Dear nlander's please pay no attention to loser @APC on the Plateau. APC was rejected on the Plateau in the just concluded elections. For political watchers like myself, we all saw and the witnessed the back and forth between the then Sen Marafa and Gov Yari APC led faction in Zamfara. No PDP aspirant on the Plateau took PDP to court as a result of it primaries unlike that of APC which up until this moment have a case in court. APC failed on the Plateau as a result of imposition of Dr Nentawe who before then was an INEC REC but was deceived to resign and later rigged in as the candidate of the party. *ALL CANDIDATES OF PEOPLES’ DEMOCRATIC PARTY [PDP] IN PLATEAU STATE WERE VALIDLY NOMINATED TO CONTEST FOR THE 2023 GENERAL ELECTIONS*: IMPEDIMENTS OR NO IMPEDIMENTS? By Barrister Emmanuel Menseh Madaki (LLM) INTRODUCTION: Recently, the general public have been thrown into a state utter confusion especially during the electioneering campaigns wherein propaganda rose to its peak especially in a bid to dissuade the lovers of the Peoples’ Democratic Party (PDP) from wasting their votes on the lame, crumby and suboptimal bases that PDP does not have validly elected executives in the state otherwise PDP was and or is without any constitutional structure recognized in law to field in candidates for any elections. Laughably, a senior lawyer who featured in a radio interview, approached the walls of the radio station in Jos with volumes of court of appeal judgment and made serious of unfounded interpretations and allusions to the judgment of Hon. Mohammed Alkali & Anor v Hon. Musa Aviah Agah & Ors and hastily concluded to the chagrin of many that a vote for the PDP in the election was wasted vote. He reliably quoted some portions of the said judgment though out of context and out of relevance. Indeed, the learned senior lawyer forgot that “Cases are authorities and precedents only for what they have decided and cannot have general applications” more so that in Agah’s case the Lawyers inadvertently did not inform the tribunal and the court of Appeal that PDP had complied with the judgment of the court for fresh congresses. The lawyers didn’t do a good job in that regard and if that case should be dealt with now, it will be decided differently. A lot of people have confronted and or accosted me to please assist in expounding the true state of affairs and the position of the law on the subject especially now that PDP has won most of the elected positions in the state. As a legal practitioner I have a duty to the society to espouse on the subject to help allay some fears. Before I delve into profound discussions on the subject matter, may I state that: ALL THE CANDIDATES OF THE PEOPLES DEMOCRACTIC PARTY (PDP) IN PLATEAU STATE WERE VALIDLY NOMINATED TO CONTEST ELECTION IN LAW. From the onset, let me swiftly state that the court judgments in issue which the opposition parties have been parading with strictly refer to the PDP EXCO of the Plateau State and does not relate to PDP National EXCO-which have the saddled the constitutional responsibility of also ensuring that candidates are nominated according to the party constitution and guidelines 2017 as amended. The current candidates were nominated by the national exco of the party. I stumbled on a particular write up by one legal gentleman referred to as S. D. Dido, Esq. wherein he captioned the write up as “PDP PLATEAU AND THE LITIGATION AHEAD” The writer referred to the case of _Hon Musa Agah Avia_ the former Member, House of Representatives for the Jos North/ Bassa Constituency wherein the Election Petition Tribunal acceded to the submissions founded on the judgment of the Learned Justice I.I Kunda of the High Court of Justice, Plateau State to the effect that the Plateau State PDP should conduct fresh Primaries to have a valid EXCO. That article is nothing but barefaced lie capable of misleading the public as it is no longer good law and cannot be regarded as precedent anymore and it is incumbent on me to clarify the issue in the following lucid and clear terms. Kindly cast your mind back to the year 2020 when PDP in Plateau State Chapter held its Congress to elect its EXCO at all levels from Wards, LGAs and State Levels during the Covid 19 global pandemic wherein there were strict restrictions put in place by Government as to gatherings limited to only 50 due to the existing regulations and prohibition. Notably, the said Congresses were widely berated, challenged and as a result were bluntly affected by the judgment of several courts which led to the decision by the party to conduct fresh Congresses across the State in order to have valid EXCO and a lot of consensuses were made, fresh congresses held which were never questioned anywhere and or contested in any court the EXCO Validly subsists till today. While the crisis in the PDP was still boiling, PDP quicky reconducted State Congress conducted by the PDP National Office thereby correcting the real or conceived legal impediments on the exco after the Ward Congresses were repeated and areas were issues still persisted were not allowed to partake at the State Congress that produced the present State EXCO of the PDP under the leadership of Hon. Chris Hassan Adukuchili and indeed to the chagrin of many detractors and propagators of mischief and confusion there is no more any legal impediments against the party in Plateau State (this was the Congress where Hon. Bitrus Kaze testified to have withdrawn from the race and there was no litigation against this second Primaries). What is more interesting is the obviously smart calculation and enabling arithmetic by the PDP national body that smartly came up with a sound approach wherein in all states where PDP had pending litigations, including Plateau State, the PDP National Office took charge of the Ward Congresses to elect delegates and also the Primaries that now fielded *ALL* the candidates that contested for the 2023 general election. Assuming but not conceding that here is no valid exco in Plateau State for PDP (which is no longer the position), it has nothing to do with the candidature of any PDP candidate at the 2023 election because no Ward or State EXCO or even statutory member partook in the election and it was never conducted by any such exco but strictly by the National EXCO of the party whose credibility and standing was never in issue. The last straw that broke the Carmel’s back is the fact that the issue of non-compliance with the judgment of Hon. Justice S. P. Gang which many have been parading with is the fact that the Court of Appeal. Jos division has finally cleaned and cleared PDP of any disobedience of any court’s order in the case of AGUSTINE TIMKUK VS INEC & ORS in Appeal No. CA/J/300/2023. This is the latest judgment and most relevant that has absolved PDP plateau state chapter of any disobedience wherein the court held that PDP has valid structure and it will never be a tea party for the oppositions who think that they can challenge the election on the ground that PDP does not have a structure as the opposition lacks the legal imprimatur and capacity to question the nomination of any candidate for election at this point. The Judgment in AUGUSTINE TIMKUK is a watershed and the most latest. What is even more? the question of nomination of a candidate or selection of a candidate are matters within the sole preserve of the political party courts have no jurisdiction to look into such complaints see EZE V. PDP & ORS (2018) LPELR-44907(SC). Afterall, for one to complain of the nomination of a particular candidate for an election such a candidate must also bring himself within the purview of the sub-section 14 of section 84 by showing that he was an aspirant in the election complained of. Who is an aspirant? An aspirant is a person who contested the primary election of his party. He must be someone who actually participated in the primary election he is challenging. See: P.D.P Vs Sylva (2012) 13 NWLR (Pt.1316) 85 @ 126 A-E; Lado vs. C.P.C (2011) 18 NWLR (Pt.1279) 689: Shinkafi vs. Yari (2016) 7 NWLR (Pt.1511) 340. CONCLUSIONS PDP has come to stay in Plateau State and all speculations as to the validity of the candidates recently voted into power are mere distractions and an attempt to find solace where there is none by the political parties that lost in the last elections. oluwatis:Totally different but they want to spread fake news. The national leadership is responsible for the nomination of party candidates as seen in the case of Senator Ahmed Lawan and Hon Machina. The APC leadership substituted Machina's name despite Lawan not taking part in the election. The supreme court is clear on that and also, APC will be seen as a meddlesome interloper because the have no say in what happens in another party. 1 Like 1 Share |

Apc will be the party to divide Nigeria,do not take the hospitality and simplicity of plateau man as cowardice, if you saw the jubilation in plateau for 3days after pdp won, apc and their highest bidder courts will have a rethink. |
