He is very right... It is at the discretion of INEC.. But has anybody asked if INEC has already made their discretion known...? The answer is a big Fat YES and Inec's discretion is contained in the Electoral act which was the basis for the new act. Read this... Section 60 (5) of the Act states that the presiding officer shall transfer the results including total number of accredited voters and the results of the ballot in a manner as prescribed by the commission” (This is exactly what Alake meant by discretion) . Now read on The prescribed manner here is the BVAS, which INEC introduced to ensure that the electoral process is credible. The BVAS was introduced by INEC in line with Section 148 of the Electoral Act, which gives INEC power to make guidelines and regulations to ensure the full effect of the law. In view of the above facts. “the electronic transmission of votes provided by the Electoral Act and in the guidelines issued by INEC has not been complied with”. Hence the Presidential election results as announced by INEC is non and void. Has anyone ever wondered why Dino Melaye was insisting that the state Inec reps announcing each result should say that what they were announcing is in tandem with what was uploaded on the server? Here is the reason... Section 64 (4) of the Electoral Act states that “a collation officer or returning officer at an election shall collate and announce the result of an election, subject to his or her verification and confirmation that the number of accredited voters stated on the collated result are correct and consistent with the number of accredited voters recorded and transmitted directly from polling units and that the votes stated on the collated result are correct and consistent with the votes or results recorded and transmitted directly from polling units”. There were no statements by the returning officers that the results being called out were verified and confirmed that they were those directly transmitted from the polling unit.(This last paragraph alone has made the entire results void) Infact, INEC chairman on many occasions has reiterated that capturing of election results and uploading them from the polling units REAL TIME IS A LEGAL REQUIREMENT TO VALIDATE ANY ELECTIONS meaning without it, any election is invalid. Alake has just shot APC in the foot. My fear is just that the Supreme Court might be complicit and may not give the right Judgement cos Nigeria is a country where elephants can fly. 6 Likes 2 Shares |

Hangulsaram: Where did LP party got party agents, are u not in Nigeria when the inec published list of party agents in polling units,. LP did not have representative in more than 60 percent of polling units in Nigeria. So they are relying on others party figures in those polling units, relying on others parties figure in the North where they failed too? Where they recorded lowest votes. Here in Ekiti, they don't have party agents in more than 95% polling units, if they were rigged in those polling units, how wiill LP party challenged that? May b PDP and APC decided to rigged for themselves , pls can will LP know this, they only rely on where there's going to b over voting and nothing of such happened here |

Believeintruth: Nobody said it is not in d act, but it is not mandatory for collating votes. They inec believe in manually results collating from pus, wards, LG and states. Not banking until when server brings results online. Sending it online is not for the purpose of using it to collate. They believe all party agents already have DEA copies, |

Geopex: Are party agents allowed at the wards and LGA s? If yes, then even if LP has only 1000 party agents, being at the LGA is enough for them to capture their results. |

It is not always about saying things emotionally,my choice in this election was between Tinubu and Obi because power should rotate,that being said the law does not say you must transmit results but it mandated you to set the guidelines for the election now when you set the guidelines it automatically becomes law if you as INEC decide to change the law which you have powers to do you must inform the public of the new guidelines and those that feel the need for further interpretation can approach the court..now the guidelines set by INEC was changed immediately before and during the Presidential election this is the issue here. After the President of Nigeria the INEC chairman is the most powerful position in the country, the powers held by just one man is too much, there should be a returning officer from each region of the country that will have to vote including the chief returning officer and by simple majority before the president can be announced..this power go destroy our democracy, if as America develop reach they still rely on the Electoral college then we need to protect our democracy.. This was the same reason the PDP government removed the power to declare a state governor after election cases by the appeal court,..
