My brother, deal with him. He has not right to break into your apart. Get a lawyer, sue him. Claim theft of property. Cash out.
They are many mumu here, saying 8 months is long.

I am a landlord, I have tenet that owes me too, but I can't try such.

If he did not exhaust all legal framework for ejection and moved your properties with court bailiffs, then you are now a very rich man. Just use even the laziest lawyer and gain like 100m if you are the merciful kind.

As I type this, I'm currently sick and there so much anger and pain within, I haven't been able to eat or drink since I got the news from my neighbor who told me that my landlord came to the house with a strange face, broke the locks to my apartment and packed my things out, I sent a relative to confirm and she said everything is outside but he went with my TV set.
I called the landlord to ask what he has done, he blatantly lied telling me I sent my 'brother' to clear my things off the apartment that he has reported me to Police.
Yes, I owe him 8months rent and I've away for 13 months even before the last year rent I paid expired. I told him I'll be back by November and I'll pay once I get in.
Pls even though I owe him, it doesn't feel right stealing my property and throwing the rest in the rain
Pls I'm lost and dire need of legal advice
Edit: while I'm not absolving my self of the guilt that I owe the landlord this long and purely due to loss of job (covid19 problems) and there's no way I go there and get my stuff without paying the backlog. I don't know if the law is on your side, but the fact is that you owe him money and if you really wanted to pay, you could have done that from anywhere in the world. 8months rent in this hard economy is not a joke.

Simply just obtain a police report and proceed to court. Even though you owe him, he should have obtained an eviction order from the court. He has broken the law. If you don't sue him, he will do it again. We are not in a jungle, there's a due process for everything. Being owed is not a reason to act outside the ambit of the law. Also, don't allow anyone harass you. Going by the ACJA 2015, police should not interfere in civil matters such as this. Indebtedness is not a criminal offence. The reason why you are reporting to the police is because a criminal offence has been committed by your landlord i.e obtaining your asset without your notice (a.k.a stealing) and breaking into your apartment (a.k.a burglary)



The money he would have used to do all these above you mentioned,he would have used the money to pay his landlord.


Make sure you pay your rent too. All the best.

I don't know why I feel you are painting the whole story to draw pity towards yourself. You owed him almost a year rent, like you locked up someone's house and rent and went your way for good eight months? I bet he must have called you to come pick your stuffs with no avail.

'2 wrongs can not make a right'

The action of the landlord is a criminal breach of contract and unlawful entrance.
He should have taken the matter to court and obtain a legal backing before breaking into the apartment.
It is the duty of the court to send a bailiff to act on the courts instructions.
That landlord has made a big mistake, you can approach a good lawyer to take up the case.

At best the landlord should have locked your apartment with the properties intact so that he can claim his rental and even interest to the last month of your default, but ignorance made him to misfire.
The law is an ass, you don't take it for granted it can remedy and also hurt when one go contrary.

No sentiment or emotions in jurisprudence.
Go get yourself a good lawyer, take pictures of the properties outside were he dumped them.

You must be a very terrible individual for you to write this. What the Landlord did is absolutely criminal and the man should get a police report and report the man for stealing and damaging his belongings.
We all know Nigeria is in a terrible mess and the Lanlord should have been bold enough to accept that he did.
Anyway with individuals like you in Nigeria, I guess that's why Nigeria is the way it is.

sad You guys advising him to go to court, to go police, to go to this to do that and do this.....? Will money not be involved in all that proceed you are suggesting....? is it not better he use the money to go and pay up his landlord, besides a landlord that carried out such and act must be ready for whatever that will come out from it. My advice is for him to try and pay up his rent and his things returned.

The landlord is a very patient man

I had sympathy for the tenant...until I saw that he had not paid his rent for eight months.

Landlord was very very patient. Some would have gotten the tenant's property removed within 2 weeks of default

Very funny. It is not the landlord that made accusation they broke his apartment. The landlord only said he saw his brother coming to pack things. Funny enough the landlord may even have video evidence because the op said he sent his brother to check so in the process the brother may be packing some things. The op that made the allegation will provide evidence. Nothing concerns the landlord. The landlord was only worried they came to pack the properties without paying him. No case is straightforward. If the landlord planned it well...nothing dey happen

You are the one that is ignorant of the law here. There is no evidence there was illegal invasion...that is the point. Assuming the landlord admitted he broke his apartment now, the OP has won lottery . But as long as the landlord denies it and no other evidence, what illegal invasion are you talking about? . The op brother was even seen at the apartment meaning he probably came to park his brother's things.

Your landlord is wrong �, you know he doesn’t have right to break into your home, if he has sent a quit notice through his lawyer then you will be given max duration of 6months from the day the quit notice was issued

Gather yourself together, don’t worry, call your number and put it on record to repeat what he told that happened have that as an evidence, tell your brother or relative not touch anything

Whatever your property is worth he’s going to pay in full... if sincerely you don’t have the money to pay now, then is okay but you have to come back to make payment you can pay from anywhere... just do the needful

Don’t banter words with him, since he lied that he knows nothing about that, let the Law do the job. Any good lawyer can nail this easily

Something of such happened in Lagos here 9 years ago, the tenant rented an half plot, I don't really know how much he pays then for the rent, but he wasn't paying very well. He was owing the landlord a year rent.

He built a restaurant and bar on the land.

One day, Landlord got angry and arranged boys to destroy the man's shop. They destroy the walls without going inside not touching anything. The man told me this himself because I was going to rent part of the the land for my viewing center business that I wanted to open at the area then.

He reported the case to the police and got himself a lawyer because he was educated and an Ebo man. He took pictures for evidence and told the Judge that he left 5 million naira in his bar, his lawyer asked him to say that.

They charged the man to court and he explained what led to his actions but the Judge punished him by asking him to pay 8 million for damages or he can forget the land, and it belongs to the tenant until otherwise.

The man begged his tenant but he refused and got stroke. So, his children went to the man to beg and he asked them to go and bring 3 million and he will drop the case. Till today, the tenant has been using the land as he likes and renting it to other tenants like he owns it. The owner is late now so and the children never see 3m.

This happens at Aguda Ogba Lagos.

Yes, he will still loss the the land still as long as the order as been giving by the court then the land his not his anymore. And if investigations shows that he truly killed him might loss more than 8m
