In a related scenario where a job advert on LinkedIn specifically states British passport holder, can that be classed as discrimination. A colleague saw the attached advert and was really displeased but I wasn't surprised since I encountered quite a bit of that during my job search and they all claimed its due to Security Clearance for the jobs. With her reaction, it now got me thinking if it's passive discrimination but I am just used to it hence my not seeing a big deal to it. On the other hand stating it publicly saves the recruiter and applicant precious time.

fatima04: This one is interesting. I usually see UK residents for past 3/5 years, etc. for this sort of job. Except where it has to do with national security, that's the sort of thing where you see UK citizens only. If this is an ordinary document controller position, then the stipulation for UK citizenship appears really strange to me. Unless its MI5 or GCHQ and they're not saying. 1 Like |

Lots of folks here previously mentioned that they got rejected for credit cards, it wasn’t given any ‘ulterior’ motive. Someone jejely came here and said ‘I have been in the uk less than 7 months, and I got a credit card from Barclays’. Fair game. The same Someone was rejected by John Lewis for what was essentially a credit application. First, Someone now played the race card , insinuating they were rejected because they were black and African. Same Someone now wants to conflate that occurrence with GDPR and the viewing of their LinkedIn profile. For those of us saying Someone has a good case. Question: on what basis? On discrimination based on race? Or on GDPR breach? It will take less than 1 second for any judge worth their salt to thrash that case. 7 Likes |

I've been in the fraud risk space for some years, though not UK specifically. The action of the fraud officer in this case may not stand as discrimination because fraud units work with data. Analysis must have shown that similar transactions were fraudulent in nature based on various variables like amount of credit and demographic information. If the company proves that the LinkedIn check was backed by trend analysis of previous fraudulent transactions, discrimination won't stand. However, for data protection.......I don't have enough information to give an opinion now.. 1 Like |

dustydee: I am genuinely surprised at how pretty standard procedures can suddenly be given racial connotations. Someone made an application for debt. A company feels something doesn’t add up. The company says, NO, we can’t give you this credit because it doesn’t meet our policies. Company communicates to the applicant, saying sorry. We can’t give you this. Applicant almost immediately uses their debit card to make the same purchase, from the same company. Because the smell of the fish(y) from the first instance hasn’t completely gone, company says wait a minute, just a couple of hours ago, you wanted this same thing on credit. We said no. Now the same you have suddenly come up with £800.00 to make an outright purchase.We need to investigate further. Company details their fraud unit to investigate, to prove that this person is who they say they are. Because company doesn’t want to hold funds for too long, company returns £800 to customer. This was referred to fraud unit. The fraud unit guy enters the name provided by the customer into Google search engine. The first hit is a LinkedIn page. Fraud unit guy browses the first link. And turns off their computer. Customer (who uses LinkedIn Premium) now sees that Company employee had looked them up. Customer now claims they were refused because they were black? And African? Customer now says Company had no authority to ‘Google’ them? Because of GDPR? Shuooooo 26 Likes |

ybahrbz91:Have you applied for council tax exemption? for some council even after you applied for exemption you will still receive council bill as it might take a while for them to process it. Eventually you will get a letter telling you that you have been exempted and imploring you to inform them 21 days before your circumstances changes. |

MichaelUde: You’re a clown. I work in financial crime prevention and i know quite a number of Nigerians who work in the financial crime space. I cant speak on the GDPR issue but i can assure you we are permitted to check customers’ (current and prospective) social media platforms. Infact Screening of profiles on LinkedIn is part of my day-to-day work, although it’s not expected that you use your personal LinkedIn profile to check a customer’s page as this is unprofessional and classed as tipping off the customer. 4 Likes 1 Share |

KOVIC19COVID20:While I do not necessarily agree with the racial profiling part, she has a very valid point, in my opinion. I think you should read her subsequent comments. Paypal approved her credit request but John Lewis declined her transaction. Going by your logic, what did the fraud team guy find in her linkedIn profile that made them decline her third transaction even after the payment was taken from her account and after she called and made a complaint? TheGuyFromHR:Document controllers handle sensitive documents as well and depending on the project, may need security clearance. The ones in my company have it else they cannot work on some projects. Not sure about citizenship except if it has to do with the required level of clearance. 1 Like |

dustydee: I'm well aware what a document controller role entails, we recruit them. What I said was that I thought that for a general document controller role in any usual commercial company, the requirement for British citizenship is unusual. Security clearance stipulations are commonly seen and usually require a specified number of years of valid UK residency, and I've only come across a requirement for UK citizenship in adverts you see for the security services. |

I’m going to be making some assumptions here. First, I’m assuming the buyer hasn’t stayed in the uk for up to 3 years which is like the average credit lenders want to see before issuing credit. Buyer attempted to buy a high value good on credit which the system declined. Buyer contacted customer service to find out what’s going on, buyer was told to retry. I personal think this was what prompted the fraud prevention team to do a search on the customer. I’d think the first point of contact for the fraud team would be credit reference agencies like Equifax, Experian and TransUnion. Then it appears the customer don’t have enough data to backup their request for a credit facility for the said amount. Hence, fraud team has gone further to find more information about the customer in an attempt to provide them a good reason. They want to know if the customer is genuine and where they work Cus they appear “desperate” for a high value item. I suggest that customer shld check their credit file to see which companies have carried out searches on their name. I don’t think the race card fits in here but then I think the fraud team shld have contacted credit reference agencies and not customer’s LinkedIn profile. For all I know, LinkedIn is a professional online CV and I doubt if they would have asked the customer for their CV before granting them the credit. I think the fraud team “spied” on the customer. Now whether it is lawful or unlawful is the question that begs for an answer. Make I go break fast I dey come 1 Like |

TheGuyFromHR:My sister works in the Fraud Prevention Unit (FPU) of a FinTech in Europe. She said and I quote - once you see any transaction that could be flagged as fraudulent, there is no limit of what publicly available information (LinkedIn, FB, Twitter, Instagram etc.) to check so as to mitigate the risk as long as the info is used solely for that purpose and nothing else. Once a transaction failed security check, they go all out. The ideal thing is to pause that payment channel till it is certified ok by the FPU and before it is certified, DD must me carried out. The OP can file a case which is well within his/her rights, but a FPU officer will squash it within 5 mins. There is no discrimination in Fraud Prevention (her words). 11 Likes |

dustydee: The fact that he/she paid with her debit card and they cancel the order, he/she isn't asking for credit, your credit history doesn't come into this when you are paying with your debit card, he/she stated they even had to approve the transaction via their banking app. So I don't know why the debit thing comes into it. I don't think people really understands what's going on in here, honestly. This is a good case for her/him to work on. |

KOVIC19COVID20: You don’t have to predict what his/her case is. Let him/her pursue and get to the bottom of what happened. Let them investigate what and why, this is a free country with legislation and rules. I just hope the OP goes with his/heart and go with their gut feelings. |

At least if one would spend more than £100 on a chair, it should be worth it as well as avoiding having to return such bulky item. |
