They haven't started sitting but two others have gone to Court as well.

Mike Enyong, factional Governorship aspirant and James Iniama Consult.

OBA is still in PDP sponsoring suits using cronies though, the rumour is that the person in YPP is a place holder for him...

Enyong was elected by a faction using statutory delegates and basing his case on the ante bellum saga of Iwok & Ors v PDP & Ors.

Which bit didn't I read? It is you that is not understanding my point. The issue is that INEC should ensure that at least all contenders are allowed to contest elections otherwise it can never be free and fair. If they need to allow more time for primaries to be re-conducted the sky won't fall.
Let me show you where you failed to read and understand.
“Then it gives INEC the venue and the date of the primary. The commission will constitute a monitoring team for that particular state headed by the Resident Electoral Commissioner (REC),” Mr Okoye added.

This newspaper, last month, reported how supporters of the two APC factions in Akwa Ibom fought over the control of voting materials meant for the conduct of party primaries in the state.

The Chairman of the Election Committee, Tunde Ajibulu, had told Mr Igini on the phone that he was unable to leave the SSS office because he was traumatised and could not go ahead with the primary.

Mr Ajibulu reportedly told Mr Igini that Sheergrace Arena was not the venue given to him by the party’s national office in Abuja to conduct the governorship primary and concluded that “all activities be postponed until he gets back at the Commission.

Mr Igini at that point briefed the reporters who were present at the venue. He left the venue at about 10:30 p.m. that day.
APC representative told Igini on phone that the primaries would not be held again... And Igini reported to the Press.

Okoye was telling you the true position of things. Unless, there is a valid Court Order, nothing will change.

Is it a court that will upturn the decision of the electoral umpire?

Yes, the Court is superior to the electoral umpire.

That's absurd..

Electoral law that was worked on by majority of Nigerians ably represented by their senators and representatives and signed into law by the president and commander in chief should not be override by the adjudication of any judicial officer.

Electoral law is like the constitution, it's wordings should be sacrosanct.

The Court has a duty to interpret the Constitution or any Electoral Act in any way.

INEC and indeed every other body in Nigeria MUST obey the Order of the Court. The Court will not go outside the Act or Constitution to make that decision, they are simply interpreting what the Senators and House of Reps have passed.
Re: APC Has No Governorship Candidate In Akwa Ibom - INEC Insists by Nobody: 11:27am On Jun 17, 2022
INEC need to document every decision with letters or electronic mail or messages rather by taking decisions based on hearsay or alleged unproven undocumented conversation with a single individual.
Corruption in INEC is legendary.

If APC goes to court asking that INEC should publish their name on ballot. Candidates of other parties will ask to be joined as interested parties. The suit will not fly. And don't forget this could be a Supreme Court case. So no be here...

And what was passed and signed into law was for all parties to abide by the act and act accordingly.

Where a party abuse the electoral act and believes he can still ride on cause he owns the law should be looked into.
The act says INEC must supervise every party primaries..

In this case INEC went to the venue of the primary but nothing happened..

Even if they were issues, the party should have informed Inec before rescheduling the primary and also made sure Inec was available on ground to monitor their activities.

Its like chelsea playing a uefa champions league game indoor outside the initial fixed venue without uefa officials and referees officiating.
They later claim they won the match by 10 goals to 0..

Even flashscore or other sport sites won't honour such scores.

We are saying the same thing, but the Courts have the final say.

I don't think APC can win that case in AKS, and no Senator for them for AKS South..... But the Court always have the final say.

The PDP in AKS also have to watch it....there is a time-bomb there.

Saintkeppy said it...anyway,the news is mischievous.okoye was just making a general statement,he didn't say anything about akwa ibom apc primaries.there is no official report for now
.

After Mike Igini the INEC REC made the statement, me I feel It is now left for the court to decide, &it's a pre-election case, hearing & subsequently final judgement will be dispensed may be by the Apex court, the Supreme court.

People &politicians alike are of opinion that Mike Igini is baised taking sides with a certain faction of APC led by Mr. Austin Ekanem known to be of Senator Udoedeghe's faction &has refused to recognize Chief Steve Leo NtukEkpo led faction as an authentic Chairman&Exco of AKS APC who were sworn-in by the NWC of the the Party in Abuja.

One of the APC stalwart came on Air to fault Mike Igini on so many things, saying he refuses to acknowledge official letters sent to him as regards to Party activities led by Steve NtukEkpo, AKS APC now had to sent their letters to INEC Abuja for acknowledgements, that as an umpire Mike Igini is, he is suppose to remain neutral &not to involve himself in partisan politics, his job is to observe or monitor party's primaries then write reports.

Barr. Mike Igini has few months left to retire from active service, I think before the end of the year, another INEC REC will be sent to continue from him, so let us just wait &see as political events unfolds.

The case won't get to the supreme court.once a court orders inec to recognize udofia, inec will restore him.they dont appeal cases.the only case that can get the is that of ita enang

The new Electoral Act rules out State High Courts. Moreover, only an Akwa Ibom State High Court if any can sit on the matter.

The only time bomb is the different birthdates of umoh eno and the case instituted by akan okon to that effect.

If the court terminates his candidature, akan okon who scored 3votes will be substituted to replace umog eno..
Still studying the electoral act on this as i just downloaded it.

Maybe udom made it so during the primaries, cos how did akan okon scored 3 while Oba and onofiok luke had 1 and 2 votes respectively..

Stay away doesnt mean they didn't participate.

They had votes..

U can stay away from an events, it won't rule the fact that u r part of the event.

What if OBA had won?
Will his stay away invalidate his victory?

Or the PDP might not have a Candidate. One of both.

Udom obviously intervened in the Primaries, Luke & OBA can't benefit in any way, they did not partake in the primaries.

Imposition never weakened lagos apc...
Even in 2015 the imposition then was so bad that we had G37 group with the likes of nsima, helen esuene, effiong abia etc..

At the end the party still stood firm.

The only thing that will make pdp not have any candidate is the case of akan okon against umoh eno over his multitude birth dates not the other case.
The parallel primary mike enyong conducted with statutory delegates was a comic act just to calm frayed nerves.

The court case OBa and onofiok cited and used in staying away from the primary is also being addressed in the electoral law have posted here.

No court can stop parties from holding any primary.

OK, what ever it is, let the court decide, yes, Senator Ita Enang has a case too, he questioned the manner on which Mr. Akan Udofia emerged & his membership of the APC, after leaving the PDP within a couple of weeks.

Senator Udoedeghe having seeing impending crisis in the Party, left with his supporters to NNPP, some say he collected several Million$ of Mon€¥ from Mr. Akan Udofia to withdrew the case he filed at Appeal court.

Senator Udoedeghe is now NNPP Governorship Candidate, so he will be on the ballot.

AKS Guber elections will be very interesting this time, as very unpopular parties may win & even win seats in the Parliament, both State &NASS.

OBA hasn't join YPP yet, most of his supporters have made the moves in droves to the new bride party clinching tickets for various elective positions in YPP.
(E.g) Barr. Usenobong Akpabio is a Senatorial Candidate for Uyo senatorial district under YPP, he was a two-term member, AKHA.

Others who are already a YPP card carrier are waiting for him to make the audacious move in the coming weeks. YPP billboards &stickers are all over Uyo creating awareness to residents of the state &they are ready to take the gospel of YPP to all nooks and cranny of the state.

Lagos is completely one party state,no body challenges.pdp is useless there.before tinubu imposes,he consults and then bring an acceptable and someone the party likes.he makes sure all interests are taken care of..
In aks,its not so.attah tried it and failed in 2007.in 2015,akpabio begged everyone to accept udom,he tried to satisfy all factions...he settled Luke and oba.only umanah umanah got angry and left.as of then, apc was nonexistent in aks...with the entrance of nsima and akpabio, apc became stronger and competitive.. Udom won his second term because oba,Luke, nelson effiobg, akan okon sided with him...he promised to handover to one of them and they used thugs and cultists to overwhelm apc..now,he is saying he doesnt want cultists and thugs that fought for him.who does that? Did he consult anybody before bringing that albino? Even if he doesnt want them oba,he should still have brought someone very popular in the party from same ITU/ibiono axis...udom is a foolish politician.

If court rules in favour of both eno and udofia, you will see the gangup against eno.those thugs he spoke against will be used against him
