fergie001: I beg to differ sir. On your first issue, where a SC's judgment affects the petition at the tribunal, the court cannot strike out the petitioners petition. That would be tantamount to telling an aggrieved party to go home without being heared. Such action will violate section 6(6) (b) & (c) of the constitution. Every case it's decided based on it's peculiar circumstances. If you had argued that the petitioners on record may be asked to file a fresh petition, to suit the assumed present situation, I would have agreed with you to a reasonable extent. In summary, the outcome of the SC's decision cannot warrant the striking out of the petition, without been heared to the end. On your 2nd issue, there are pre-election matters that can still be brought by a post election suit. E.g, the issue of qualification, which is the subject of the extant appeal at the SC. To throw more light on this, when an issue of qualification is to be brought by way of a pre-election matter, it must be either a party member or an aspirant in the primary election of the said party, that has the locus standi to institute same. Where any other person or political party institutes it, he would be more regarded as a meddlesome interloper. But, a candidate in an election or a political party, can institute an action based on grounds of disqualification, only if the general election has been held and a winner returned. In that case, the petition would be clothed with the requisite jurisdiction. 2 Likes |

garfield1:Yes when it touches on the Constitutional eligibility requirements of the Candidate. The citizenship issues does.... S182. What he meant was that if peradventure Tinubu is disqualified, that Obi can amend his appeal to include the 1st runner-up which is not possible. |

A collective reading into Abdulrauf Abdulkadir Modibbo v. Mustapha Usman, APC v. Aliyu Suleiman Lere; our Courts classified the following issues as Pre-Election. nomination of a candidate double nomination of a candidate disqualification of a candidate wrongful substitution of a successful candidate’s name by INEC complaints about the conduct of primaries false declaration on oath about particulars of a candidate. In all of these, none touches on items in the CFRN. I believe it is clearly a pre-election matter. In a nutshell, Tinubu's false declaration suit as well as Shettima's double nomination are merely academic before the tribunal (to my understanding). 4 Likes |
