The Imo State High Court gave a judgement on July 28, affirming Umeoji and Jude Okeke as candidate and Chairman of APGA respectively.

However, Oye & Soludo were not joined as parties. Oye, childishly as always, rather than appeal has gone to the same Court to be joined as parties, and the case revisited.

Even though, the Court reserves the rights to revisit such a case where interested parties weren't joined to the suit...Justice Isiguzo insisted that he won't revisit the case and the ruling of 28 July stands.

Oye & Soludo had pressed for a Stay of Execution which was also turned down by the Judge, instead asking them to approach the Appeal Court in Owerri for the request...

I just read another clearer interpretation of the judgement. The OP simply sensationalized the headline as usual. The court agreed that Oye has shown sufficient interest in the case and was granted the leave to appeal the judgement at the appeal court. So, it is left for him to appeal the July 28 judgement at the appeal court. Hopefully, the Owerri division of the appeal court will upturn the useless high court judge that ruled on the case without hearing from Oye.

UPDATE

The Imo State High Court has granted the National Chairman of APGA, Ozonkpu Dr Victor Oye leave to appeal the judgment of Hon Justice Iheaka delivered on the 28th day of July, 2021. In a ruling delivered today, 19th of August, 2021, the vacation court presided over by His Lordship, Hon Justice Isiguzo held that Ozonkpu Dr Victor Oye has shown sufficient interest in the subject matter of the judgment and thus ought to have been joined ab initio to the suit at the lower court. Consequently, the court granted him leave to appeal the perverse judgment of the lower court.

The court however declined to grant the application to Stay Execution insisting that the Court of Appeal is in a better position to entertain the application for Stay of Execution.

With the ruling of the court today, the coast is now clear for the Court of Appeal, Owerri Division to follow the judgment of Court of Appeal, Kano Division to set aside the judgment of Owerri High court which was delivered without jurisdiction.
