Good Evening House 🌝 I just arrived in the UK last week with an EUSS family permit and I learnt from someone that my 6 months have just began to count the moment I arrived. I don't know how true it is yet So I need enlightenments as the person who was supposed to put me through, I can't reach him since I arrived here and I can't just sit idle. 1. Can I apply for jobs now? 2. What should I do or apply for first ( I was thinking of NIN) I don't know if that's the first thing I should do? I just need someone with a general knowledge of this EUSS thing that will just guide me through. Thank you 🙏🏾 |

Goodday Sirs/Mas, please is there any update that full time student and dependent have to pay council tax because a friend of mine have been having issues on this with Croydon Council oo, I have checked everywhere and I can’t find anywhere it says student is entitled to 25% while dependent will pay full. Please advise me oo as I have been telling them to ignore any threat mails they send to them. Thanks in advance. 1 Like |

Re: Living In The Uk-life Of An Immigrant (part 3) by Zahra29: 3:03pm On Aug 01, 2023 |
AgentXxx: According to gov UK: Discounts for full-time students Households where everyone’s a full-time student do not have to pay Council Tax. If you do get a bill, you can apply for an exemption. To count as a full-time student, your course must: last at least 1 year involve at least 21 hours study per week If you study for a qualification up to A level and you’re under 20, your course must: last at least 3 months involve at least 12 hours study per week You’ll get a Council Tax bill if there’s someone in your household who’s not a full-time student, but your household might still qualify for a discount. So they have to pay council tax, but should apply for a discount from the council on the basis of the student being disregarded/exempt. They have to apply for the discount though - it's not automatic. In any case they definitely should not ignore letters from the council because the council has the power to take enforcement action to recover the debt, which could result in a court summons, bailiffs or even a prison sentence. Croydon council is bankrupt and will not joke with its money. It recently hiked up its council tax by a substantial amount even though there are many struggling households in its borough. Edited to add - bear in mind they will also be liable for the tax arrears that has accumulated. They should engage asap with the council to try to agree a payment plan. 2 Likes |

Good day everyone. I arrived June and I'm on dependent visa. Do I have to do NI? I saw one NI number on my BRP |

Please look at this evidence from their Croydon’s website in the picture attached. “A non British spouse of a full time student whose visa restricts work or claiming benefits”. How do we explain that @justwise Zahra29: 1 Like

AgentXxx: No worries.. I just did some more digging around and it seems the official guidance is a bit nuanced when it comes to non-british spouse dependents of students. Here it allows such dependents to be exempt from council tax if they are prevented by the terms of their leave to enter or remain in the UK from working or claiming benefits. The "or" is confusing as it implies that the dependent can claim an exemption if they are not entitled to benefits (which would apply to almost all dependents). However the practical application seems to suggest that most councils treat it as an "and" clause i.e. a dependent is exempt if they are not allowed to work, and also cannot claim benefits. it's worth highlighting this clause to the council to see what their response/interpretation is. 3 Likes |

davide470: Please, i am confused here. Do you mean that when the MA is schooling while the dependant gets a job with COS and intends to be the MA for ILR, ILR start counting from when the dependant (new MA for ILR) starts working or when the former MA (new dependant for ILR) gets a job with COS? |
Re: Living In The Uk-life Of An Immigrant (part 3) by Zahra29: 3:47pm On Aug 01, 2023 |
AgentXxx: This clause is worded in a confusing way and open to interpretation by councils. Some seem to take the view that any foreign spouse dependent is exempt as long as they are not entitled to benefits. Others want to see a copy of their passport, which shows a stamp stating that they are prevented by immigration regulations to work or claim benefits in the UK. So if their BRP shows that they are not entitled to work and also cannot take up benefits, then they have no means to pay and are disregarded. I suggest they complete the exemption form from Croydon and provide the supporting evidence and see what they say |
Re: Living In The Uk-life Of An Immigrant (part 3) by AgentXxx(m): 3:53pm On Aug 01, 2023 |
They did that in the past but the council still maintains that only the student spouse is entitled to 25% even when it’s clearly stated on the dependent’s Brp that restricted work and no claim to public funds. This is really the first time am hearing of a council being stubborn about this, the bankruptcy has probably gone into their head and just want to get money anyway. With the evidence from their site and brp supporting no claim to public funds and restricted work, won’t they win the council if they eventually get charged to courts, Tbh, I wouldn’t want them to pay any dime because it’s so clear they shouldn’t be paying based on what is clear on their website. Modified: They reached out to citizen’s advice and they also said they are not meant to pay. Zahra29: 2 Likes |

AgentXxx: They are not meant to pay shishi. A full-time student and non British partner dependent. This is clear on every council's website. When they disturbed me in my own council that year I quoted their site in my mail and we were exempted. In this UK study to show yourself approved on every matter or else pounds go just dey show you shege 4 Likes |

Zahra29: Absolutely, the discount is to be made by the Council. Some Councils can give a total exemption, others a discount, and a few may stubbornly insist on collecting their money if there is an adult dependant occupant. |

Re: Living In The Uk-life Of An Immigrant (part 3) by Zahra29: 4:45pm On Aug 01, 2023 |
AgentXxx: Lol, a broke council is an angry one. Has the council given an explanation for why the dependent is not exempt? Your friends could sit tight, since they're in the right, and see how far the council takes it. Worst case they might receive a court summons and have solid grounds to win against the council. Chances are the council will cave once their legal team gets involved. Or, depending on their risk appetite, they could pay and then claim it back from the council. |
