The problem is, Nigerians don't know the law and how to protect their rights.

There is a process for loan collection as established by the law. There are due diligent steps that must be taken by creditors to recover their loan even before they approach the court. Palmpay infringed on a lot of that guy's rights with their unconstitutional actions. Also, no written agreement overrides a citizens constitutional human rights, absolutely none, it is universally accepted! This is why I say many Nigerian companies are taking advantage of people/ workers with ridiculous actions.

If this was the US, lawyers for don dey blow up this guy phone with calls and texts because this is an easy case!

Very important message there. No law trumps the constitution.

The public funds embezzled by Nigerian politicians annually will amount to hundreds of trillions of naira at least. If not for corruption, Nigeria should be among the richest or upper-income countries in Africa and in the world.

I just wonder what they will do after arresting him. I don't think there's any law that prescribes jail term for a debtor.

There is nothing in fine or ugly print that can trump a citizen's constitutional rights. Lending someone money under the condition that he waives his rights is even illegal. Palmpay must pay. Dey don enter one chance.

But I have read of cases where a powerful and rich man rapes a woman, pays her off and and makes her sign an agreement not to institute legal action in the future

I just thought that something similar may have played out here.

Courts reviews NDA's and it's appropriateness and that is why people like Epstein are having their dark acts exposed. NDAs have very strict terms and if there is no balance of power between the parties, the court will strike it out. What is the state of the victim, age, cognition and was the use of force/ threat used etc. NDAs must be mutual and that is where the balance of power comes into play.

Also, in the US, I know for sure, certain States do not admit NDAs if it related to rape, sexual and domestic abuse. Infact, now, NDAs are illegal in the work place when it has to do with rape or any kind of sexual harassment/ assault case in the US. NDAs do not mean the victims can't report the crime. They can report the crime and allow the justice system take it's course without being primarily involved.

The example you used above is a good ground for the court to terminate the NDA because of the balance of power.

Commercial banks don't offer zero-collateral loans to every Tom, di.ck & harry. Before commercial bank advance u loan sef, the credit risk department go don calculate your rate of default, they would've screened u out at the loan application stage.

If a commercial bank loan goes bad despite doing all their due diligence on the customer and having his collateral documents sitting in the bank's vault, the bank has special recovery unit that goes after debtors legally and not all this false imprisonment wey those loan apps dey do.

Once again, knowing the law is different. NDAs have good intentions like the case of OG Tiger Woods who signed a NDA with his now ex-girlfriend for the duration of when they dated. She willfully signed it, infact, she had her attorney review the terms of the NDA, allowing for days (a very important prerequisite) before signing it in the presence of other witnesses.

Tiger fulfilled all the terms of the relationship agreement. There was no incident of abuse and when Tiger was done with the relationship, he kicked her out and now she is seeking some relief for time wasted, being homeless and now claiming abuse. The court has reviewed the NDA and have now asked her to adhere to the terms of NDA as a private arbitratior will look to resolve the issue. That is how NDAs work. NDAs are not death sentences, they can be reviewed by the courts.

You make a great point, particularly with absconding. I mean, if the creditor is unable to serve notice as part of due diligence as established by the law, then it can become criminal. HOWEVER, for it to become criminal, the creditor must prove that the debtor is absconding because of his unwillingness to pay the loan and that can be very difficult because debtor fit claim other reasons for absconding, not related to the loan. Otherwise, the creditor will get punished by the court because it can't be deemed absconding.

If the video is fake and these guys have used verified logos/ registered brand name for this skit, then Palmpay should sue them because of the damage it has done to one of their product.

The worst one i met was a nigga who refused to pay Aella Credit 70k loan but had funds to buy tear rubber everything. Nigerians are terrible people to do credit business with.

With your BVN, and loan you take would be attached to your data.

When i worked in the bank, before we give you a loan, we would spool a report to know your credit history.

So that report will show all the loans you have collected from every registered financial institution.

Na why i pity people wey dey collect Opay loan, come throway sim card.

They don't know when that bad debt would turn around to bite
