitution with Amendments 2011 created more problem for Nigeria and is responsible for the state of reproach that the nation is in today. Until proven otherwise, there is an assumption that this argument is based on part 1, paragraph 14 (a)(b) of the Code of Conduct for Public Officers which exempts members of the legislative houses from the provisions of paragraph 4-(1)(a)(b): “A public officer shall not after his retirement from public service and while receiving pension from public funds, accept more than one remuneration position as chairman, director or employee of: (a) a company owned or controlled by the government: or (b) any public authority.” And paragraph 11-(1): “Subject to the provisions of this constitution, every public officer shall within three months after the coming into force of this Code of Conduct or immediately after taking office and thereafter – (a) at the end of every four years; and (b) at the end of his term of office, Submit to the code of conduct bureau a written declaration of all his properties assets, and liabilities and those of his unmarried children under the age of eighteen years.” To put this into perspective the former Governor, Bukola Saraki, a retired public officer who is now the Senate President is exempted amongst others. As a result, he is in receipt of a pension as former governor which is estimated in the region of N6 million a year (Six Million Naira), totalling to approximately N36 Million (Thirty Six Million Naira) in 6years in addition to his current salary and emoluments as a Senate President since 2011 to date. In addition to members of legislative houses being exempt from key provisions of the Constitution, they also have at their discretion the power to exempt certain individuals. In other words, they are protected and they can choose individuals to protect as well. Is there any wonder why such positions in the Government are coveted? Holding such a position easily leads to; (1) the defraud of the nation and; (2) evasion of justice. The AP signed the Executive Order on the Promotion of Transparency and Efficiency in the Business Environment — May 18, 2017, why not promote the same in government? The Government has a role to ensure fairness to all but how would that be possible when the National Assembly is not only exempted but also have the power to exempt individuals from key provisions of the Constitution. The constitution should be a safety net for all without prejudice or bias. Justice should be blind. As stated in section 14 (2) (a) Under the Fundamental Objectives and Directive of State Policy “It is hereby, accordingly, declared that- “Sovereignty belongs to the people of Nigeria from whom government through this constitution derives all its powers and authority.” Fellow Nigerians from the above one can understand why the Constitution with Amendments 2011 is frowned upon. You will agree that this is not democracy but demonstration of madness, the highest form of insanity. Nevertheless, we have none but ourselves to blame because we gave this “special group” the power through the constitution. So, not until the citizens rise up and demand that the AP repeal these exemptions we will be running in circles. This madness is further celebrated by the present culture in Nigeria where individuals guilty of defrauding the nation are given chieftaincy titles, positions in our religious and circular organisations among other things. We need to start acknowledging that some of our accepted culture/tradition is damaging to our fate and dignity - and start to shape our lives accordingly. On May 7th 2017, there was a Bill to Amend the Central Bank of Nigeria (CBN) CAP C4 LFN, 2007 and for related matters, 2017 (S.B. 64), in an attempt to ensure Transparency and Accountability in the operations of the banking sector. This was deliberated is subject to approval by the National Assembly (“special group”), a typical example of “the pot calling the kettle black.” In his book titled “The man dies” Wole Soyinka stated that “The man dies in all who keep silent in the face of tyranny”. Many Nigerians are afraid to stand up for the truth, we live in fear of been persecuted particularly those living in abroad. Some of those living abroad may think the issues of Nigeria does not concern them but think again. Most are reluctant to travel home citing bad government, lack of electricity, security, etc. Why not get involved and be a part of the solution for change so that travelling home would a pleasure and not a burden. It does not matter where you are, fear enslaves, it gives the tormentor the power they do not have. When the people fears the government there is Tyranny but when the government fears the people, there is Liberty. The question posed here is, how can the government fear the people when they keep silent and act cowardly? Corruption is simply define as " the process by which a word or expression is changed from its original state to one regarded as erronous or debased". With this definition, one can judge what will be the actions of someone whose words are considered to be corrupt. In his book titled "The man dies" Wole Soyinka stated that "The man dies in all who keep silent in the face of tyranny" . In light of this, let us not be afraid to stand up and demand what is rightfully ours which is democracy, a government of, by and for the people. I am reaching out to you, in an effort to form a political party where every Nigerian citizen, both at home and abroad has a stake in it. It is my hope that you will accept this invitation with the same spirit, heart and mind. By the special grace of God, there is nothing impossible to achieve if we work together in unity in an effort to effect the desire changes in Nigeria. Our core value is respecting differences while working together not only to promote the constitution but to implement, preserve and defend it's basic fundamental principles and it's objective in the society as prescribed. Put simply, we will do what we say, with the help of God In the spirit of transparency and accountability, our sincerety for change is now been put to the test. We must take personal responsibility and start asking our elected representatives both at local and national level legitimate questions.These questions must be constitutionally base, such as: 1. Article 16 section (2)(d): Why is there is no suitable and adequate shelter? Reasonable living minimum wage and old age care/ pensions are non existent, why is that? Where are the provisions for unemployment and welfare of the disabled? 2. Article 17 section 3 (d): The public health care facilities/conditions are deplorable and the costs are out of control but these are only felt by those who are unable to attend private hospitals or travel abroad for medical treatments like the government officials and their families. How can this be term as providing adequate medical and health facilities for all citizen? 3. Article 18 section (1),(2),(3)(a)(b)(c): How does allowing the education system to deteriorate, leaving the less unfortunate children to suffer while government officials send their children to private schools abroad and home, amounts to ensuring equal and adequate educational opportunities for all citizen? 4. Article 14 section (b): Dire security challenges continues to plague our nation leading to public distrust and lack of confidence. From the poor quality of police personnel, equipment and facilities to the fact that policing of the nation has now become policing of government officials. How is the primary purpose of the government being fulfilled in such case? You must demand for answers as they are oblige to provide one. Remind them of article 14 subsection (2) (a) that " Sovereignty belongs to the people of Nigeria from whom government through this constitution derives all its power and authority". It can be argued that a life does not get better by chance but it definitely gets better by making the right choice. The next general election is just around the corner, these corrupt and unjust leaders or their representative will approach you wanting to buy your vote with money, bag of rice etc, tell them your vote is not for sale, its your voice and power. Know the facts before you choose, they are chiefly concern with their own personal profit and pleasure, they don't care about you and your family nor will they ever. Do not be sway by their promises either because they are not doing you any favours for providing such given rights that they swore an oath to. There is a time and place for everything but protesting without applying the rule of law will not work. We must not allow the labours of our heroes past to be in vain. They fought against corruption on the basis of the rule of law because they wanted a better governance. Some of them were killed, in my own opinion, because of lack of support from the people they were fighting for. We are still in the same situation and possibly worst. According to Fela Anikulapo, suffering and and smiling. The target is for this message to reach fifty million Nigerians on or before the end of this year (2017) but this cannot be achieve without your help, let us make this miracle happen and turn our great country around for good, it is possible. Let us take a step back and a closer look at the bigger picture. Most Africans taken away as slaves in the 1500's and scattered all over the world have probably lost their identity in terms of not knowing where they are from and the specific characteristic which distinguish each tribes. This could be as a result of not reconnecting to their ancestry even after the abolition of slavery. Presently, Nigerians residing outside the country were not taken slaves, but left citing duress from corruption, poor economy, lack of electricity, lack of security, bad leadership among other things. The same fate of losing ones identity may befall us, our children and their children's children if we fail to act now to effect the necessary changes needed to save our great nation. The situation in Nigeria affects all. In lines 4,5 & 6 of our national anthem, it is stated, "...The labour of our heroes past Shall not be in vain To serve with heart and might...". These words were sang with much pride while growing up but it now appears as if the pride has fade away. Why or what happened? According to Whitney Heuston, "...Everbody is searching for an hero...". We all can be heroes but note self or selfishness will not make one an hero only selflessness. As parents/guardians, we wants our child/children to see us as their heroes but how can we be by keeping silent, pretending not to know what to do, resorting to complaining about inactivities and corruptions in high places, such attitude can best be describe as that of an ostrich, who buries its head in the sand at the slightest inkling of concern that he may have to deal with a task perceive as being complicated, frustrating, boring, or otherwise unpleasant in some way. Letbus stop deceiving ourselves, as God cannot be mocked. A man reaps what he sows. Galatian 6v7(NIV) As there is no room for neutrality, We must take a stand either for or against change. We all occupy position of leadership over our children beside the usual provision of shelter, food and clothing, our main goal is to protect them by actively been their voice, doing or participating in bringing about the desire changes. By omission or commission, it's a choice we have made by bringing them into the world, we are now faced with the same choice to protect them, their future and that of their unborn children by making Nigeria a better place for them to visit and maybe return someday should they desire. This is a fresh appeal to join this crusade. We may differ on the way forward for the country. It was revealed by a reliable source that a bill is to be tabled in the House of Assembly giving more power to the Senate President, Bukola Saraki. This is definitely frightening because such power can have a catastrophic effect on the nation. Every government has the potential to be corrupt if left unchecked. The problems facing Nigeria today is no different from the ones faced in other part of the world. The countries that make theirs work, they promoted and applied the rule of law as stipulated in the constitution. Also, in their narrative of matters they empower the people. In the past few months, there have been several publications highlighting the state of the nation. One such notable publication was by Ben Murray Bruce (BMB, henceforth), self acclaimed advocate of commonsense for the people and member of the National Assembly under the platform of PDP. In an interview given 3 months ago to Forbes TV Nigeria posted on YouTube, My (BMB) Worst Days, he claimed to be on the side of the poor/masses as he feels their plight. Is it to serve the people? He stated, "......Buhari is the President of Nigeria, he is my President, regardless of what I feel, I must respect him, I must treat him as my president because if I don't value him nobody will value him, In 2019 we can fight but right now he is my president...." . The poor/ masses are and have been suffering for a very long time, so why wait till 2019 to challenge the president on the rule of law and its application in the society? Is there commonsense in that? Is the plight he is feeling not strong enough. Also, his validation of the President does not have any bearing on how people view the President because popular opinion suggest that, the average Nigerian do not like Buhari. He blames issues of kidnapping, rape, Niger Delta problem, Boko Haram on the people being hungry. One finds these comments incredible. The issues highlighted above is as a result of the absence of good governance and not hunger. What would happen then if every Nigerian that is hungry take to the issues mentioned, as most Nigerian are presumed to be hungry. When Donald Trump made an executive order banning certain countries entering United States they fought him by challenging the order in court, it was subsequently overturned by the judiciary citing that it is unconstitutional. Does that suggest that they did not value and respect the President? But BMB takes to social media, supposedly exposing the corruption of the current government. What happened to the constitution he swore an oath to? why is he not promoting it and its application by going to the Court to stop government officials from looting the system? Why is he still part of the government that he is actively criticising? He continues to enjoy all the benefit as a member of the national assembly. Why has he not vacate his seat in the house, resign as a member of PDP and fight for the people on a different platform? Whether in private life or in public, one should test the commitment of the person intended to lead. If BMB is going to be the country future president or probably fronting for someone, then serious question needs to be asked and answers demanded. One will view his actions as hypocritical and his comments contradictory given that the constitution is the instrument use in running a nation, no other change proffer outside its premise will bring about the desire changes. On behalf of the people, who are both judge and jury, we are demanding that he provides answers/clarification to these questions particularly the issue of the bill giving the Senate President more power. Alternatives to bad governance and unjust leadership are individuals, who stand up to defend the core values of The Constitution and a formidable opposition party. Let us compare and contrast the present administration to the previous ones, they are the same individuals who keep recycling themselves. Take a look at the All Progressive Congress, it is a make-up of members from the PDP and other failed parties who, even after 16 years of control did not effect desired changes. We are all aware of the many corruptions plaguing our nation, Nigeria, but splashing it all over social media via videos or write ups does not proffer solutions. People who engage in such practices are urged to do their part by making a difference and provide solutions. Let us go back to the drawing board and recruit fresh thinkers with a good grasp on the constitution to move Nigeria forward. Lessons can be learnt from the four lepers (2 Kings 7:3-29) who despite knowing their fate did not just resign to die but acted and went in search of a solution. Corruption is a known fact of Nigeria but not impossible to eradicate with the right attitude. Selfishness, greed, self centredness and the sense to get rich at the expense of others are not the right attitude or the solution. The lepers were not selfish and it is because of their unselfishness that the famine came to an end. Ben Murray Bruce, Senator in the House of Assembly under the platform of PDP, Chairman Silverbird Group and acclaimed advocate of Voice of Commonsense for the People, has been exposing the corruptions of the present administration. Could he be the alternative that the nation requires? If so, why is he still a part of the government that he is actively criticizing?
