According to the Nigerian Constitution 1999 (As Amended), both the National Population Commission and well as the various Local Government Areas are empowered to register births and deaths. ... According Part-1 of the Third Schedule of the Constitution; reading the Section 24(b), it states that: The National Population Commission shall have power to, among other things, “establish and maintain a machinery for continuous and universal registration of births and deaths throughout the Federation.” .. Then again, Section 1(i) of the Fourth Schedule or the Constitution reads: The main functions of a local government council, among other things, includes: “registration of all births, deaths and marriages”. .. I really don't want to believe that this amounts to an aspect of inconsistency in the Nigerian Constitution, or that the Constitution gave a particular job to two different offices. But I really need to understand two things.... 1. Going by the two sections of the Constitution quoted above, who is supposed to register the births and deaths in Nigeria?.. 2. Is there any difference between “establishing and maintaining a machinery for continuous and universal registration of ALL births and deaths” and “registering of ALL births, deaths”?? .. The reason I asked the second question is just in case I was the one who didn't understand the two clauses very well.. So that, anybody who understands the two clauses better than me (and the differences between the two of them), should put me through properly, and get me enlightened. .. Thanks 10 Likes 2 Shares |

BluntCrazeMan:According to the two clauses from the constitution, it's very clear. Their Functions Are Very Different. The NPC are not supposed to be the ones to be directly involved in the registration of the Births and Deaths. (Although, they are also registering births and deaths at the moment, which they are not really supposed to be doing). According to the Constitution, they are supposed to establish and maintain a robust and an effective machinery for the continuous registration of all the births and deaths in the country, and even conduct periodic trainings for the LGAs’ staff who are the ones that enter the field to do the actual registration of births and deaths. 27 Likes 2 Shares |

Local governments has many things to cater for. Overload will make it inefficient. Nigeria Population Commission should be the one enforcing it in collaboration with Nationality Identity Management Commission. In NImc, there's something like "Dead Nin" or so(I've forgotten) it's like de registering bio metrics of dead people. The NPC collaboration with NIMC, Immigration are the ones that suppose to have Intel knowledge of our population growth, death rate, immigration and emigration. 4 Likes 1 Share |

Sammy07:Most oftimes than not, the LGAs don't even register, unless for children between 0-2 years old. There are NPC officials in every LGA in the Country who carry out that function. Again, there is some duplication, because Part Ii of the NIMC Act also empowers the NIMC to register births and deaths as well. So you have roughly three bodies doing the same thing. The NPC is the safest place to 'hide'. |

Sammy07:Currently, the various LGAs are underperforming.. Weeds and shrubs are even overgrowing their head-quarters and offices due to the fact that they don't go to work, just because they allowed some other offices to take over their constitutional responsibilities.. So, when you talk of OVERLOAD with respect to the LGAs, I keep wondering what you mean. .. I was even saying that the duplicated duties according to the Nigerian Constitution are already too much, and you even went ahead to introduce “triplication” and “quadriplication” of duties by bringing in the NIMC and Immigration.. Like,, if NIMC and Immigration are also involved in registering Births and Deaths,, then we can never ever ever get it right as a country. How can they all work together to unify and synchronise their databases and have one single Authentic Register of Births and Deaths for the whole federation?? 3 Likes |

That is, the register in any nearest LGA (or most preferably, the LGA where the town he was born in was situated in), then the NPC Register, and also the NIMC Register??In rural villages, if the child is born @ home...the parents will obtain a proof of birth from the LGA, and later forward same to the NPC for processing of the birth certificate. If the child is born in the hospital....You will obtain a notification of birth containing all details of the child from the hospital (usually called " certificate of live birth), then you submit same to the NPC. So registration per se can be carried out in many places, LGA, Church, hospital but by law, all is expected to get to the NPC for National Planning Purposes and issuance of Birth Certificates. Again, an NPC official is attached to every LGA so information can be shared. The NPC and NIMC is just some duplication.......NPC is Constitutionally empowered to issue birth certificates. 1 Like |

If the constitution gave the responsibility to two different entities then it was clearly meant to be a shared responsibility. For example, some courts created by the Constitution like the Federal High Court and the State High Courts both share jurisdiction when it comes matters or cases filed under fundamental rights in the Constitution. I think it is the duty of the Local Government as theirs was explicitly spelled out. That of NPC was to provide an enabling environment, at best keep a database of such, but they were not explicitly told to do the registration themselves. 1 Like 1 Share |
