Oyedotun Babayemi Vs PDP, INEC and Senator Ademola Adeleke:

An Application filed by Prince Dotun Babayemi in collaboration with Osun APC (behind the Camera) for substituted service on Senator Nurudeen Ademola Jackson Adeleke will be heard by Supreme Court today.

By practice of Court of Records and couple with inability of Dotun Babayemi ( in collaboration with Osun APC) to have the processes of Appeal against the decision of Court of Appeal at Supreme Court served personally on Senator Ademola Adeleke, the Application will surely be granted by Supreme Court. Once it's granted, Senator Ademola Adeleke is deemed to have been properly served.

So, from there, the matter will subsequently set for hearing. Inshallah, Senator Nurudeen Ademola Jackson Adeleke and PDP shall be victorious!

It is hilarious how APC are trying so hard to snatch Osun People's mandate backdoor through Prince Dotun Babayemi's suit against the people's Governor.

Let it be clear that the good people of Osun rejected APC and will resist attempt to steal our mandate.

Osun Guber Poll: False Observer Reports, Media Trial Can't Change Peoples' Will - Osun PDP

The Osun State chapter of the Peoples Democratic Party (PDP) has berated the coordinated plot by the defeated All Progressives Congress (APC) to explain away its woeful loss at the July 16 governorship poll through sponsorship of fake security reports, unfounded petitions and spurious election monitor reports to undermine the credibility of the elections.



In a statement by the office of the State Caretaker Chairman, Dr Akindele Adekunle, the PDP rebuked the APC and Mr Gboyega Oyetola for its increasing resort to media trial of the petition it wilfully submitted to the election tribunal, asking why the APC has suddenly developed cold feet in pursuance of its false submissions before the Tribunal.



The PDP posited that in a spate of one week, the APC has deployed several tactics ranging from declaration of insurgency war on Osun people, plot to burn down Osun INEC office, spurous petition to move the tribunal sitting to Abuja and now sponsosrship of falsified election analysis by paid agents masquerading as election observers, submitting that "media trial is an insult on the judiciary that has demonstrated readiness to discharge its responsibilities without fear or favour.



"In a reprehensible bid to subvert the will of the people, anti-democratic agents have revived their tyrannical pens to churn out vile articles which will in future hunt them as men and women who deploy their intellect in service of anti-people agenda. Full of bile and hate, their anger at electoral loss has beclouded them to the reality that this is a democracy and the governorship of Osun state is not a birthright of anybody.



" We are aware that the APC's resort to media trial and the cacophony of fake election monitor reports are designed to blackmail and stampede the judiciary. We hasten to add that Osun people have decided and no amount of trick will subvert their will," Dr Akindele said in the statement.



"As much as we do not want to join issues with anyone, we must restate our firm resolve to stand by the decision of Osun people in the July 16 governorship poll, which was resoundingly acknowledged by well over 30 observers, both local and international, to be transparent and reflect the will of the electorate."



"We are well aware of the desperation of the APC and so, not surprised that it will fancy anything that can sustain its illusion that it did not lose the election. The victory freely given to our party and candidate, Senator Ademola Adeleke, has come to stay and we want to warn the APC to desist from promoting any information that could ignite violence.



"Osun people watched their mandate stolen in 2018 and will not entertain any idea of that happening again. Since the APC/Oyetola has filed a petition before the Tribunal, we advice them to go before the panel to pursue the mirage of not losing and stop polluting the public space with misleading information.



"We therefore charge Osun people to be on guard and be prepared to resist any plot by the APC to make mess of our democracy with its incessant culture of stealing mandate.



"For us, as a law-abiding party, we reiterate our respect for the judiciary and have faith in it pushing back any devilish attempt to deny the people their rights to decide who leads them", the statement concluded.

#FLASH: SUPREME COURT, EBONYI JUDGEMENT AND BABAYEMI'S FALSE HOPE

My attention was drawn to the reccent Supreme Court judgement delivered today 14th of September 2022 that affirmed Mr odili ifeanyi as PDP governorship candidate for the 2023 gubernatorial election in Ebonyi state Nigeria after setting the judgement of the appeal court that earlier affirmed Senator Obinna Joseph Ogba as the governorship candidate for PDP in Ebonyi state. The crux of the facts in that case was that Mr odii ifeanyi won the PDP primary election conducted by the National organ of the Party (PDP) supervised by the INEC in line with the provisions of the PDP constitution, constitution of Nigeria 1999 as amended and the provisions of the 2022 electoral act of Nigeria. For a reason best known to the National organ of the Party another primary was conducted that produced Senator Obinna Joseph Ogba as the PDP governorship candidate for 2023 gubernatorial election. The hint from the judgement was that the second primary that produced Senator Obinna Joseph Ogba was not supervised by the INEC and that 90 percent of the 3 adhoc delegates did not participate in the said primary. The Supreme Court in its wisdom nullified the said primary and Mr odii ifeanyi was declared as the PDP governorship candidate in Ebonyi state for 2023 gubernatorial election.

Now let us address the wide difference between the appeal filed by Dotun Babayemi against our Governor elect senator Nurudeen Jackson Ademola Adeleke at the Supreme Court of Nigeria after two Federal high Court and two appellate court had dismissed his case against the PDP, inec and our governor elect in relation to today Supreme Court judgement in Ebonyi state. I want to state that Dotun Babayemi case is dead on arrival and can not be compared with what happened in Ebonyi state in the case analysed above for the following reasons :
(1) Dotun Babayemi did not participate in the primary in line with the PDP constitution, 1999 constitution and the 2022 electoral act which mandates that only the aspirant that participated physically in a primary conducted by the National organ of the Party, supervised by the Inec has locus standi to challenge the outcome of the primary. Dotun babayemi himself sworn to an affidavit that he did his own primary at wocdif not at the accredited place where the National organ of the Party and inec were. See sec 84(14) of the electoral act 2022.
(2) On the issue of authentic delegates or executives, it has been decided by the Court severally that the power to make both the executive and candidate of the Party rest only on the National organ of the Party not on the state organ of the Party and no court has jurisdiction to dabble into the internal affairs of any political party, it is trite.
(3) on the premises of the judgement which is already appalled against on which Dotun babayemi is arguing his case . The legality of the law is that whoever that is not a party in a case can not be a beneficiary or be affected by same. Dotun babayemi was not a party to the judgement already appealed against on which Dotun babayemi is arguing his case. Hon soji adagunodo was the person that took the party to court in that judgement not Dotun babayemi the question is that can Dotun babayemi benefit from a judgement he was not part of l leave the answer to the almighty Supreme Court though the same judgment had been crushed by the Akure appeal court .

Supreme Court is a court of justice that will look critically on all the existing relevant laws most especially section 84(14 of the new electoral act 2022 before deciding on all issues before it. Imole has come to stay in Osun State no cause for alarm God does not speak twice.

A high court gave a judgement in his favour befor the primary, PDP went and got another high court judgement which should be invalid since the judgement came from a court of equal jurisdiction with the first one. That's even the reason he had a pararell primary. Apart from that, is this the first time the supreme court nullifies appeal Court's judgement? So allow him to exhust his chances.

check my wall very well. All the court cases are always posted on my wall. Dotun Babayemi’s case have been dismissed in both state high court in Osogbo, federal high court in Osogbo and court of Appeal in Akure . Supreme Court of justice will dismissed Dotun Babayemi’s case for lacking merit. Dotun Babayemi’s case is dead on arrival. Besides he has been expelled from Pdp.
