I would not want to be engaged in any legal battle. I am new in the UK and just want to leave the company and start a new life at a new place. I may not be replying the mail from the company anymore.
Respond with the snapshot of the relevant part of your contract. They are simply grabbing at straws and trying to intimidate, they have nothing on you.
No need to respond to the bullying thing. Play your cards close to your chest, you don't want to give them any ammunition to use in anyway in future.

Sadly you would have to respond to them and engage with them as much as you can. You also need to detail how you have been bullied and how this has affected your mental health. You need to specifically state what’s on your contract and that you have only been with them for 2months. List out your start date and today’s date. State that you have been threatened frequently with contract termination by xyz person (name and shame the person) and that you are in no way in breach of your contract as you have abided by all the rules of your contract, and that threatening to report you to Home Office is also a form of bullying.

You need to be bold, you have nothing to lose as they have way much more to lose than you. They might end up losing their license if they continue to over assert their so called authority over you. If you need me or anyone else here to help you draft the email just say the word.

Also, moving forward, do not engage with them verbally, everything should be on email so there’s paper trail.

You have as much legal protection as a person who has been here for a decade, please do not let them abuse your rights.

Like!! I’m livid on his behalf. Threatening to report him to home office?? For what? He has a legal right to work. From all he has said on this thread, he only overemphasised his ability to drive a manual car. That in itself is not a crime. They are being ridiculous. Instead of them to be begging him to stay, they are sharing contract terms that further proves him right. progressivegee don’t be scared of anything oh, and for that week that you’ll work, they have to pay you. I cannot even begin to imagine the emotional stress you are currently going through. Sorry jare

Try not to do the bolded. It may fetch you an unwanted escalation, which you'd rather avoid. And before you start waving the emotional distress banner, assess your own position and your actions carefully, as well as those of your employer. Documented and/or demonstrable ones preferably.

In my experience, probationary notice periods generally range between 1 and 2 weeks, so I assume you probably have the right of it in this case.

Regarding other matters which you may or may not have presented here, have you any documented evidence of the allegations of mistreatment and bullying you adduced? You mentioned the company refusing to stand guarantor for you as part of your securing accommodation, was this contractually promised in writing? You mentioned something about not being able to drive a manual car, remind us again - was your ability to drive a car part of the skills reasonably expected of you for this job? Does the company provide vehicles, and are those vehicles all manual (fleet vehicles in this country quite commonly are). What other grounds are there for your employer becoming dissatisfied with you and subsequently resorting to maltreat you as you say? Might the employer have grounds for a wasted recruitment claim against you?

In all probability, this will likely end with more threats and huffing and puffing, but don't apply silence to this matter. See it through.

He shouldn't fret just reply them calmly stating the obvious. If they insist on 2 weeks notice just play along with them before you know it 2 weeks is here then you can leave their company.

Not only when you work for the bolded and also not only when you are the bolded.
If it’s you alone, good! And if you have dependants, you can do this below.

- The main applicant and his or her dependants can all get a refund that would be lodged directly into the account used in making the same payment initially.
- As long as you work in healthcare; either with care homes, Independent living, Domiciliary, NHS or whatever, you qualify.
- When applying, ensure your application (payslips) timeframe starts from March of the year under review to avoid rejection.
- If the main applicant (MA) and his dependant work in healthcare, they only need an application that will include all their details.
However, If their timeframe isn’t the same, they can decide to do it separately.

Remember me when the ££££ enter o, just a bottle of O’mara’s Salted Caramel Irish cream will do cool

@alphauno, it’s not clear to me why the payslips should start from March of the year. Is it about sending all payslips within one fiscal year?

I intend to use payslips from August 22 to February 23. Hope no issue with that?

I was told driving was a requirement and yes the company provides vehicles but wasn't explicit about manual transmission. Since the driving incidence, I have received a cold treatment including threatening of job sack and return to my country at any slight instance. My ID card expired since November and wasn't renewed so I move about with an expired company ID. I wasn't given the required training my colleagues were given. I get queried for things other colleagues do. E.g I was told I will be sacked for wearing the company's coat in a client's house but other senior colleagues do wear same coat and no one bat's an eyelid. I am accused of doing things and never given a chance to defend myself.

Reply with semmyk's draft and state these things as an addendum. State the names of the persons who have threatened you and possible times they did.

Be factual but allude more to how these acts have affected your mental health.

Also, ensure your new COS is titanium locked so, you have a new contract to hold on to.

Cheers.

Just to say this.

When on your right and as it alludes to intimidation or issues that affect your mental wellbeing, no fear, stand your ground.

On this platform, issues far stronger than this have been resolved. People, including my humble self don write home office for here query them, nothing happened. Schools have been queried with HO join and the issues resolved.

Just make sure you are speaking the truth and stating the facts.

You would be fine.

Hello guys, after officially sending my resignation and sighting issues of bullying, harassment and threat by the company, I got this mail from the MD who is the husband of the madam. I have gone through the contract over again and the only clause that talks about 4 weeks notice prior to resignation is if the employee has passed the 3 months probation and I am only 2 months old with the company.

How should I respond?

Threatening not to pay you for hours worked is bullying and unprofessional and also illegal.

Sorry for the late response, I have been busy.

The UK has what is called a fiscal year for some of her services eg a tax year (for 2022/2023, it’s April 6 to April 5). Probably for administrative ease.
In regard to IHS refund, it’s from 31st March or after, of the year under review.
- it’s a staggered payment, so, you only need payslip for the first 6 months and ensuring that you have worked a minimum of 16hours per week.
- yeah, your application should fly

If the advert mentioned driving was an essential requirement for the job, the company may well be within their rights. However the use of intimidation and bullying is never the right approach. This is when being a member of a Union becomes very useful as you can get representation and advice in situations like this but I appreciate you are new in the country so not an option for you.

TheGuyFromHR raised a question about recruitment costs which has been glossed over - did the company pay your relocation expenses from Nigeria?

Obvious gaslighting. Refer them to section 1.5.4 of the contract and reinstate your rights to them.

"Dear Mr.Bleep

Please refer to section 1.5.4 of the Bleep company employment contract which I signed on the *date*. As you can deduce, this was signed less than 3 months ago so therefore I am only legally obliged to a week's notice as per terms and conditions of the stated contract..........."

Then add whatever it is you require from them etc. Tell them that you expect to be paid any money owed and threaten to take them to an employment tribunal

On the notice period, reply them quoting the signed contract and the provisions therein.

As you are not legally bounded to explain the bully/threats they have subjected you to, I will suggest you do not respond to that, remember anything you say or do can be used against you in the court of law especially as you have not sought proper legal advice.

Also note that issues are handled on individual basis. If company's operating guidelines says feed dog once, that your colleagues fed dogs 3 times and got away with it does not mean you should feed the dog 3 times, the question will be did you breach operating procedure? same with the company's coat, and by the way, can you confirm that those colleagues were not cautioned behind the scene. And telling you that you would be sacked if you break such procedures could come as a way of final verbal warning not threat [maybe bully].

And more importantly, do you have evidence/witnesses for all these allegations so that it does not become your word against theirs. Your colleague that said the company is trying to get rid of you (even though true) can easily deny it if you don't have evidence.

Hi guys, I posted sometime ago (other miniker) about issues with my company because I wasn't able to drive and how they threaten to sack me at any slight instance including feedind a dog thrice instead of twice. It hasn't been easy for me. I have been trekking in the winter to see clients and never complained yet my company never cease to threaten me of sack for the most trivial of issues. They constantly remind me that they are doing me a favor by keeping me cos I wld have been long gone to my country the moment they noticed I cldnt drive. They refused to renew my ID card and didn't give me the training they give to other staff.

I was told by my South African colleague that the company wants to chase me and I should find a new sponsor before I am chased out. Luckily for me, I got a new sponsor and I have a new COS. I have also applied to update my Visa using priority option.

My company sent me a mail that they have booked me ahead for work till the new year. I plan to start at my new place before the Christmas. I responded that they should only book me for a week cos I will be stopping after a week. My contract states that both parties should give at least a 1 week notice before contract termination.

I was told to report to the office and on getting there I laid all my concerns. I have been living in an hotel with my wife and two kids for close to 2 months and the company refused to stand as a guarantor for me to get a house. I also made other concerns. They said its non of their business if my kids are registered with a GP or not or if I have a place as long as I work with them. I maintained my stance that I want to quit but was told I must work for a month before quiting or forfeit the pay for the days I have worked. I said I wasn't going to work and the madam opened the door and asked me to get out. I got up and left.

Later in the day, the husband mailed me that I am breaching my contract that I must work 1 month or they will report me to home office and I will have a limit to stay in the UK. I didn't reply his mail but I have a copy of the contract that states other wise.

Any advice for me guys?

To the best of my knowledge, you still have 60 days to get another sponsor and legally still be in the UK. So, persist and hold your ground gidigba
Thank goodness you already have a new COS and the process is almost completed.
- Join a union, it might come in handy
- No employer can refuse to pay you for work done. Just make sure you have your evidence
- I hope you are in the process of learning the manual driving?
