If FCT was not specifically mentioned, it will be simply interpreted to mean quarter of 36.

The FCT as the same governance structure as other states. The president run the territory through a minister, the NASS make laws for the territory and there is an FCT high court.

I personally consulted my uncle (a retired judge in his 80's) on the interpretation of the constitution.
Mind you He is a member of the 1997/98 constitutional conference that drafted the 1999 constitution.
He said that the FCT 25% clause was added because the President is like the FCT "governor" who now appoints a Minister to run the territory for him.
Therefore, for the President to be the Legitimate head of the FCT, He must have 25% approval of the people in FCT.

I see. But that doesn't mean that the those Judge cannot make mistake the first time. This is a clear matter *AND* FCT.

There should be no confusion, unless that clause is not there.

And section 299 already clarified that the FCT should be treated as a state for all constitutional matter.

It's the election that will GRANT you the authority to execute the constitution. So first the president has to be accepted by the people of the FCT.

Fine, first of all I advise we keep the argument civil cos I'm interested in this clause of our constitution of and researching on it.
Mind you, BAT govt will even favour me through my boss who may likely get a Parastatal appointment so I'm apolitical right now.

Back to the case, can you provide a link to the judgement?
Based on the section you quoted. If the law sees Abuja as a state why is the 2/3 of states regarded as 24 states which is actually 2/3 x 36 ? Instead of 25 states ?

Treated like a state does not mean it is a state. Infact it means it is not so why does it need a governor. But it is not a state doesn't mean Nigerians are not living there so that makes it neutral and counted as a separate state which makes Nigeria 37 states for election's sake. All that is needed 2/3 which is 25 states. FCT is treated as equal to other states not superior

24 or 25 was not stated in the constitution. People are simply doing their own calculation based on their understanding of the provision of the constitution. For me, getting 25% in 25 is enough to fulfill the requirement of the constitution. My opinion is based on the fact that FCT is treated as a state In constitution matter like this.

Don't be surprised that they didn't even realise it until it was too late.

This is the first time SINCE 1999 that a so-called winner of a presidential election is not getting 25% in the FCT.

You missed it. That section 299 still went ahead and listed what and what should apply to the FCT as if it were a state accordingly. Read through (a), (b) and (c), nowhere was election mentioned.

Generally is the FCT treated like a state? Does the FCT have a governor?

Nothing pdp could hve done to get 25pc In Fct. No one saw this coming not even obi or Atiku. Obi really raped Atiku in this election, decimated him totally, near annihilation. Even I underrated him. I tot hed get a few votes here and there, but boy did he get more than a few votes! Tinubus greatest mistake which will follow him to his grave is not paying attention to fct. Already inec has her already tainted imag to protect after not having uploaded the results from PUs on their servers as stipulated in the EA. This is inecs only chance to redeem her battered image. There will be a rerun. And Waziri will be declared winner. We just need an alliance with Kwankwaso to stop the haemmorage in Kano. LP supporters would return home where they belong like the prodigal son, and the PDP would welcome them with open arms. O FCT, the city of Miracles.

I did some law courses in the university though am not a lawyer. I guess we'll leave it for senior lawyers to interpret then.
Remember that Mike Igini himself, a Lawyer and former INEC rec said on national tv that the 25% for FCT is mandatory.
Nobody saw this coming seriously. It's really thrilling
