Forfeited $460,000 Was A Civil Matter: Tinubu's Witness, Bamidele Tells Tribunal / Bola Tinubu Forfeited $460,000 To US Govt For Narcotics Trafficking - Paul Ibe / Ondo Election: There Is Gang Up Against Us – APC Spokesman (2) (3) (4)

APC and the likes of Funny Food Kayode and Fraudstus Keyamo might insist that the Drug Baron-in-Chief, Tiefnubu, was NOT indicted for drug trafficking. That may be true but to claim that his forfeiture was a civil case is a lie. The truth of the matter was that Tiefnubu forfeited the amount of $446,000 under a Criminal Statute 18 U.S. Code § 1956 & 1957 and NOT under a Civil Statute. Below are the facts of the case and the findings by the United States District Court, Northern District of Illinois, Eastern Division in 1993:

1. That there was in fact a proceeding in the United States District Court Northern District of Illinois Eastern Division in 1993 in which the United States of America was the Plaintiff and the funds in 10 accounts held by Bola Tinubu and Compass Finance and Investment Co. at First Heritage Bank and Citi Bank International in the United States were the Defendants. 



2. The substance of the application filed by the United States Attorney was an in rem forfeiture case brought pursuant to 22 U.S.C.
Section 881 and 18 U.S.C. Section 981 which provides for the forfeiture of property representing the proceeds of drug trafficking and property involved in money laundering.” 



3. Bola Tinubu defended the said publication through his counsel Patrick S. Coffey and there was a stipulation and compromise
settlement (plea bargain) of claims to the funds held by Heritage Bank and Citi Bank.


4. The United States and the Individual Claimants i.e. Bola Tinubu and others agreed to settle and to compromise (plea bargain) this
action upon terms previously presented to the court. 



5. The court made the following findings “The United States filed a verified complaint for forfeitures against the funds in the above-captioned defendant accounts because there was probable cause to believe that the property represented proceeds of narcotics trafficking or was
property involved in financial transactions in violation of 18 U.S. Code § 1956 & 1957 and therefore was forfeitable to the United States pursuant to 21 U.S.C. Section 881 (a) 6 and 18 U.S.C. 981. The funds in the defendant's accounts were seized initially by seizure warrants.”



6. From the findings of the court, Bola Tinubu has admitted and acknowledged that the funds traced to his account represented
proceeds of narcotics trafficking or property involved in financial transactions in violation of 18 U.S.C. 1956 and 1957 and therefore was forfeitable to the United States pursuant to 21 U.S.C. Section 881 (a) and 18 U.S.C. 981. The funds in the defendant's accounts were seized initially by seizure warrants.



7. Following from (6) above, Bola Tinubu has also admitted that he was involved in laundering proceeds of drug trafficking in the United States of America and the proceeds of such illicit drugs or money laundering in the amount of 460,000 US dollars be forfeited to the United States Government. 



8. Although Bola Tinubu was not charged to court for trafficking in narcotics, he was nonetheless indicted for laundering proceeds of drug trafficking being financial transactions forfeitable to the United States Government. 



9. Bola Tinubu opted for a settlement (plea bargain) so that he would not forfeit the whole money. He would have forfeited the whole money if the matter had gone through a full trial. 




So, it's very disingenuous of Tiefnubu's acolytes and supporters to try to use semantics to try to deceive Nigerians who are NOT legally savvy.

He only want the Court to disqualify tinubu and court should order fresh election. He didn't claim he won the election as stated before he went to court. This case of drug have been tested in the courts doing obasanjo regime tinubu won upon being opposition to the government . Talk less of when is now awaiting gcfr.

Can a government ask anybody to forfeit funds when there is no crime, fraud or illegal funds suspected to be routed through such accounts? The enquiry through the IGP isn't enough. Get a DEA agent to testify before the courts so these matters can be laid to rest.

okupe didn't admit to guilt bt rather claimed he was innocent bt the court proceeded and found him guilty.

if tinubu didn't accept the Forfeiture settlement he was going to jail as he was clearly guilty.
He was guilty and forfeited to avoid jail?,this is a drug case we are talking about and it's very serious in US,Tinubu wasn't arrested,no mugshot or record of his arrest

The forfeiture order was made against the bank account of Bola Tinubu and not the person of Bola Tinubu, claims BAT.

With this, all the boys EFCC are arrested in regards bank fraud can now appeal there cases.

I'm clarifying that a civil forfeiture is different from criminal justice financial obligations. This was why tinubu wasn't charged for any wrong doing..

The money he forfeited isn't his own personal money. IRS traced the money and found it was money from drug proceedings..

Tinubu was an accountant in USA with many clients. Any of his clients might have used his account without telling him the source of the money..

IRS forwarded the case to DEA/FBI, both found tinubu not to be involved in the drug whatever. This was why tinubu was never arrested, no indicted, nor charged!

The case was closed after forfeiting the money and it ends their..

If you buy a stolen phone in USA unknowingly, you'll forfeit it but won't be charged.

Infact, I read a case of a woman that embezzled money to finance her kids wedding. All the clothings they bought with the money were forfeited grin. E no concern USA say them don wear ham before. But that doesn’t mean everyone that wore the cloths the woman bought were charged. They just forfeited and that’s all!
