...Upholds the Ebonyi State Cybercrimes Prohibition Law

The High Court in Abakaliki today, 10th March, 2022 grants "Judgment in Rem" to the Governor David Nweze Umahi following an earlier Federal High Court Abuja judgment on the 8th of March, 2022.

According to the Honourable Attorney General of the state, Barr. Cletus Ofoke:

"You are already aware of the judgment of the High Court of Ebonyi State delivered on the 28 day of February, 2022. In that judgment, the court directed that the Governor of Ebonyi State, Engr. (Chief) David Nweze Umahi, and the Deputy Governor of Ebonyi State, Chief Barr. Kelechi Igwe should not vacate office as Governor and Deputy Governor respectively in Ebonyi State by virtue of their defection from the Peoples Democratic Party to the All Progressives Congress. And so, you are also aware of the judgment of the Federal High Court in Abuja on the 8th of February, 2022 in the same subject matter. And so, when we have two judgments of courts of competent jurisdiction, the next thing that parties would wait for, is to rather wait for the decision of the appellate court.

Speaking further, Barr. Ofoke said:
"And so today, the same High Court in Abakaliki, has mandated, has made an order, a valid one for that matter, asking the parties to enforce its earlier judgment of 28 of February, 2022. In other words, His Excellency, the Governor of Ebonyi State and his Deputy approached the court in lieu of the decision of the Federal High Court on the 8th to say, look at the position. We have this judgment from you, we have also this judgment from your sister court, a court of competent jurisdiction, what do we do?

"The Governor and his Deputy approached the court through his Lead Counsel and court made an order. This is in the respect that the judgment of the 28 of February 2022, is the judgment the Judgment in Rem. And in law, when the judgment is in rem, it means that it is the judgment that has been adjudicated all the issues raised by the parties and that one is subsisting and valid and that the parties should give respect to that.

Explaining the meaning of Judgment in Rem, the Honourable Attorney General said:
"In other words, a Judgment in Rem, is a judgment that binds the whole world, even if you are not a party. The court relied on the Supreme Court decision in Igboama and ors vs Obidigwe and ors reported in 2019. In that Supreme Court case, I have just cited, the court tried to look at, what is the Judgment in Rem. The Judgment in Realm comes into play when you are having two judgments on the same subject matter just like that of 28 and that of the 8th of March. And so the court is saying that the judgment of 28 ought to be respected, enforced and should be allowed to stay by all the parties, including non-parties and that is why the Supreme Court is saying, it is the judgment that binds even the whole world.

"So even if you are party to that suit or you are not a party, you should be bound by that judgment because it has decided on the issue really brought to it by the parties.

On the case instituted against the Ebonyi State Cybercrimes Prohibition Law 2021, Barr. Ofoke noted:

" Yesterday, a High Court in Abakaliki gave judgment validating the Ebonyi State Cybercrimes Prohibition Law 2021. Some disgruntled elements instituted what they described as frivolous actions against Ebonyi State Government, the Attorney General and the the Governor of Ebonyi State asking the court to set aside the Ebonyi State Cybercrimes Prohibition Law 2021. That the Law runs contrary to the intent and provisions of the 1999 constitution as amended. And the court in its judgment stated that the Law remains in force, that Law has not violated any provisions of the constitution and that the House of Assembly of Ebonyi State has not committed any wrong by enacting the Ebonyi State Cybercrimes Prohibition Law 2021".

A black market judgement obtained in a kangaroo court that can not stand the test of time. Ex governor Umahi should vacate the government house and submit himself to EFCC for immediate prosecution due to wanton looting of Ebonyi's scarce resources.
His Excellency Igariwey should address the state now as the people's governor of the state

I'm not against any judgement but cases where State courts issue judgement regarding their own States should be stopped by the NJC.

This is not giving the judicial arm any good name at all.

The appeal court process should take like 5 court proceedings before judgement, 2 months adjournment interval, that's 10 months before the appeal judgement while there is still opportunity of SC.

Pdp should stop behaving like illiterates

Umahi is forum-shopping and it is normal for him to do that so as to prevent what happened in Abia in 2016.

The Eboyin State High Court judgement came b4 that of the FCT High Court, both are High Court's, the order of the Eboyin state High court has not been vacated by an order of a court of higher jurisdiction b4 the FCT High court order came in, do you now want them to obey the order of the FCT High Court and disobey that of the Eboyin state High Court or what? Only the order of an higher court ie an Appellate court can resolve this quagmire caused by these Judges, cause the governor will adhere to the order that will benefit him though he has gotten a stay of execution of the FCT judgement and also gone on appeal.

No he is not.that court judgment preceded ekwo's own.

Section 68 addressed federal lawmakers.section 109 addresses state lawmakers.why was governors and presidents omitted?? Immunity clause perhaps.

PDP started their court case in August 2021 and while the case was ongoing, Umahi got his Abakaliki judgment on 28th of Feb 2022.
Umahi went to court on the 4th Feb and by 28th he got the judgement he wanted.
Why didn't Umahi wait for the verdict of the high court in Abuja?

The judgment preceded Ekwo's own because Umahi shopped for favourable judgement. Why didn't Umahi wait for the verdict of Ekwo in a case that was in court since August 2021?
Umahi went to court in Feb 2022, PDP went to court August 2021.

You know my position on this already.

I believe it's a judgement that will be overturned with superior arguments.

This case was filed by the PDP in August last year at the FHC, Abuja....with the APC, Umahi, Igwe & INEC as respondents.

The APC wanting to pre-empt it, used Sunny Ogbuoji (an APC member) to file the exact case before the Ebonyi High Court in Feb this year.
NB: The PDP & INEC were not parties to the suit and the PDP filed a joinder, which was rejected. The matter took two weeks and the Court ruled in favour of Umahi/Igwe.

A stay of execution postpones the enforcement of a judgment against a litigant who has lost a case (JUDGMENT DEBTOR).

The judgement of the Ebonyi High Court in February was executory in order. Did it need a Stay of Execution in rem? What are they staying? The judgement already said Umahi/Igwe are good to go. He was the judgement creditor, so except it is forum-shopping, there was no need to go there for a Stay.

He has already applied for a Stay of Execution at the FHC, Abuja, that is where will matter and I believe it will be granted.

This one before Ebonyi is to protect him witjin 7 days or at maximum, 14..before then the FHC, Abuja will have granted his.

For the records, it will be hypocritical of me to say he shouldn't do what he is doing. You have to do anything barely legal to remain there

Was it Umahi that went to court in the Eboyin matter or they took him there? If he did who was the defendant cause I thought he was the Defendant/Respondent, na Nigeria we day, them nor day punish the judges hence them day give contradicting judgement, how two high courts go adjudicate for similar matter? The second court nor suppose hear the matter so long a case like that don day your sister court
