I have studied presidential election petitions and courts judgements since 1999 and discovered that 2023 petitions are the most worthless and useless of them all. It cannot upturn local government chairman election. The petitioners went to court on 4 grounds.
1. 25% in FCT. Supreme Court past ruling, all Nigerians votes are equal and so no golden votes. FCT is just one of states in nigeria as it relate to election and stated in theconstitution.
2. Tinubu indictment of drugs: Supreme Court past judgment, only Court of competent jurisdiction indictment can prevent a candidate. Tinubu was never arraigned or indicted by any court.
3. VP elect double nomination: VP name was never sent to INEC as a Senate candidate. Mere expression of intention is not equal to nomination.
4. Non transmission of results real time: There's no existing law make transmission of results real time a compulsory for INEC.
INEC substantially complied with electoral act.

The petition is the most useful. The only strong argument is the Abuja argument all others are to score cheap social media points.

The constitution is very clear and unambiguous. FCT is one of the state in Nigeria, it's expressly stated in the constitution.

People living in Abuja are not golden humans, their vote is equal to one, even buhari's vote is equal to one, democracy is based on majority of people choice. Residents of Abuja decisions alone cannot determine the election result,Most useless among the petitions.

Tinubu forfeited drug money to US authorities. If this can be proved in court,not only this election but his past political posts will be scraped. I guess that's why he's been away for so long, to straighten this. If so, I hope for humanity's sake, he failed.

The matter is already in court,you can actually join the Tinubu legal team to be a part of them,so you can go argue your points before the court.

It is very very very possible. If the occupants of Abuja are majority of a tribe not inclined to the leading candidate or are very in tune with another political party.

There is also the 5th one which has to do with number of lawful votes. In this, the petitioners are claiming that APC rigged but they shot themselves in the leg by joining INEC as one of the defendants on allegation of subtracting a candidate's votes and adding them to votes of another candidate (funny).

The umpire body has substantial evidences and materials to defend itself in the tribunal. It would have been a different case if INEC was to be a mere witness at the tribunal and not a co-defendant on the case of lawful and unlawful votes.

Furthermore, APC had agent in all the PU's and has its evidences intact unlike LP which had no agent in many PU's

It's possible

The losing or loser candidate might be from the FCT or may have done so much there. The same way it's possible for a guber candidate to win all the LGAs in a state except the state capital LG.

I'm ready to bet any amount that the court will throw out that FCT case. It doesn't make any sense.

The judiciary only interprets laws. And where there's ambiguity in the letters of the law, they resort to the spirit or intention behind the law.

The framers of the constitution couldn't have intended a situation of golden or superior votes. All states and votes are equal.

Imagine the chaos if a court rules that the votes in a state or the FCT are superior or golden. Politicians will stop at nothing to win and harvest such golden or extraordinary votes.

This cannot be the intention of the constitution. It cannot be.

I don't think the FCT issue is even any strong. Lawyers are politicizing the issue even though the language is clear. 25% in 2/3 of the states and FCT simply means 2/3 of the 36 states and FCT, meaning FCT might complement the number of states to achieve the 2/3.

The constitution didn't say ..."in 2/3 of the states and IN FCT. That 'IN' in bold would have made it clear that aside from 25% in 2/3 of the states, a candidate must also have 25% in FCT.

Some people would say ... but the lawyers who argue in favour of the 25% requirement in FCT aren't fools. Of course they aren't fools; it is normal for lawyers to explore technicalities in language to swing a case in their favour even if the implicit meaning of the language or clause is well understood

They are capitalising on their own computations. This is ridiculous! I'm not surprised, knowing how watery their claim is, they prayed to the tribunal for outright cancellation of the exercise on the ground of the unlawful votes.
