Hopefully, one day Udom would answer for spending #2.1 billion on the International Worship Center perimeter fence as at March, 2021. And Akpabio would one day answer for spending #100 billion as at 2014 on the Ibom Tropicana project which he didn't complete. Hopefully, Gov. Udom would be made to pay for spending #17.9 billion on the 21-Storey Dakkada Towers with no economic recompense to the state. He'd answer for all of these someday. Someday. |

The case started in Lagos and the person who petitioned and stood as witness is an OBA henchman today, Leo Ekpeyong. It was OBA that dragged the case from Lagos to Akwa Ibom and was delaying a case he could have plea-bargained in Lagos until this election season. Imagine a gift he took in 2012.... He made this same mistake and lost his Senatorial bid until Appeal Court saved him years ago. Justice Okeke was posted to Ibadan and the specific instructions from the CJ of the FHC is that all pre-election cases and cases that have attained near-conclusion be disposed of. You see the problem? He was given 7 years. Even if he appeals, he can only get a reduced sentence.... He was convicted on Section 15 of the money laundering Act. Read!!! 1 Like

For the WAEC I have told you that, Okon's lawyers invited WAEC via subpoena duces tecum and not Subpoena ad testificandum. If Okon's lawyers has done their homework, they will have been the ones subpoenaing WAEC and not allow the defence to use legal gymnastics in defeating them. The Judge doesn't issue Subpoena, she only orders it when you apply. |

OBA's case is an almost impossible situation. He has maybe 20% out of 100%. saintkeppy:Subpoena is not initiated by a Judge, they only give order to what the Counsel(s) seek. Evey counsel has a right to choose what witnesses to call and in what order to call them: In duces tecum.. 1. The summoned individual is not sworn under oath. 2. The summoned individual is not cross-examined. 3. The summoned individual does not tender documents but "produce" and may be asked to leave by the Judge (based on oral testimony and not cross-examination). His/her only job is to produce the materials in Court and leave. 4. Even if the witness is forced by a Judge to testify under oath, the higher Courts will render it null and void. However, there are certain documents where the evidential proof cannot be determined by a duces tecum (that's for another day). 5. Under this duces tecum, the documents are not necessarily evidence but just to determine the maker(s) of the documents but will be admissible but can be countered with proof. The Appeal Court or indeed, Supreme Court cannot compel an ad testificandum on WAEC. What the higher Court will do if it finds fault with that subpoena is to order a retrial. That is, take it back to the High Court and order the Chief Judge to re-assign the case to another Judge. However, this case was filed on June 10th or 11th, meaning that next week Sunday will make it 180 days wherein which the trial Court can no longer handle the issue, the Appeal Court will only scold them and then dismiss the suit regrettably. Forgery is a criminal offence and the onus is on the plaintiff to prove his case beyond every reasonable doubts and not dwell on the weaknesses of the defendant(s). cc garfield1 |

garfield1:He is a powerful person so he is trying to circumvent the law. Have you seen him campaigning or seen him in the open? When a high-profile person is sentenced or convicted as the case may be, the feasible thing to do is to apply for bail pending appeal but in the eyes of the law, he is a convict. The higher Court can only grant bail under very unusual circumstances, one of which is ill-health that the Correctional medical facility cannot handle. This process can take as much as 6-8 months unless the issue has to do with jurisdiction. The FHC cleared him in June last year, he won the APC Primaries in May 2022 and the Appeal Court jailed him in July this year. This judgement was in Lagos and immediately, he ran to the National Hospital in Abuja and paid for a bed. He did it the 'Nigerian way' and got a document to EFCC for an undisclosed ailment. So during the day, he is in his bed and at night, he is with his friends... Nothing stops OBA's Campaign from going on but he won't come out unless he mysteriously gets down with an undisclosed ailment. INEC wasn't a Party to the suit and hence have no powers to disqualify any Candidate. That will be the job of the tribunal which will definitely sack them if they win. |

garfield1:No, immunity doesn't exist in Tribunal judgements. The Appeal and Supreme Courts will adjudicate the cases that emanate from a Special Court 'the tribunal.' How were Olusegun Agagu and Olagunsoye Oyinlola removed? |
