And we should return the money we spent out of it immediately.

When we got to my mom's bank, we went to customer agent area, instead of writing the mandate letter, we told the agent everything that happened leaving nothing untouched. the agent said we should give him the number of the staff that called us, when he called the Sarah with his phone, Sarah gave him another name, instead of introducing herself as Sarah, she said her name is Evelyn. She now told the agent to hold my mom down till she (Evelyn) gets to that bank to arrest my mom or whatever.

The agent said on what basis would he hold my mom down. The agent checked the description when the money was sent and he couldn't understand the description. He was saying how could this be government money. He told my mom to try and return the money spent and he told us to go.

The description on the transfer when it came in on Sunday was: "National Procurement of Scanners" #3million.

Is this truly a government money?

Deposit everything you spent into your mum's account and leave it there. Let the banks sort it. Don't transfer the money to any 3rd party. If it is a mistake the banks will reverse the transfer between themselves. Just make sure you have the money in your mum's account.

It's not for you to transfer or pay the money into some other account. What should be required of you is to give the mandate (authorized instruction) for the bank to reverse the 3m wrong credit. There are conditions under which the bank may not be in a position to reclaim the funds, but with your story line, you are not likely to meet those conditions. So the bank can compel you to give the reversal mandate. Or they'll go ahead and do the reversal even if you do not give the mandate. He said if you received money into your account that you know isn't yours and you spend out of it, its not a criminal offense yet. It only becomes an offense when its clearly proven to you that the money was wrongfully paid into your account and you're adamant on returning the money plus the one you've spent. In fact he said you're by law entitled to a percentage of the money as compensation for returning it. O think the percentage was between 10% or 5%

Please don't mind those advising you to commit more crime. What you did was wrong. You shouldn't have spent what doesn't belong to you. If it a crime money, you have lopped yourself into the crime as benefiting from it (accessory). If its a clean money you have put yourself into debt. You were careless and thoughtless. Your action is criminally inclined.

My suggestion, report to any nearest police station or better still, get a lawyer to approach any magistrate court prohibiting any enforcement agency to arrest your mum and you all. Then, state your willingness to return or better still deposit the money back to the account, even its frozen already.

Your lawyer will write to the bank to explain your innocence and the money should be reverse to the sender being government or private.

Be very careful next time. There is no freebies in this world.

The money is not from any government its a laundered fund, but that does not justify the woman's action, if it was me I would have gone to the bank to complain. You self be strong Nigerian pikins. You spent 220, 000 Naira from money that doesn't belong to you. Between the space of how many days?

Anyways, since all you used the spent money to procure are phones and co, you can easily sell those items and refund it to the bank and not to Sarah.
Sarah is not clean. How possible is it for someone to send 3 million Naira into a wrong account? If you must refund it, I must be to the government purse and not to an individual account.

It happened to my brother through an erroneous transfer, they will freeze the account after a complain only for a week whole giving out Ur number to the sender on plea after then unfreeze the account. The bank has no right to freeze Ur account without a court order or a criminal act by U.
