Appeal Court Grants Lagos Request To Join Rivers’ Suit On VAT by Nemere2020: 1:53pm On Sep 30, 2021
The Abuja Division of the Court of Appeal has granted an application Lagos State filed to be joined as an interested party in the suit that stripped the Federal Inland Revenue Service, FIRS, of the right to collect Value Added Tax, VAT.

The Appellate Court, in a unanimous decision by a three-man panel of Justices, on Thursday, held that Lagos State had through its Attorney-General, established that it “has a direct and substantial interest” in the matter.

It, therefore, made an order, joining Lagos State as the 3rd Respondent in the appeal the FIRS filed to set aside the judgement of a Federal High Court in Port Harcourt, which gave Rivers State the nod to collect VAT revenues within its territory.

The Court of Appeal, in the ruling that was read by the head of the panel, Justice Haruna Tsammani, ordered FIRS to serve the AG of Lagos State with all the relevant processes in the appeal.

It adjourned further hearing on the matter till October 7, disclosing that further proceedings in the case would be conducted in Port Harcourt.

If this case goes in favor of the states, I'm sure other parts of the constitution will be studied to see all lapses to be explored to favor themselves.

This is indeed a good thing I'm sure of and will lead to the development of the various states.

I just hope we the citizens wake up to the part of our responsibility of holding our leaders accountable because where accountability is lacking, corruption thrives.

Fiscal federalism is the way to go and we say no to free money

I also heard Oyo State wants to join Rivers state on the suit

What I don't understand is why Anambra state is not making moves on his one as the counterpart states

This is the way forward and I think more probe should be done to find out a way to utilise the constitution in achieving the king overdue restructuring which the presidency has vowed to suffocate

Not totally correct. Wike rather learnt from Lagos error and did the right thing. Lagos had taken the FG to court on the issue of VAT which the court turned down the case and stated that the case should have been between the state and the agency empowered to collect VAT (FIRS).

So, it's more like Lagos State joining Rivers
