I don't know what you consider recent sir. Nigerians have never had it better this past year. Generally the num of EB visas issued was double the typical num. I know of a case in Oct and Nov.

Congratulations sir. You're at the final lap of the race. Pre-covid USCIS/NVC was the bottleneck in the process but now the interview date is the bottleneck at least in the case of Nigeria. The wait time is longer than usual but things are catching up. You'll get your last letter, they just follow the FIFO method.

I’m learning new things!(DQ, IL, FIFO etc smiley). It’s nice to see and learn the nitty-gritty of how the consular processing phase differs from the adjustment of status phase for those outside of or within the United States respectively post I-140 approval.

Happy to share that my I-140 (EB2-NIW) was approved this week! ( such a great Christmas gift lol).

I filed I-140 and I-485 concurrently 5 months back. I completed the whole process myself with help and guidance from a few other friends. I did not employ the services of a lawyer (personal preference though).

I have shared resources and links that were helpful for me on previous pages of this thread.

High impact is subjective. Nonetheless, proving high-impact isn't too difficult; it's not as tricky as it sounds.

Noticed today that there's the O-1A route. Has lots in-similitude to EB-1A and EB2-NIW.

The O-1 visa is a waste of time since you can use the exact same info to get an EB2NIW.

A quick one please, I have a sister who is a medical doctor and I would want her to explore the EB2 visa (no job offer, so NIW). I am aware there’s a physician EB2 and the regular one for everyone. However what I want to know if she needs to qualify to practice in the US before she can file.

No, she doesn’t need to qualify to practice in the US before she can apply for the general EB2 NIW. She already qualifies as an advanced degree holder with her medical degree (she should have this evaluated to the US equivalent, I recommend using WES). The rest of it will be to satisfy the 3 NIW prongs.

Note; For the general EB2 NIW, her proposed endeavor should not be that she’s coming to work as a physician, because just as you mentioned, there’s a physician NIW pathway with its own set of requirements. She can use research, public health, technology etc as it applies to her.

All the links you need have been posted by others already.

Because I know this is alot of information to someone new to this route. I will help to brake it down.

H1b, L1 are dual intent work visas but you need a US employer to sponsor you on these visas. Dual intent because you can adjust your immigration status to Permanent Residency from such visas when you arrive or living in the US.

Eb1b, Eb1C, Eb2 advance degree, Eb3 are Permanent residency visas but they also require an employer to sponsor you.

Eb1A and Eb2NIW (National Interest Waiver) are the only 2 sub categories that you can process without an employer sponsorship. This is because those are meant for the US to pull best brains from all over the world. They waive requirements of a job offer and employer sponsorship for these two sub categories knowing that the people that will qualify can easily land a job in the US, most likely contributed quickly to US interests.

It's not always easy for most foreigners to get employer sponsorship because of the rigor of the employer passing the Labor Certification requirements to proof that the employer cannot fill that job position with US citizens or Permanent Residents. This is why many people that can get Eb1A and NIW file for themselves.

Now to file NIW or 1A, first make sure you can provide well-documented evidences to support 4 out of the 10 criteria. I said 4 to be on safe side in case USCIS rejects any of your claims.

Then look for a good immigration lawyer that is also very familiar with your field of occupation to file I140 form for you.

To look for lawyers and read their reviews, visit www.avvo.com, you can also get a good lawyer by referral.

After you get approved on I140, you move to second stage of NVC where you submit processing fees and civil documents.

Third stage is different based on where you reside when you are going through this process. If you are already living in the US legally, your third stage is Adjustment of Status route. If you are outside the US, your third stage is Consular Processing route, where you will attend immigration visa interview in a US embassy in your country of residence.

There are so many information on this route, just be specific with your questions, so that you can get specific answers.

The 'agent' must tell you the specific code for the unskilled worker category.
If per chance it's the EW-3 visa (broadly the EB-3 visa), Third Priority Worker visa, then you might get guidance on this thread. Especially, with changes and processes.
