2. APC has the highest number of votes in the country
3. APC scored at least 25% of votes cast in 29 states (Constitution requires only 25 states including FCT)

PEOPLES' DEMOCRATIC PARTY (PDP)
1. PDP validly nominated a candidate
2. PDP did not score the highest number of votes in the country
3. PDP did not score at least 25% of votes cast in two-third of states in Nigeria including the FCT (PDP only had minimum of 25% in 22 states)

LABOUR PARTY (LP)
1. LP did not validly nominate a candidate (Peter Obi was a member of PDP one week to LP presidential primary election)
2. LP did not score the highest number of votes in the country
3. LP did not score at least 25% of votes cast in two-third of states in Nigeria including the FCT (LP only had minimum of 25% in 16 states, FCT inclusive)

PDP and LP did not fulfil the requirements needed to produce the president of Nigeria in 2023.

For Peter Obi to be made president by the court, he must prove his cases against Asiwaju Bola Tinubu before the Court of Appeal and Supreme Court beyond reasonable doubt. The courts must nullify Tinubu election. after that, Atiku will be made president, Peter Obi will have to perform an abracadabra to remove Atiku too.
