Industrial Court Orders ASUU Back To Work by gabolak(m): 1:55pm On Sep 21, 2022
The National Industrial Court has ordered the Academic Staff Union of Universities (ASUU), to call off the ongoing strike.

DAILY POST reports that the industrial action has lasted for seven months.
The Court invoked section 18 of the Trade Dispute Act and national interest of the Nigerian students to grant the request of the Federal Government for an order of injunction against the lecturers.

Justice Polycap Hamman issued the order for suspension of the strike while ruling in an application filed by the Federal Government asking that the University teachers be compelled to go back to work pending the resolution of their demands for better working conditions.

Is it the court that will pay ASUU members the outstanding 7 months salary? I'm sure this is a judgement passed by the industrial court which I know will be appealed by ASUU..Does a government who does not obey court order expect ASUU to obey the same court order? Time shall tell! ASUU can also decide to honor the court judgement for 24hrs,then go on strike again the next day.

They can't be wiser.

The decision before the NIC today was simple. Would the court allow itself to be used as an instrument of futility for the struggle so far? & only postpone for students, even longer strikes or would they check the FG as they are bound to & facilitate an end to incessant strikes?

It allowed itself to be used for the former.
ASUU is compelled to call off the strike. Disgruntled and disoriented academic staff are forced back to work pending the determination of the suit which the FG is willing to drag on till the end of its administration.

The reality is FG intended to use the court as an instrument to frustrate ASUU’s ambition and if the court had a bit of an hint of discernment; they’d know than to ask Academic staff to resume however disoriented they are, back into the situations they sought an end.

Yh, a futile strike. Students time wasted.

And not very far from now, another strike will begin anew. Might be longer than this 6 month. FG has no incentive then to address issue in so far NIC has offered itself as an instrument to nullify such strike actions and so the universities will continue to deteriorate, unmotivated staffs will be the universities lots, but then now and then we would rejoice at the convocation of our political elites children in universities abroad.

That said, Channels reported this news over 1hr ago. Users have posted the news immediately on this platform too. Yet it won’t make FP until the news is stale.

How will it get to FP when the owner of the platform prefers interacting on Twitter, preferring to court the attention or be noticed by Hundeyin to using his own platform?

There was a time nairaland was the go-to place for breaking news.
It’s sad that the founder can no longer endure his platform. But rather than let the platform be destroyed as its reputation has been, why not put it up for sale? or get it listed.

We all knew it would come to this.

Now, ASUU will have no other choice than to resume or be found guilty of disobeying court order.

At the end of the day, ASUU will visit their anger on the students.

SMH

Even though we all want ASUU to call off the strike, it shouldn't be through the Court.

Nigeria has truly suffered in the hands of Buhari and his APC fellows.

May affliction never rise the second time.

whine yourself. Except they want to employ new staffs in all the university on strike, they can't force them to resume.

University Lecturers are not daft among them we have the finest brains who always outsmart the government.

ASUU will find a way around that court order.

When Obasanjo threatened ASUU with no work no pay around 2003 or so they resorted to something called "active non compliance". Lecturers would report to work in the morning and just mill around without holding any lectures.

No one advised us to go home. Dem no the tell blind man say rain the fall

Once again, another poor and needless deployment of Interim Order! Where is the urgent situation to be saved by the interim order when the “damage” is already done with an entire academic session wiped off the academic calendar of our universities? Best to have an accelerated hearing that puts parties and their Counsels on their toes so justice can be done to meet the facts and situation of the Suit. The futility of making an order that might be difficult to carry out is exactly why courts should refrain from making orders that might be in vain as in the present situation. It is simply impossible to carry out within the lifespan of the interim order as it ends up granting the claims of the FG without a trial on the merits. The Fast Track provision in the court rules is exactly the reason the Judge ought not have granted the interlocutory order! The judicial reasoning here is faulty. It puts the court system in a difficult position where it courts disrepute. Much of law sometimes is common sense! Nigerian Judges must wake up and smell the coffee in the acknowledgement of the fact that Nigerians are not dumb! The Judge says it is a judgement according to “national interest”. Judgments ought to be according to Law. See - Mogaji v Odofin. Amazing!! We know a good judgment when one is delivered!!
