Confusion. Party primaries is not same thing with elections. I don't see what the debate is here. The judge while delivering judgment in a suit marked: FHC/UM/CS/26/2022 held that Sections 66(1)(f), 107(1)(f), 137(1)(f) and 182(1)(f) of the 1999 Constitution already stipulated that appointees of government seeking to contest elections were only to resign at least 30 days to the date of the election and that any other law that mandated such appointees to resign or leave the office at any time before that was unconstitutional, invalid, illegal null and void to the extent of its inconsistency to the clear provisions of the Constitution. This is where the issue lies. Contradictory laws should not/cannot exist. 1 must be scrapped. Malami position is very valid. |

Nigerialabalaba: This is the kind of task that causes Junior lawyers to sleep in the office until the job is done. This kind of pre-election and post election matters are sweet. But the stress is killing. You will have money but won’t be able to spend it because there is no time to even enjoy yourself. It is well. In any event, I do not think the Court of Appeal will be able to deliver judgment before 31st May 2022. There must be time for the Respondents to file their briefs before argument of briefs, and then judgment. Can all these happen before 31st May? Only time will tell. |

Same thing he did with the direct/indirect/consensus fiasco. They had an agreement with Buhari to amend that provision which they have refused to. This is a good judgement I believe. The section 82(12) was actually suggested by the Buhari regime. It is however obvious that something changed and some powers are affected, hence, the sudden turn around and strong attempts to withdraw the section. I stand with the new judgement for this exposition. |

fergie001: Some politicians and the judiciary are in bed in this case. We all know what this section 84 sub 12 is trying to cure. How can political appointees be in same category with civil servants? The courts need to take another look at it for the sake of clarity. The structure of the civil service is totally different from that of an appointee of government. The difference is clear for all to see. |
