hisexcellency34: Interpretation of Supreme Court judgment on Double nomination by Amaechi Ekwe, Esq: 1. Double nomination falls under Non- qualification of a candidate under section 134 (a) of Electoral Act, 2022 and, is also one of the grounds you can challenge an election through Election Petition. 2. Non qualification or double nomination of a candidate can be challenged by a person within the Party that nominated the candidate and also a person who is from another politcal party or another politcal party itself. 3. Double nomination can be challenged before or after Election (if it is before Election, we call it "pre Election matter" and if it after the Election we call it "post Election matter". 4. If you are challenging double nomination or non-qualification of a candidate before the election (Pre Election matter) then, you have to be a member of the politcal party that nominated the candidate you are challenging. An external person cannot challenge it before the election because it is at that time an internal affair of the party that nominated him. 5. But if it is after Election, any other candidate from another politcal party or another politcal party itself can now challenge it through Election Petition under non- qualification. At this time, it is called non- qualification of such candidate. You incorporate it in your Election Petition. That is what LP did. Shettima's non-qualification will still be raised again in the Supreme Court by Peter Obi and Supreme will still have to determine it again in Peter Obi's Petition. Shettima has not gone scot free. The double nomination will still rear its ugly head again. But PDP did not wait for the election to come before they challenged the double nomination, that is why Supreme Court threw their case out because at that time, it was an internal affairs of APC; it did not concern PDP or any other party at that time. No hope for Nigeria. From today's court ruling; in other words, next election (if there will ever be); a party can nominate any candidate who can win elections for it as presidential candidate, governorship candidate, senatorial candidate, HoR candidate, State Assembly election candidate. The candidate wins all the posts for the political party. If anyone who is not from the party complains, the complainant is an interloper, busybody, and stranger to the party therefore has no right to complaint even though he has a lot to lose from the action of multiple candidacy for an aspirant. fuckJones: I do not know what most of you think or understand but for someone like me, I have never relied on the planks of Atiku running for a post concurrently or even the US narcotic case, no. Those are easily discardable. i am not even interested in the technicality of BVAS and all. I am only interested in the interpretation of the relevant section of the law which suddenly confers the status of a state to Abuja in matters of election when there is no such express provision in the law of the land. In its simplest form, the law is that expressio unius est exclusio alterius. If this be case, how can what is not written be read into what is written, I struggle to understand it. Beyond the simple Literal rule of interpretation as known in law, perhaps someone wants to extend it to the mischief rule, I will want to know how both rules of interpretation will suddenly interpret AND to mean anything other than a conjunctive term. How this is interpreted will benefit us as lawyers and law students alike and will improve our legal jurisprudence especially in the area of statutory interpretations. Can a sitting president be removed if his election is voided, Lord Denning did say in his famous dictum in McFoy Vs UAC that...Nihil non exspectanl aedificare stare...You cannot put something on nothing and expect it to stand. So yes, a sitting president can and has been removed even in fledgling democracies like that of the US. Whether the Nigerian justices can do same if they find a gap in the law will yet be seen, Whichever way the argument goes, we all know that law is made by men and interpreted by men for the use of men. It will be better to tell us that on grounds of public policy, they want BAT to continue in power than to stand the law on its head. |
