I know what u are trying to say is that an employer(LASG) can be vicariously liable for the acts of their employee ( the driver ) while in the course of their lawful duty …… However, there are instances where such would not apply and one of those is when the employee is on a frolic of his own .

This particular driver is on frolic cos he disregarded the instructions of his employers to always ensure safety first . Nobody in LASG instructed him to try to run a railway crossing when every other motorists were waiting patiently for the train to pass before they continue their journey .

The best that can come out of this is LASG compensating the victims as a form of social welfare . A court case by any of the affected families against the government won’t fetch them anything . They will be unable to establish a case of vicarious liability against the government in the courts .

You see the madness of psp drivers and of lagbus drivers. The unspoken is I be government driver, deal with it.

If a school bus driver crashes a bus and it is clear he is at fault the school is liable.


The worst that can happen to the driver is jail time

I said earlier that lasg imposes a yearly commercial license on commercial drivers in the state. You go and sit through two days of training and videos. Can we confirm this was done? Can we confirm lasg has a record of sanctioning, disciplining and dismissing rogue drivers? Or does everyone just wave it off

I have said at different times that accidents and tragedies never occur in isolation.

It is only by punitive sanctions that organisations can be forced to rewrite their processes to ensure things like this do not happen

This was a totally avoidable tragedy

That may be only cos in Nigeria rule of law is optional. Normally the state government is liable for his actions, especially when countless witnesses start popping up detailing the numerous times they made complaints about this driver.

In sane societies the employers of the driver will be sued for civil damages and they will have to cough out millions, while the driver himself will face criminal charges and go to jail for a long time.
