What if the guy has counter-proof that he got the particular 10k he used to place the bet from elsewhere....what's gonna be the outcome in that case?

if that's the case he will only return the 10k he stole. But if it is proven he used any proceed or part of the stolen fund in the bet the girl is entitled to part or all the profit. A criminal has no case in front of a court.

Think about it...
