It's really disappointing that some Nigerians are supporting the motion to keep MNK locked up despite court orders ordering his release. Do you guys realise we have 3 independent arms of government? The Executive has been disregarding and disrespecting the judiciary for years, now the senate has joined, yet some of you won't see an issue because of your blind supports for some so-called political parties and strong men that keep ensuring that the country doesn't move forward due to their interests. I am more convinced that this country won't move forward with these current crops of citizens who instead of fighting for strong institutions would rather fight and die for strong individuals (politicians). The past generation and the current one have failed this nation, maybe our children's generation would do better. |

Ever heard of separation of powers within the arms of government? Weathered: Show us any case where the Supreme Court has overruled the decision of the Senate The Senate can always overule the Supreme Court by just Changing or updating the Law .or issuing the FG an order like it has done by telling the FG not to release Kanu The Courts cannot change the decision of the Senate The Senate makes and unmakes Laws The Courts can only interprete them |

Christistruth03:The question you asked does not exist! There's no circumstances where the court will need to overrule the senate as A Court can only overule a court of lower jurisdiction or equal jurisdiction. The senate is not a court. Your question is akin to asking if a football referee can overule a club's training/ practise sessions. However, there are many laws and bylaws made by the senate or National Assembly which the court has rendered inconsistent with the 1999 constitution and rendered conflicting and illegal. I do not think you know that functions of the senate because senate makes laws and act as an oversight to the Executive arm of government. The Judiciary interprets the law and gives order. All laws passed by the senate is subject to judicial interpretation. does the senate make decisions overreaching the judiciary? No! It only makes laws which the judiciary has power to interpret. The constitution is clear and unambiguous; the provisions of the constitution of a country is supreme to any other considerations, opinion. You guys should stop supporting lawlessness, it's Nnamdi Kanu today it can be you tomorrow. Your local Government Chairmen can consider you as a security threat and do whatever he likes with you. |

The Senate can overule the Supreme Court and the Senate can overule the Supreme Court 's Judicial interpretation by updating the Law and the Constitution The Senate are elected representatives of the People The Senate is higher than the Courts It is the Senate that has right to write Laws and amend the Constitution The Senate.snd the Courts are not mates In cases of National Emergency the Courts can even be closed down completely and Martial Law be put in place for the whole Country |

AlexBells: There is no where in the world the last court order can be obeyed. Court can not rule on what is not before it. Jurisdiction was the bone of contention, not illegal extral ordinary rendition of Kanu. The judge, instead of deciding if the court lacks of have the jurisdiction to try Kanu, for which Kanu approached the court, he ruled on the illegal kidnapping of Kanu. But the problem is, Kanu was not challenging his rendition but was contesting the jurisdiction of the court, trying him. Court, can not rule on what is not before it 1 Like 1 Share |
