Bennycollins:In a civil forfeiture, the focus is not to prove your guilt or innocence. Rather the focus is to prove that your property should be ceased by the Government. Your property was linked to illegal money one way or the other and therefore should be ceased whether you were guilty of the illegality or not. A criminal forfeiture is punishment for a crime which you were convicted of. In that case, you are the focus and you are named as the defendant in the final case, not your account or property ceased. Tinubu claimed he received money from a friend (family friend to his wife known as Akande). The court didn't go the extra mile to determine if he was part of the drug dealers, since the drug dealers (Akande's two younger brothers) who were earlier prosecuted did not mention his name. He got involved in the case because they traced every penny from the Akande brothers and traced funds to Tinubu's account as well. Tinubu was in Nigeria then and admitted he did receive 8 thousand dollars as gift from senior Akande which he used to buy a car in 1989. Account was frozen and in the process of getting back his account, Tinubu forfeited money according to U.S law on such forfeitures. The court did not go ahead to establish that Tinubu himself was part of the Akande drug ring in America or that he just received gifts from them, hence the sentence was just against the account to cease the property according to U.S law. They ceased just 460 thousand dollars and returned back 1.2 million dollars to him. This was probably a better deal for Tinubu than fighting his case with the Powerful U.S Government to the latter in order to get back all his cash. He may have ended up losing everything with the case still inconclusive for years. |

Mosba: Both Atiku and Obi knows Tinubu won the election squarely but the game plan is they're trying to get Tinubu disqualified and ineligible through this forfeiture case, dual citizenship, Shettima double nomination or degree certificate, hoping that one of these stick. The know they can't prove anything on the ballots that they got more popular votes than Tinubu. In the event that this happens, the rerun would be between the first and second runner-ups who are Atiku and Obi respectively. |

Bennycollins:Well that's how civil forfeitures work in the U.S. You are not guilty of the crime but you received money linked to the crime. That money is taken by Government without a criminal charge filed against you. There are millions of cases like that in the U.S and it's common. 3 Likes |

Reason we should strengthen institutions. If inec was devoid of external manipulations we'll all trust them but not now. Atiku Abubakar problem now is he is not staying on a winning message--hurting his chances for runoff at the election tribunal. Atiku Abubakar can win a runoff election with Bola Tinubu if he stays on one message. The message i want Atiku to stay is Bola Tinubu got 19% in the federal capital, Abuja instead of 25% required in the constitution. He should hammer Bola Tinubu failure to meet the constitutional requirement -- to get the ears of election tribunal judges. Fine of $460,000 over drug issues has been ligated during the election and voters did not buy it. So, my advice to Atiku, leave drug issue alone, and talk about constitutional requirement. The election tribunal is going to rule on whether any candidate on February 25, 2023 meets the constitutional requirement of February 25, 2023 presidential election or not. in my humble opinion no candidate meets the constitutional threshold---meaning no candidate was duly elected. Right now, i am betting on runoff election between the two top votes getters---Bola vs Atiku. |

/ We play too much in this country. There is no imposition of fine without a breach of law. There are many underhand deals (including forfeiture or fines without prison terms) in US. In some cases, some criminals go under Federal Protection programmes or snitch to walk free. But a crime must have been committed first. The fact that a sitting President is directly or indirectly connected to narcotics in US is in itself a valid reason for disqualification. But Nigerians are quick to condone evil for pecuniary reasons until the monster turns around to haunt them. / |

garfield1:Don't confuse yourself. A case happened in 1993 and was well recorded. Then a purported document released in 2003 said there was no such case at any point in time which you people are standing on. Then in 2022 the court papers were published. How you guys want us to accept 2003 'report' as the fact when the publication from the US court on the matter is in public domain is what beats me. Let us even assume that the 2003 report by the FBI or what agency was it, was authentic, don't you know about emerging facts or fresh evidence? It can set a man free from jail or convict a previously discharged and acquitted person. |
