The All Progressives Congress (APC) and Social Democratic Party (SDP) in Lagos have applied for leave to appeal the judgment of a federal high court which ordered INEC to electronically transmit results on Saturday.Governorship and state assembly elections are billed to take place on Saturday.

On March 8, Labour Party (LP) and its governorship candidate, Gbadebo Rhodes-Vivour, secured the judgment directing the electoral commission to transmit results electronically.


Peter Lifu, the presiding judge, also dismissed an application by SDP to be joined in the suit as an interested party. In a fresh application before the court, SDP and three of its chieftains are seeking leave to appeal the judgment.

They want the court of appeal to declare that the lower court was wrong to have refused to hear and determine a preliminary objection they filed along with the joinder application. They also want the court of appeal to declare that the originating summons in the suit lacks merit.

The APC has also applied for leave to appeal the judgment as an interested party. The APC wants the court of appeal to take judicial notice of a judgment of an Abuja federal high court which held that INEC is at liberty to choose its mode of result transmission. 

The APC and SDP are both seeking a court order to stay the execution of the March 8 judgment pending the hearing and determination of the appeal.

The APC is just jittery everywhere. In a 21st century civilization, APC and SDP are against INEC’s BVAS, IREV and electronic transmission of election results? Why are these people this backward?

Don't they see how election are being digitalised today across the world? Ghana did! Kenya did it with their Supreme Court even recovering a stolen mandate.So why can't the ironic giant of Africa do likewise?

A glaring fact remains that, these anti-democratic elements can't win elections clean via the ballot hence they always resort to violence, voter’s intimidation, electoral malpractice, and sabotaging of the electoral hence democratic processes in conjuction with INEC.
APC didn't win the 2023 election. The evidence are glaring.

The only progressive thing in the electoral act which is capable of almost eliminating electoral malpractice, the APC is publicly challenging it in court?

Just the other day, INEC in connivance with the APC blatantly flouted this single most critical content of the new electoral law, thereby enabling one of the most brazen electoral heists in recent history. Now the very same scoundrels are calling for the legalisation of their heist?

I don't think you need a soothsayer to tell you that this was how Tinubu was able to rig the Presidential elections and he intends to ensure same is done at State level.

If indeed you and your party are as popular as you have said, then you should have zero to fear about e-transmission of results.

The fact that the court has to essentially regurgitate what is written in clear black and white as captured in the latest electoral act, just shows the level of decadence in Nigeria.
