Koldfuzhion: I don't know what you consider recent sir. Nigerians have never had it better this past year. Generally the num of EB visas issued was double the typical num. I know of a case in Oct and Nov. |

Koldfuzhion: Congratulations sir. You're at the final lap of the race. Pre-covid USCIS/NVC was the bottleneck in the process but now the interview date is the bottleneck at least in the case of Nigeria. The wait time is longer than usual but things are catching up. You'll get your last letter, they just follow the FIFO method. |

I’m learning new things!(DQ, IL, FIFO etc ). It’s nice to see and learn the nitty-gritty of how the consular processing phase differs from the adjustment of status phase for those outside of or within the United States respectively post I-140 approval. Kudos to everyone making contributions and keeping the thread active! 1 Like |

High impact is subjective. Nonetheless, proving high-impact isn't too difficult; it's not as tricky as it sounds. chibertha:Generally speaking, your hubby profile looks good-to-go. Kindly pay attention to TWoods' and Studymore123 food-for-thought. Eakhilomen has a good point there. |

Noticed today that there's the O-1A route. Has lots in-similitude to EB-1A and EB2-NIW. Probably, it should be on a different thread so as not to derail this well-managed EB thread. Kudos to all. General Eligibility To qualify for an O-1 visa, you must demonstrate extraordinary ability by sustained national or international acclaim, or a record of extraordinary achievement in the motion picture and television industry, and must be coming temporarily to the United States to continue work in the area of extraordinary ability. Extraordinary ability in the fields of science, education, business or athletics means a level of expertise indicating that you are one of the small percentage who have arisen to the very top of the field. For detailed information regarding how USCIS evaluates evidence to determine O-1A eligibility, including examples and considerations that are especially relevant for those in science, technology, engineering, and mathematics (STEM) fields, see the USCIS Policy Manual Volume 2, Part M, Chapter 4, Section C, and Appendix: Satisfying the O-1A Evidentiary Requirements. www.uscis.gov/working-in-the-united-states/temporary-workers/o-1-visa-individuals-with-extraordinary-ability-or-achievement Part M: www.uscis.gov/policy-manual/volume-2-part-m-chapter-4#3 |

semmyk: The O-1 visa is a temporary visa and you require a sponsor. It's just a longer route to PR. 1 Like 1 Share |

Can't agree more. Absolutely, a way longer route to PR. PS: Some come in via 0-1 and stayed back via EB-1,2,3. studyless123:... require a sponsor ... | that's where nuances of 0-1A come in. Very trick. Hence, if EB-1A, EB2NIW is sure, why not. Much better option. By the way, that is the objective of this thread. @All: Kindly note this thread remains focussed on EB-1, ,2, 3 petition towards PR [one nuance of 0-1] FAQ from USCIS Q: When an agent performing the function of an employer files a petition, are contracts required with the employers where the beneficiary will be employed? A. No, in the case of an O petition filed by an agent performing the function of an employer, a contract is not required between the beneficiary and the entities that will ultimately use the beneficiary’s services. Q. Can partially or fully self-incorporated persons petition for themselves in the O classification? A. The regulations require that an O petition be filed by a U.S. employer, a U.S. agent, or a foreign employer through a U.S. agent. Q. Can a foreign employer be a corporation owned by the beneficiary? A. Yes, but the petition must be filed by a U.S. agent. A foreign employer may be a corporation owned wholly or in part by the beneficiary, but the foreign employer must utilize a U.S. agent to file the petition. A U.S. agent petitioning on behalf of a foreign employer must be authorized to file the petition, and to accept services of process in the United States in proceedings under section 274A of the Act, on behalf of the foreign employer. ... ... |

A quick one please, I have a sister who is a medical doctor and I would want her to explore the EB2 visa (no job offer, so NIW). I am aware there’s a physician EB2 and the regular one for everyone. However what I want to know if she needs to qualify to practice in the US before she can file. Thank you. |
Re: USA Employment-based Immigration (EB-1,EB-2,EB-3 Visa) by NotsonewMary(f): 4:04am On Jan 13, 2023 |
purplesummer: No, she doesn’t need to qualify to practice in the US before she can apply for the general EB2 NIW. She already qualifies as an advanced degree holder with her medical degree (she should have this evaluated to the US equivalent, I recommend using WES). The rest of it will be to satisfy the 3 NIW prongs. Note; For the general EB2 NIW, her proposed endeavor should not be that she’s coming to work as a physician, because just as you mentioned, there’s a physician NIW pathway with its own set of requirements. She can use research, public health, technology etc as it applies to her. 1 Like |

Kindly specify the type of work visa. Inbtw, if it's not any of the EB, you may be better assisted in one of the US work visa thread. All the best. For H1B - https://www.nairaland.com/7137181/everything-us-h-1b-visa-category @Justwise, seems USA might need a work visa thread like the USA students visa or USA visit visa. PS: Depending on the visa type, accredited/registered agents in the States are typically allowed to assist with processing adigun27: |

The 'agent' must tell you the specific code for the unskilled worker category. If per chance it's the EW-3 visa (broadly the EB-3 visa), Third Priority Worker visa, then you might get guidance on this thread. Especially, with changes and processes. Info on form as at 2016: www.uscis.gov/sites/default/files/document/outreach-engagements/PED_Form_I-140_TSC_Engagement_1-20-16.pdf Info: https://travel.state.gov/content/travel/en/us-visas/immigrate/employment-based-immigrant-visas.html#third Info on USCIS: www.uscis.gov/working-in-the-united-states/permanent-workers/employment-based-immigration-third-preference-eb-3 Designated as 203(b)(3)(A)(iii) on I-140: www.uscis.gov/sites/default/files/document/forms/i-140.pdf NB: the DE categories, as I understand, require employer sponsorship. Not sure what's the role of your agent. The experienced on this thread would guide you. adigun27: adigun27: semmyk: |
