The thing is that even the court registries are not obeying the court's directives. I learnt that even the Supreme Court's registry no longer accepts old notes of 500 and 1000.

There lies your answer.

Well.
The scenario you painted is a kind of...

I understand this line of argument.

CBN is answerable to the FG, but it is not a part of the FG.

This defies logic. So what is it part of then? It must surely be part of something or does it exist in its own firmament.

Thus, if the Supreme Court gave orders to the CBN with respect to a case that never had them as any of the respondents, then it became a biigg joke..

If a Landlord serves a quit notice on a father, can the son who lives in the same property insist the notice has nothing to do with him because his name was not mentioned on the notice

A Supreme Court order binds, affects, and must be complied with by all things and persons living, breathing, and existing within the territory of Nigeria. Full stop. No exception.

There is a reason it is called Supreme court

Some of you are just trying to imposed your sentimental views on law. You are raising issue of jurisdiction which will be determined by the same Court during hearing of substantial case. This has nothing to do with obeying interim order.
There is something here.

We all know that the CBN is answerable to the FG, but it is independent of the FG.

In the suit filed against the FG by those states, they didn't include the CBN as part of the defendants.

Thus, they have absolutely nothing to do with that particular suit in question.. Even though they were part of the main reasons the suit existed in the first place.

So, you're saying that the Supreme-Court is very right is issuing orders to them??

Something like,, Mr.-A took Mr.-B to court (say, a high-court) for an issue that concerned them both..
But somehow, the court needed Mr.-C (who never knew anything about the court-case) to stay indoors for one-week, regardless of his personal engagements.

If the Court gives such orders to Mr.-C, while the suit between Mr.-A and Mr.-B continued, is the court doing the right thing?
Should Mr.-C refute such orders (by maybe, trying to appeal in a higher court)??

Talking about the Independence of the CBN,,
The CBN is as Independent as INEC.

If you sue the FG based on the things which INEC did, and you didn't include INEC as part of the defendants, then you really didn't sue INEC.

Same thing with the CBN.
CBN is independent.

..
Then,, talking about the Supreme-Court Order..
I think I understand what you're trying to say.

BUT THEN,, THERE ARE DIFFERING VIEWS ABOUT THAT HERE ON THIS THREAD..

SO,, I NEED TO BE BETTER CONVINCED.

I NEED TO KNOW WHICH ONE IS THE ABSOLUTE TRUTH, AND NOT BASED ON PERSONAL-OPINIONS AND BIASES..

Nothing supercedes a presidential executive order. It can only be revoked by the president himself if it is deemed to be grossly unconstitutional.

Presidential executive orders are final.

For the number 3 question, the executive and judiciary are equal, but the head of the executive (president) supercedes all in the land.
What's this? Soo if the supreme court orders the president to vacate office, the president can easily issue an executive order? Which clowns are these? Ha! Supreme court can even remove buhari. The fact that buhari is publicly issued a decree automatically makes him guilty of contempt of court. Omo, the kind of things people say on Nairaland shocks me.

The supreme court interprets the law, and can only cancel an executive order if it's against the constitution which is the supreme law of the land. That is exactly what is being determined, the legitimacy of the naira withdrawal.

Supreme court does not have jurisdiction over monetary policies.

So if Supreme court rules that one dollar should be equal to one naira, who will obey it?

As long as we are under a democratically elected government and the Constitution is not suspended......
Everyone is bounded by the law including Mr President too......
Any matter and anyone can be taken to court, any matter at all...
It is left for the court to decide if the matter is within its jurisdiction to hear or not.
If we say executive order by the President, can the president just wake up one Morning and say, with his executive order he has disolved the Judiciary.....??
That's anarchy looming.

Some people don't know the true meaning of checks and balances in politics and separation of power.

The supreme court as the highest court in the land is the last Bus stop for all cases in the land.

That is why the supreme court has the power to remove the president or call for another election. It happened in Kenya before between Kenyatta and the opposition candidate.

Except in Nigeria ( Buhari vs. Onoghen) i have never seen or heard of any president removing a cj

How does the supreme court not have jurisdiction over monetary policies?

Does that exempt it from adjudicating on a case relating to monetary policies?

Are there any matters that the supreme court can't adjudicate on?

(Thus, for State Governors in their various states,, similar addresses have overriding state executive powers over the Judiciary too,, I guess??)

There are things that are on the executive list meaning only the Federal Government can make decisions on them, monetary policy is one of them. State governors have no power to declare and decide currency but I guess many of them are waiting for the case to be deicided in the supreme court, the matter should not have been entertained.

The supreme court gave an order that all naira notes should remain legal tender pending the February 20 when it will hear the case. So the governors are acting within the ambit of the law
