You've lied like hell through much of the posts here. You were defended by a public defender, and didn't spend your own money on your defense. You challenged the DNA evidence -- because it was a close enough match to you to overcome the doubts of a judge and jury. The victim identified you in court as the attacker. There is no meaningful doubt about your guilt. Nonetheless, I have a phone call out to the district attorney and a records request to the Douglas County courthouse for the full transcript.

With that kind of evidence, you leaving your phone somewhere else while committing the crime -- your "GPS" evidence -- doesn't matter. Minor questions about whether or not you were able to ditch your clothing don't matter. Nothing you've said overcomes the strength of the evidence presented in court, or demands that I "investigate" any further than this.

You were convicted fairly. You are no longer entitled to a presumption of innocence, particularly on the strength of this evidence.

You think you're going to die in jail, and soon. I sympathize with that fear. You were sentenced to life in prison, not to be garroted by a murderer in a dark corner of a prison hall. But you belong in prison.

1. As opposed to what you said, there was actually no in-court identification. Yes, it was falsified!

2. The jury never heard the DNA weren't his...he was standing for himself then (story for another day). The judge prevented his DNA expert from testifying!

3. He was deemed guilty even before the court said so.

4. Do you know him in person? You sound like he has done it before and you bailed him!

I do not mean to disrespect you but I wish to provoke your mind! The best way to help is checking two facts! You hate the figure who raped the minor, yes, it's normal! I'm beginning to consider a grand conspiracy involved in this case, as regards the recent emergence of dubious characters whose only aim is undermining Powerhouse5050's right to an appeal by subduing the interest of people bent on ensuring a retrial and a fair hearing.
Whatever information the defendant is withholding is crucial if truly he's in need of deserving help.
His brief history.
His travels.
His engagements.
His acquaintances in Nigeria, Japan and US.
His next plans and intentions in the US before his arrest and incarceration.
A clear picture of people he knows in the state and those he came across during his brief stay in the US.
Any grudge, conflict of interest, debt, deals etc with locals, neighbours, vendors, law enforcement etc no matter how negligible it might be, can be the missing link.
Body fluids can be swapped.
Clothes can be stolen and disposed of close to the crime scene.
The witness can be compromised.
IN FACT THE RAPE MIGHT NOT HAVE EVEN OCCURED in the first instance, and the victim can be a victim of child abuse by paedophiles in form of parents, guardians, neighbours etc.
A great possibility if a setup exists going by the defendant's behaviors on this forum.
You might never know who's foot you stepped on that hurts the most.

If the convict is guilty as decided by a jury of his peers, you have to admit there are some “fine people” on his side, one of whom is this character. A person who by his own admission on this site, slept with his cousin “only” 3 times and also encouraged another character to do same in the most cold, unfeeling language “Fvck her and move on.” Wonder why those words remind me of his cold, unfeeling comments specific to the child’s rape experience on this thread.

I was never arrested for this crime..... When the police stopped my SUV , they questioned me about it and the invited me to the police station to have more discussions about the 6 SUVs that I just bought and fully paid for,I drove to Douglas country police department by myself without any warrant.

After 20 minutes of interrogation at the police station about my SUV and the payment method....
The police officer changed the topic and said he will like to question me about a crime that happened in the complex I was living.

I replied him that he brought here to question me about my vehicles...but now he has changed it took a crime that happened....I have no idea about what you are taking about and because of that I don't want to say anything to you again.

After some persuation and I refused to talk , the detective then said he will have no option than to arrest me for the crime and he will charge me with rape...
This scenario happened just 2 hours after the crime happened.

! If this is exactly how it played out and nothing was held back nor garnished, then you were just a pawn in a villainous systemic conspiracy. Some are fast to testify against one, crucify and bury even though they had no realistic evidence against another nor were they witnesses. We must becareful when passing the buck that could send a fellow human to ultimate perdition mostly when there are jagged edges as to the accused's culpability.

There's been cases of wrongful convictions on the Innocents and even biased acquittal/ soft landing on the guilty in some climes people thought their system are impeccable in all indices.


To the OP, if you're truly innocent, please take solace in this... it may take time but God will eventually vindicate you in one way or another if ONLY you believe! And now is even the time to draw closer to God if you've not really been. Who said the main suspect can't be apprehended? Who said prayers don't work? He may even helplessly own up to the crime when a heavy unseen hand descend upon him and renders him restless.

They are preparing him from what he will face in order to convince anyone to look at his case.
And if his appeal comes through, what he will face from the DA, prosecutors and the press will be 100 times worse. If he cannot convince doubters here of his innocence, I doubt he will the able to convince anyone in the U.S.

There are more wrongfully convicted cases in the US some of which are not known to the rest of the world.

I think when God was creating the Nigerian he gave him more emotion than reasoning capacity or according to evolutionists the hypothalamus is more developed than the hippocampus. Simply put we are controlled by emotions rather than reason.

Mr Bah is guilty of rape among other crimes because a jury of 12 (not sure of the exact number says so). The jury system is more robust than the judge system. If Mr. Bah had been able to convince just one juror of his innocence, he would have been considered innocent.

As I said, I am not in a position to say whether the convicted actually commited crime or not, only God and Mr Bah himself can know that. What every other person can rely on is the court system. As the court has pronounced him guilty, guilty he is until the courts again find reason to rescind its decision. All other opinions are irrelevant.

The US justice system is not perfect as it is operated by mortals, and humans are far from being infallible. Having said that, the US justice system is one of the most fair and robust in the world. Of course it makes mistakes from time to time, but it cannot compare to a country like Nigeria where most citizens in prison are innocent or awaiting trial for decades for minor misdemeanors.

If You are truly concerned about injustice of jailing innocent people for decades for crimes they did not commit, you should fight the Nigerian justice system.

Mr Bah had ample opportunity to defend himself before the conclusion of the trial. He could have reached out to Nigerians both in the US and Nigeria before judgement was passed. He had ample opportunity to appeal any part of the trial he found unfair to him getting justice. He could have even questioned or rejected any member of the jury. He and his lawyers should have done their homework before judgement was passed. Three years after a guilty verdict, he is now beginning to make a case of mistrial. He is in for a very difficult time indeed. Unless another person is found to have commited the crime or he can come up with a new incontrovertible evidence, I honestly don't see how he can prove his innocence.
This is the basic fact 1stgenamerican and georgechidi are trying to pass.

Have taken my time to go through the thread since last night and I will make my submissions.

Disclaimer: I am not a lawyer neither have I ever practiced law before.

1. Nobody is accusing Mr bah or trying to prove anything against him. In law and I beleive also in the US, a person is presumed innocent until convicted and in this case Mr bah has been convicted.

So the jd woman and the journalist aren't trying to prove anything against him I believe.

It is Mr. Bah that must prove his innocence in his appeal.

2. In my opinion, the jd woman has really been the most helpful to his case here as believe me if she is asking these questions and punching the holes imagine what the attorneys would do in court.

This should help Mr bah know how to strengthen his case and know which of his evidences are weak and how exactly they can be countered in court.

3. Mr. Bah has placed his invoice majorly on 2 pieces of evidence - the 6 mins phone call he had and the dna testimony of his expert and I will tackle them both.

Like I said earlier I am not a lawyer, but these could help Mr bah build up his evidences.

4. Mr bah claims he made a 6 mins phone and has asked several times if he can be making a phone call and raping the girl at the same time. Well, here are counter questions:

4a. What was the duration of the assault? Did the assault happen for exactly 6 mins or shorten?

Cos if the assault lasted longer eg for at least 30 mins then the 6 mins call becomes baseless. As I can have a phone call for 6 mins and then proceed to do other things.

4b. Was the exact time of the assault recorded. Not an assumed time but the exact time.

Why? Because 6 mins is extremely short and it has to be proved that the assault happened at exactly the same time Mr bah made the call and that the assault lasted for 6 mins.

So I believe the call is a weak piece of evidence (again I am not a lawyer and Mr bah should seek appropriate legal counsel)

5a. Did they victim identify Mr bah at any time.

I believe most parents would ask that their children not testify in an open court cos of the trauma it could cause but that shouldn't stop the victim from talking privately to police I believe.

So did the victim positively identify Mr bah at any time during the investigations?

If she did not, then his defence should be built around this.

5b. There was reportedly a cctv footage and online media reports say the footage shows Mr. Bah chasing the victim into the Woods.

Was this cctv footage shown in court?

If so, what was Mr. Bah reason for chasing the victim?

If the victim did not positively identify Mr bah as the attacker at any point, then that should be argued in court, could be given as I believe this is negligence on thier part (again Mr bah should consult with an attorney)

5c. According to Mr. bah there exists a second cctv footage that shows a man putting a shorts described to the police during a 911 call.

Now this a tricky one?

According to Mr bah, this particular footage wasn't shown in court.

Mr. Bah have you seen this footage and did you identify the man on shorts?

If not, did those who saw the footage identify the man as you?

If his face wasn't captured, did they identify any obvious difference in both your appearance? Significant height and weight difference, hair, tattoo or body piercing, skin color etc.

If yes, then this should be the center piece of your defence.

If you aren't sure, then your attorney should request to study the tape if possible.

6a. Was there any other dna collected at the crime scene?

This could prove that there are more than 1 suspect.

6b. Wad the results of dna analysis disputed in court or was it just the method used in getting the results?

6c. Did they dna expert Mr. Bah claims didn't testify conduct a fresh and different test to disprove that which was presented at not.

If not, how did he arrive at the analysis?

6d. Was the tests presented in court carried out by just one lab or did multiple labs present they same result.

6e. Did Mr. Bah ask for the dna analysis to be redone at any time during the hearings.

If not, is that still possible?

6f. Did the lab or labs that conducted have any history of dna swaps, fraudulent activities or any other incriminating records?

chatinent did you reach Mr. bah for any of these?

So far only 1stGenAmerican has affirmed that Mr. bah was identified by the victim from a line of 6 other black men in the presence of police officials and a guardian. which you said you would confirm.
