Recently the former AGF Aondoakaa was on AriseTv and he insisted INEC erred in declaring Tinubu the outright winner of the election because in 2008 the supreme made a pronouncement that the winner of presidential election must obtain 25% in the FCT. It will be interesting to see if the Supreme Court still stand by this decision or it will overrule itself on it.

Unfortunately, neither me nor u is in a position to say the Supreme Court was right or wrong . It’s only the Supreme Court that either stand by it’s previous decison or overrule itself on that matter .

I would be surprised if it’s true cos it makes no logical sense to give FCT voters inordinately more power than state voters.

One thing about these our electoral laws is that it seems our lawyers are either running a scam or are incompetent.
Why do we keep drafting ambiguous laws that are always open to various interpretations?

Supreme Court has already made a pronouncement on the 25% FCT Issue. In 2003 when Buhari dragged Obasanjo to the election tribunal one of the prayers by the Buhari legal team was that OBJ shouldn't have been declared president because he didn't win 25% of FCT during the presidential election of that year however the Supreme Court ruled in favour of OBJ saying the FCT is also considered a state meaning if you get 25% in 37 states counting the FCT you're good.

Even logically are we saying if somebody gets 25% in 36 states he won't be declared the winner because he didn't get 25% in FCT?

I think this is what Aondoakaa is misremembering.

The “and” means that Abuja counts as a state and the winner has to win 2/3 of 37 and not 2/3 of 36.

The funny thing is that if a candidate wins 24 states we start getting into Richard Akinjide’s twelve two-thirds territory, just that this time it will be twenty-four two-thirds.

No doubt they are all rascals but I believe Aondoakaa is cooking up fake up stories here. I don’t think the Supreme Court ever made any judgement making 25% Abuja votes mandatory for a winner.
