THERE are allegations that Governor Adegboyega Oyetola is scheming to retain the governorship seat through backdoor after losing the July 16 governorship election in the State of Osun.

Oyetola was defeated by the Governor-Elect, Sen. Ademola Adeleke, who polled 403,371 against the governor’s 375,027 votes.

However, there were reports that Oyetola had allegedly reached out to the aggrieved governorship aspirant of the Peoples Democratic Party (PDP), Omooba Dotun Babayemi, and instigated him to approach Supreme Court on his litigation against the primary election that produced Adeleke as the candidate of the party.

Babayemi is seeking an order of the court to nullify the primary that produce Adeleke and declare the factional primary that produced him as valid to make him the real governorship candidate of the party.

The Appeal Court had last Thursday dismissed Babayemi’s case, a situation that brought relief to the party.

Between Friday and Tuesday, there were reports from the PDP camp that Oyetola had approached Babayemi and encouraged him to appeal the judgment at Supreme Court.

Oyetola’s motive, according to the PDP loyalists, was to get the Supreme Court to nullify both PDP’s primaries held on March 29, this year and by that, he would be the beneficiary of the judgment being the second winner in the governorship election.

OSUN DEFENDER gathered that Babayemi has moved to the Supreme Court on Monday for final determination of the suit.

The PDP, in a press statement signed by its Caretaker Chairman, Dr Akindele Adekunle, accused Babayemi of being a tool of the APC to truncate Adeleke’s victory.

According to Adekunle, Babayemi was expected to stop further legal action if truly he is a genuine member of the party after Adeleke’s victory.

The statement reads in part, “The party specifically frowned at apparent attempt by the aspirant to become a tool of the All Progressive Congress (APC) to truncate the overwhelming victory of PDP at the governorship poll, declaring that such treachery is an exercise in futility.

“The party described as worrisome Babayemi’s refusal to listen to calls by elders of his group who urged him to discontinue legal challenge on Osun PDP primary, reminding him that he is increasingly emerging as an instrument of a defeated governor who is struggling to come to term with his crushing defeat at the poll.

“While the aspirant had filed several cases and failed to upturn due process decision of the party, the party noted that the last ruling of the Court of Appeal should put paid to further litigation on the primary, warning that any decision to pursue the issue further will smack of open anti-party activity and a direct disrespect for the people of Osun state who voted massively for Senator Ademola Adeleke.

“The party hinted that a very dangerous and self-destructive dimension is the emerging alleged collaboration between Babayemi and the APC to continue the primary case, affirming that such evil alliance will end in further legal defeat as the aspirant has no strong legal basis for his many litigations.

“We are therefore constrained to call on Babayemi to toe the path of honour and embrace the overwhelming choice of Osun people. Any hope of stealing people’s mandate for Senator Ademola Adeleke through the backdoor is a venture doomed from conception. Enough is enough.”

Reacting to the PDP statement, Babayemi’s Campaign Organisation stated that the redress currently being sought at the Supreme Court is not to truncate Adeleke’s victory but to ensure it translates to good governance.

The organisation, in a press statement issued on Tuesday by its director, Mr. Oladiran Ojedele, insisted that Babayemi was out for justice with a view to claiming his mandate.

According to the organisation, having explored all internal mechanisms of the party to no avail, the option left as spelt by the party’s constitution is to seek justice through the judiciary, adding that nothing would deter Babayemi from pursuing a legitimate cause.

The statement reads, “Our symbol, Omooba Dotun Babayemi is not seeking to truncate PDP’s victory but he’s out for justice, seeking to claim his mandate at the law court. Is such a lawful trajectory out of place? For all those who are now crying wolf, what genuine efforts did they make to ensure the PDP is not exposed to litigation?

“We would like to inform the whole world that Omooba Dotun Babayemi has continued to pursue the good of the PDP at every level of engagements; he has continued to invest his time and money for its success and the good of the people of Osun.”

The outfit further noted that all concessions made by the Babayemi’s group to achieve the desired peace before the governorship election were rebuffed by the Ademola Adeleke group.

“In any democratic setting, winner-takes-all syndrome has always been harmful in the long run.

“When Eyitayo Jegede-led Reconciliation Committee came, we laid our cards bare open. At a point, Babayemi offered to forego his governorship ambition if the other group was willing to come to the table with genuine intent to partner with both sides. The effort at reconciliation was rebuffed and rejected. As a matter of fact, no one begs to be enrolled for servitude”, the organization added.

Speaking on the alleged plot by Oyetola to retain the governorship seat through back, the Special Adviser to the Governor, Chief Sunday Akere, said the governor was not conspiring with anybody on the governorship position.

Akere said, “We don’t have anything to do with the PDP matter. Have we ever been involved in their internal crisis? Was Babayemi in the governorship contest? The PDP are afraid of their own shadow. We don’t have anything to do with whatever crisis they have in their party.

“However, we are resolute that justice will prevail at the end of the day. We don’t have anything to do with Dotun Babayemi. It is their internal crisis and they can resolve it if they want.”

#OSUN: THE LEGAL TUSSLE BETWEEN DOTUN BABAYEMI AND THE PDP

I had the opportunity of seeing in advance a copy of the Notice of Appeal filed by Dotun Babayemi at the Supreme Court. One area that was not clear to me was later explained to me by a lawyer. He raised in his appeal the issue that the Court of Appeal breached his fundamental right to fair hearing because the record of appeal was not complete and that the Court of Appeal ought to have ordered additional records.

From my investigation, I discovered that it was Dotun Babayemi that compiled the records himself and he even asked the Court of Appeal to deem his records as properly compiled. That same records is what is he is now challenging at the Supreme Court. The implication is that the Court of Appeal adjudicated on an incomplete record that Dotun Babayemi put before it. That is to to say that the Court of Appeal lacked jurisdiction to entertain the appeal of Babayemi's because of incomplete record. His appeal to the Supreme Court is a wasteful voyage and most likely to be sanctioned by the Supreme Court, that is aside the fact that his locus to file the action in the first place is on a collapsed structure as held by both the Federal High Court and the Court of Appeal.

Another curious point is that Babayemi's lawyers should have told him that nobody can be declared the winner of any election unless the person has participated in all the stages of the election. Babayemi can never get any mandate to be Governor because he was not on the ballot and can never be deemed to be on the ballot. That is to show that Babayemi's appeal is not in the interest of the PDP but that of his sponsors, and all of them will fail and fall into disgrace by God's grace.

Genuine PDP leaders in Osun State have been calling on Babayemi to thread honorably, he rebuffed all peace efforts being made by the Governor-elect himself. At a time the Adeleke's Legal Team was billed to meet with Babayemi's Legal Team, but on the appointed date, Babayemi and his Team absconded and did not honour the meeting. Calls were made to him but he is insistent on rocking the boat.

That is to show that his interest is not that of the PDP and Osun people but his personal interest but that of the APC who are planning to use him against Osun people. Many close allies of the Adelekes contested and lost the primaries, yet they maintained decorum and worked vigorously for the victory of the PDP in their various Wards and Local Governments. I am talking about people like Barrister Hashim Abioye from Ifelodun, Alh. Ganiyu Olaoluwa from Olorunda and Hon. Ibukun Fadipe from Ilesa West who all delivered their Wards and Local Governments to the PDP in the governorship election. That's how to know genuine and committed leaders.

I have revealed all these to let people know that Babayemi is not a man who is genuinely concerned about the interest of the PDP and Osun People. Rumors are rife that the APC have reached out to him not to withdraw and that they will use TINUBU to reach out to the Supreme Court lords to do the impossible. The APC have been boasting that their JAGABAN will use his influence over the Supreme Court to buy judgment to get victory from the Supreme Court. Well, their lordships of the apex court are not under anyone's control and no amount of influence will make them turn against the law they made themselves.

The Federal High Court and the Court of Appeal relied heavily on apex Court case of UFOMBA. V. INEC. I personally read the decisions. How much influence JAGABAN can wield over the Supreme Court lords ( whom we hold in high esteem and believe so much in) to overturn their own decision in doing the impossible is what the whole world looks up to when the appeal comes up for determination before the Supreme Court. Babayemi's appeal is like the camel wanting to pass through the eye of a needle.

Osun people and the whole world are watching, and we are confident that the same way God Almighty shamed TINUBU, his money and his other machinery on July 16th, 2022, he will be shamed again at the Supreme Court by God's grace.

APC has always been depending on Supreme Court to upturn people's electoral verdict. It is wrong for court to choose governor for millions of people in a democratic state. It is corruption.

Supreme Court of justice judgement on Pre-Election matters

Hon. Justice Ayobode Lokulo-Sodipe (Justice of Court of Appeal) in his Judgement cited Supreme Court Authority in the case of UFOMBA VS INEC.
In Ufoma Vs INEC (as it can be seen at the downward of attachment), Supreme Court held that a pre-election matter under Section 84 (14) of the Electoral Act of 2022 can not be properly hinged or predicated on Court Orders.....

Prince Dotun Babayemi case will be dismissed for lacking merit in the Supreme Court of justice.

Osun Governor Elect, Adeleke Inaugurates Transition Committee (see Full List)

The governor-elect of Osun State, Senator Ademola Adeleke, has inaugurated the 37-man Transition Committee for effective transition process, AMILOADED reports.



The official inauguration of the committee was held at the governor-elect’s office in Osogbo, the Osun State capital on Thursday.



Addressing members of the transition committee, Adeleke urged them to be creative and innovative in discharging their duty in line with terms of reference.





He said, “We are now at the critical point of demonstrating our readiness to translate our electoral promises into visible reality in form of good governance across all sectors of our society.



“This composition of this committee stems from my desire to ensure a proper mix of various citizens with first hand knowledge of state of affairs in this state.



”You are selected because I know you have deep knowledge of our state and the aspirations of our people. You are also fully aware of our five point agenda , its making and the ideals that underlie our governance philosophy.



“You are therefore expected to be creative and innovative as you carry out this assignment. Our approach must be practical and down to earth. Be aware as you have been that Osun is a special case demanding unique solutions.



“The task is bigger than ensuring a seamless transition in partnership with the team from the side of the outgoing state government; I expect robust innovations and out of the box ideas on how best to hit the ground running by November.



“The people of Osun State expect so much from us as they are passing through very difficult moments. They have entrusted us with the enormous task of reviving our dear state to genuinely serve their aspirations and attend to their needs.



“We are ready to meet the desires of our people. We are equipped with requisite skills and determination to meet the challenges ahead. Our administration will be by the people and for the people. Our ultimate guide will be the best interest of Osun people at all times.”



Adeleke added, “To ascertain facts and figures about the general state of affairs of the State and the state of finance including funds from the federation allocation account, internally generated revenue, grants and other sources of income



“Also to interface with individuals and groups with valuable information on the governance of and ascertain the level of indebtedness of the state and Local Governments and the terms of repayment of such debt



“Others are to examine the present structure of Government (numbers of commissioners, special advisers, special assistants, boards etc.) in Osun State and make appropriate recommendations to the Governor-Elect, obtain/collate information on movable and immovable assets of the state government



“To critically examine and review all agreements, MOUs and other legal instruments entered into by the outgoing administration with contractors, consultants, banks, etc. and make appropriate recommendations on the present structure, finance, effectiveness of local government in Osun State and make appropriate examine present policies on education, agriculture and health and give appropriate recommendations



“Also to propose actionable agenda for the new administration in the first 100 days, 1 year and subsequent years and matters relating to state labour force, welfare, payment of salaries, pensions and gratuity and Interface with the transition committee expected to be set up and examine capital projects awarded by the outgoing administration with a view to ascertaining the stage of completion vis-a-vis amount paid.



“To provide a robust media projection and response for the governor elect and the incoming administration and review the current security architecture of the state and interface with relevant security agencies in order to ensure a seamless transition,” the governor-elect said.

STOP SPEAKING FROM TWO SIDES OF YOUR MOUTH.
it is trite that no court will dabble into the internal affairs of any political party in Nigeria.
The question for determination is what are qualified as the internal affairs of any political party as enshrined in various plethora authorities, they are as follows sad1) selection of party executives from wards level, local level, zonal level, state level and National level (2) conducting party primaries at wards, local, state and national levels for the purpose of selecting or appointing candidates for each elections at every level.
Has court used this trite in our law which goes thus, no court has the jurisdiction to dabble into any internal affairs of any political party in Nigeria? The answer is in affirmative, yes this same provisions was used by the Federal high Court osogbo and Federal high Court Abuja to decide the two cases of Adeoti Moshood Versus A P C, oyetola and INEC pre election matter And same principle was also used to determine the case instituted by the TOP against the APC to challenge the outcome of the party wards, local, state, zone and national party executives elections.
Can any state executives conduct party primaries or election of the Party executives or delegate, the answer is no, it is the sole duty of the national organ of the Party.
can anybody from the party challenge the outcome of the party primary he or she doesn't participate? The answer is no, only an aspirant who participates physically in the primary conducted by the National organ of the Party has the locus standi to challenge same.
Can Supreme Court adopt technicality in its decision and deviate from the provisions of law? The answer is no, supreme court is a court of justice that will stand with the elementary tenent of our legal jurisprudence who will not deviate with the extant law or act as provided for.
let us defend our democracy and rule of law for the betterment of our society and our nation.
