VAT Amendments: NBA, SANs Caution NASS, Fault FIRS Planned Revenue Court by ogododo: 5:20am On Sep 10, 2021
The Nigerian Bar Association and prominent senior lawyers, on Thursday, warned the Federal Inland Revenue Service and the National Assembly against any illegality in their bid to amend the Value Added Tax law in the country.

The Publicity Secretary of the NBA, Rapulu Nduka, and Senior Advocates of Nigeria, Chief Mike Ozekhome, Ebun-Olu Adegboruwa and Afam Osigwe, gave the warning in separate interviews with our correspondents in response to the judgment of the Federal High Court sitting in Port Harcourt, which held that the Rivers State Government had the powers to collect VAT within its territory.

While the NBA urged the lawmakers representing the various states to be on the lookout for the request by the FIRS to include VAT on the Exclusive Legislative List, the SANs supported moves by the Lagos and Rivers state governments to take over the collection of the tax.

Following the court’s rejection of the FIRS’ application for stay of execution, the Rivers State Government ordered companies based in the state to start paying VAT to its revenue board.

On Thursday, The PUNCH reported that the FIRS had written to the National Assembly to seek the inclusion of VAT on the exclusive legislative list.

Nduka, in an interview with one of our correspondents, supported the judgment of the Federal High Court, saying it was valid.

He also said the FIRS could appeal the judgment, but stated that the National Assembly should be cautious with the request of the agency for the amendment of the VAT law.


He stated, “Firstly, the judgment of the Federal High Court regarding VAT, to the best of my knowledge, is a valid judgment. If the FIRS feels aggrieved, it can appeal to the Court of Appeal.

“On the issue of the FIRS requesting the National Assembly to amend the Constitution to put VAT collection on the exclusive legislative list, Nigeria is a country governed by laws and the NBA advocates the promotion of the rule of law.

“There are procedures for the amendment of aspects of the Constitution, which must be followed. We hope that our lawmakers do the right thing. Thankfully, we have representatives from all states of the federation.

“I will be surprised if the FIRS pushes for a distinct Federal Revenue Court, especially at this time.

“It really speaks volumes. We must recall that the Federal High Court used to be a revenue court. One would wonder if the proper response to an unfavourable judgment is to ask for new courts.”

Also, a legal practitioner, Kudos Okor, stated that VAT should not be collected by the FIRS.

He stated, “If you look at constitutional provisions, you will find out that a lot of the taxes paid to the Federal Government are actually supposed to be paid to the states.


“I believe the demand of the FIRS is inappropriate; it is only trying to extort Nigerians. I advise every state governor to kick against this demand. No state governor should allow the Federal Government to take what rightfully belongs to the state.”

Adegboruwa backs Rivers, Lagos on VAT laws
Adegboruwa also threw his weight behind the state laws on VAT in a statement on Thursday, saying, “State VAT law is a form of restructuring. It is restructuring and I support it 100 per cent. We have been shouting and crying for this lopsided federalism to be made equitable.

“Those who make peaceful change impossible make violent change inevitable.”

Adegboruwa commended the Rivers State Governor, Nyesom Wike, for starting the revolution.

He also commended the Lagos State Governor, Babajide Sanwo-Olu; the Attorney-General of Lagos State, Moyosore Onigbanjo (SAN); and the Lagos State House of Assembly for their stance on VAT collection by the state government.

Meanwhile, members of the business community and the Rivers State Civil Society Organisation have backed Wike’s decision on VAT collection.

The President, Rivers Entrepreneurs and Investors’ Forum, Ibifuro Bobmanuel; and Chairman, Rivers State Civil Society Organisation, Enefaa Georgewill, gave the governor the backing in separate interviews with one of our correspondents in Port Harcourt on Thursday.


Bobmanuel, a financial expert, said when state governors realise that VAT would be paid directly to the states, they would begin to treat businesses with a lot of respect.

On his part, Georgewill lauded Wike for the courage to fight a cause, which he said was in order, adding that the present situation meant more revenue for the state.

Ozekhome, on his part, said states, by reason of the legislature, should not lose consumption taxes to the Federal Government.

Ozekhome made his position known in an interview with The PUNCH.


He said, “VAT is ideally a matter within the residual legislative list of states. It is a consumption tax collected by producers and manufacturers of goods and is then passed on to the ultimate consumers.

“Why, in a federal system of government such as we operate, should a state that harbours industries and companies lose the consumption tax to the Federal Government, which is a central government? It makes no sense at all.

“If the National Assembly makes the mistake of legislating on and including VAT as a matter on the Exclusive Legislative List, it can be lawfully challenged in a court of law. All the state attorneys-general should join hands together and sue on behalf of their various states.”

On his part, Osigwe said the call for the establishment of a special court was unnecessary, adding that it would further strain the nation’s economy.

He stated, “In Nigeria, we have this attitude of thinking that a court must be created for everything. We want courts created for economic and financial crimes, electoral offences and now revenue collection.

“The Federal High Court started as a revenue court and today, it has become a court of all jurisdictions.

“On VAT, for the FIRS to write to the National Assembly shows that it is too agreed that there is a need for clarification on VAT.

“The states had largely yielded power to the Federal Government until recently. I think the ongoing judicial process is a welcome development. We need to have some certainty on the matter.”

But the National Assembly said the FIRS, just like any other institution, group or individual, had the right to seek an amendment to the country’s Constitution.

The Chairman, Senate Committee on Media and Public Affairs, Senator Ajibola Basiru, when asked to comment on the legality of the request of the tax agency, said the FIRS had not done anything illegal.

He, however, said the approval of such an amendment was not automatic because the request would pass through normal processes.

Basiru stated, “Every stakeholder has the right to make requests for the amendment of the constitution. However, whether the amendment will pass or not will depend on it passing through the requisite processes stipulated by Section 9 of the Constitution.

“I can’t express any personal opinion on the FIRS letter, because I’m a member of the Constitution Review Committee and the matter has not come before us.

Lagos hails Assembly over VAT bill passage
The Lagos State Government has hailed the passage of the Value Added Tax Bill by the state House of Assembly, saying it followed due process.

The state Commissioner for Information and Strategy, Mr Gbenga Omotoso, in an interview with one of our correspondents on Thursday, said the passage of the bill would benefit residents of the state.

He said, “The House has just passed the bill; it has not been returned to the executive. We are waiting for them to bring the bill for the governor to sign.

“I think due process was followed; the bill went through various reading stages and there was a public hearing, where residents of the state made their views known on the bill.

“This is not the first bill that has been passed by the Lagos State House of Assembly. The executive has sent in about 40 bills since Governor Babajide Sanwo-Olu assumed office. This is just one of the bills. It is all about Lagosians, rule of law and true federalism. It is a matter of law, not emotions.”

The state House of Assembly had on Thursday passed the Lagos State Value Added Tax Bill.

According to a statement, the bill was passed during plenary in which the lawmakers unanimously adopted the recommendations in the reports of the Committee on Finance as the resolutions of the House, leading to its third reading.

This culture of monkey dey work baboon dey chop will soon be over. Why would a state like Lagos State generate N41 billion and be given N14 billion from it? How can such a paltry amount meet the development needs of the state? Same for Rivers; they generate N15 billion and end up with N4 billion. It is high time this injustice was thrown into the Atlantic ocean. You don't want people to secede because it is extinction. You don't want to restructure. You don't want to practise fiscal federalism. You don't want to stop open grazing. You ban alcoholic drinks from the south in Kano by your religious police, yet you keep pouting one Nigeria uppandan when there is injustice and lack of accountability everywhere. Buhari is hastening Nigeria's dismemberment and anyone who thinks otherwise is playing with self-delusion.

The south is the resource base of Nigeria but it has remained chained by the North. The time to break free or renegotiate this fake, one-sided, lop-sided, north-centric and Fulani-dominated union is now!

SAN , there is going to be amendment to constitution , now the states are going to collect VAT, state should contruct road in their state and don't wait for federal government, Education(Higher institution ) should be solely for state, Health care only be exclusively right of the state.. state police either. Telling me they should not be amendment to constitution is a lie.

You can't be collecting VAT from a forward thinking state to give to a backward thinking state, it doesn't make sense undecided
If States like Lagos, Ogun Oyo, Rivers and Delta are attracting investors because of the friendly environment and State like Zamfara, Niger and Katsina are attracting Bandits, which fault is it

When you see the Southern governors, politicians, elders, elites, traditional rulers, cashivists, freedom fighters fighting for their private pockets & their hate doped retards on social media especially those from the Niger Delta talk about restructuring & resource control, you will think they genuinely love Nigeria & their region.
Sure No!
What they want is more money, more power & more control over the money without no one querying them.
Those governors, politicians, elders, elites, traditional rulers, cashivists & freedom fighters fighting for their private pockets that swallowed the 6 trillion naira in NDDC over the past 18 years meant to develop the Niger Delta in addition to squandering trillions of naira & billions of dollars that accrued to Niger Delta from federal statutory allocations, 13% derivation funds, ecological funds, Ministry of Niger Delta funds, taxes, royalties rents etc with only poverty, deprivation & backwardness to show for it every 4 years are the same governors, politicians, elders, elites, cashivists & freedom fighters fighting for their private pockets that will manage a restructured Niger Delta controlling all the resources there.
If they truly want restructuring, they would have welcomed & implemented by now Buhari's executive orders granting financial autonomy to local governments, state houses of assembly & state judiciaries instead of rejecting it & going to court to challenge the orders.
Those that are fighting for restructuring don't want independent local governments, state houses of assemby & state judiciaries because these are arms & organs of government, that if truly independent, will effectively check the excesses of the state governors & those embezzling the resources of the states in the region.
Those governors, politicians, elders, elites, traditional rulers, cashivists & freedom fighters fighting for their private pockets that want resource control are not ready to invest the billions of naira & dollars they stole from Nigeria & Niger Delta in prospecting for oil & building the massive oil infrastructures required to explore, manage, store & transport crude oil & gas.
That's why at the expiration of the oil leases held by some Nigerians & foreign companies, Buhari refused to renew them but rather passed the opportunity to own them to states so that they can control the resources & use the huge profits to better the lot of citizens of their states.
Many states in the Niger Delta & their governors, politicians, elites, elders, cashivists, freedom fighters fighting for their private pockets rejected the opportunity because it involves huge investments & rather opted to sell this opportunity of thier states owning these oil blocks to private individuals & firms for immediate cash from 10% commisions, kickbacks & convenient taxes.
They don't want the restructuring & resources control that will give the states more responsibilities, that will benefit their people or promote transparency, growth & development in their region. What they want is the restructuring that will give them more powers, more control & more money to squander.
That's why they talk about devolution of powers to states that will allow the governors absolute powers to make decisions on a lot more wide range of portfolios presently under the purview of the federal government.
That's why they are appropriating to themselves through their zombified state assemblies the powers to collect all taxes in their states including VAT.
That's why they are rejecting financial autonomy to local governments, state assemblies & state judiciary so that they can have the additional local government billions of naira to squander, pass any selfish law they want & obtain any court order they want against their opponents while eliminating scrutiny from the same institutions constitutionally empowered to query & sanction them.
That's why they are bent on having state police to intimidate, brutalize & put away any opponent or dissenting voice.
Sadly, the citizens of these states have their brains & minds so wickedly twisted by the ethno-religious hate opium they are doped daily & can no more comprehend who their enemies are.
A pathetic shame indeed!!

Unjust hatred for people will consume you. We see the obvious in the very hilarious VAT battle that is happening. I just dey observe.
Many supported Governor Wike's decision to be collecting VAT because they say "the North contributes nothing and they want to be collecting". But if they know their facts they will understand that they are digging a hole for themselves. They will realize it is all of us that will suffer when States collect VAT.
First of all, after Lagos, the next place that contributes the highest VAT (20%) is the FCT which is in the North. Yes this is followed by Rivers at 6% but Kano is next with 5% and this is followed by Kaduna. So no, it is not as you have been misinformed. The only special case is Lagos. So your State will suffer. Even Lagos will suffer with much more people migrating there. When resources are shared among Federating Units, it is shallow to always think it is injustice. Give Lagos 100% of it's VAT, Mukaila from Sokoto, Chinedu from Aba and even Lasisi from Osun will all migrate there. So what is the point again?
Secondly, in the federal system, companies with less than 25 million were not VATable. You think you are doing Northerners but your company will become VATable once Wike's law is replicated in your State. Why do you think commercially massive States like Abia and Anambra do not top the list of VAT contributors? Because those boys in the market were not exactly VATable, wait until what you are blindly supporting takes effect. VAT will be collected like motor park tickets. Then you will see where hate has led you.
Third, people will most likely pay VAT twice across different states with different laws because Wike does not know what is input and output VAT and did not listen to Nojeem Olasubomi Yusuf and others who politely asked him about it.
Some have even termed Wike the leader of restructuring in Nigeria. A gullible people in search of heroes. Being used and misled by every opportunist. Stop allowing yourself to be used by politicians to settle their personal scores while they tell you they are fighting for your interest.
You need to first know what your interest is to know who is actually fighting for or against it

As long as each states utilize the VAT for the development and progress on their people.
As long as it won't end in the foreign accounts of politicians in the states.

We've talked about ranching many times here.
This is how things are done in saner climes.
Miyetti Allah need to give the good ones among their members all the re-orientation that things can be done the way it is done in civilized nations.

The bill was not meant to attack anybody, but that it was all-embracing.
Land resources were very important to the state, adding that the relationship between cattle herders and farmers should be symbiotic.

A better Nigeria all around is all we want.

Let every state, work with what they earn. You cannot earn less and want to spend more.

If na so let everybody add up their earnings/salaries and share amongst the people in the country.

The North is mining their gold and not sharing so? Up next is allow state manage their natural resources

For this FIRS to approach the NASS for amendments, it means that the original VAT Laws and FIRS Establishment Act had some loopholes which seemed to favour the Current State-VAT struggle.

If every State stands alone, you will realise that your bragging is on thin air. We have clearly seen that Lagos, Abuja, Rivers, Kano lead the pack.
If we carry out a simple VAT fertility you will see that your State is VAT impotent....and your much touted beer VAT are blank shots.
Na just gum body dey make una think say your state dey fertile.

Let every State face that "VAT fertility test", so they will all know the true state of their viability!

About time States within the Nigerian Federal system of government began to imbibe a competitive mindset. They should be intentional about growing their economies and attracting meaningful endeavours to dwell. States should identify their areas of core competencies and leverage on them to create and nurture economic identities and growth. For example, when you think about food and the agrarian Benue and up north States should come to mind. Gone should be the days when all they do is to go to Abuja monthly to share revenue.
