The Court of Appeal sitting in Asaba, Delta State on Monday affirmed the judgment of the Federal High Court, in Warri which held that the Federal Road Safety Commission, FRSC can only operate on federal roads.

A panel of the court in suit No. CA/AS/276/2019: FRSC Vs Darlington Ehikim dismissed the appeal filed by FRSC challenging the judgment of Justice E. Nwite of the Federal High Court, Warri.

The Federal High Court had on January 25, 2019 entered judgement in favour of the Plaintiff, who is a member of the NBA Warri and granted all the reliefs sought, which includes a declaration that the FRSC has no right to operate and/or carry any activity on State and Local governments roads.

The trial court also issued restraining orders against the Commission from operating on roads other than federal highways and also awarded cost of N10m against the FRSC

Plaintiff’s lawyer, Mr. Kunle Edun commended both the trial and appellate court for standing by the proper interpretation of the law.

He said that by virtue of the Court of Appeal judgment, FRSC personnel who are on roads inside cities and towns except Federal highways, have no right to be there, as their operations on such roads which are mainly to extort road users are illegal.

Edun further stated that the Judgment is a re-emphasization of the federal structure of the country because the FRSC being a federal agency should only concern itself with federal roads.

I keep wondering why they're usually on State Roads, sometimes local government roads.

Last month I had to ask one of them...is this a federal road?

He responded that I should mind my business and keep driving that he never flagged me.

This is good news for Nigerian motorists.

Nobody should stop when signalled to do so by those doing illegal job on state roads.

In fact, we should start effecting a citizen's arrest whenever we find them on state roads doing illegal work.

Many Nigerian agencies and institutions don't even understand what they should or shouldn't do.

I remember one yeye soldier who was threatening my neighbour then because one olosho reported my neighbour to him. The girl would leave our entrance open at 3am whenever she goes out to visit her customers. When a neighbour decided to treat her fvckup, she contacted her customer who's a soldier.

Over the phone, the soldier was proudly telling the guy, "I no dey hear I am sorry, sir oh!" The whole drama sounded so funny and annoying at the same time. Those people don't even know they have no right to interfere in civil matters.

Now these are the kind of lawyers I like.

The only problem is police and other state rogue outfits will fill the vacuum.

More extortion windows are opened with this ruling or else it's a beautiful case as it puts the FG and her agents in check.

We will recover our federation back from the rogue central govt .

One more step back to being a federation as agreed upon before Okoro foolishness messed it up for everyone .
