Therr Judge said that certificate forgery is a criminal offense that has to be proven beyond reasonable doubt.

And there's reasonable doubt already established.

You should know where he is going with this.

This is not a criminal case. The supreme court here cannot impose criminal penalties like jail terms on offenders.
The beyond reasonable doubt standard does not hold.
The standard is what would a "reasonable man think"
Or "preponderance of evidence"

The problem is that the judge himself has raised the issue of reasonable doubt

Isn't it Tinubu's lawyer that's supposed to be raising this? This clearly shows bias on the part of the judge. I thought he was supposed to be making judgement based on arguments .... not raising arguments. Thus judge needs to be removed from this case if the Supreme Court is to continue being the bastion of justice

I remember many US democrats trying to bend and stretch the law as much as possible to get Trump, arguing that it is justified because Trump is a "bad man" and "illegitimate president".

They generally argued that Trump is not above the law but they had to be reminded that he is certainly not below the law either.

Opponents of BAT should remember that too. True justice is a two-way street.

There’s one letter and one deposition under oath. As a judge, Principle of Orality’ in Litigation must be appreciated.

A deposition under oath is not a letter, infact it gives clearer view to anyone's sworn statement, which the Judge is trying to create technicality for.

If your written statement is yes and during cross examination your yes turns no, then you're not saying the truth.

When you remember this is Nigeria and not Netflix then you will understand this statement from a judge.

We know justice okoro's antecedents, he should go on to approve certificate forgery. Nigerians will remember him for that.

Don't mind them my brother. All these Judges need to be schooled. They should strike out the case let the whole world know how corrupt the Judicial system in Nigeria is.

Shameless people!

It simply means not everyone is crazy like the Obidients and the Mikano boys.
This is an abuse of the court process, case should be thrown out.

Now The Supreme Court of Nigeria is going to discard evidences before it and to make it's own decisions but rely on a letter from CSU. grin

What a Supreme Court!

He's told you that you need to prove beyond reasonable doubt. That's what to expect.

Once there are conflicting letters/reports, it's a recipe for throwing out the suit.

Fraud or forgery is a criminal matter and must be proven beyond any reasonable doubts. 1+1 must be 2 and not 11. As it is said in criminal cases, it is better to free an accused than convict an innocent.

If for example, CSU was cross-examined then it could have slightly made some difference, nonetheless in the face of conflicting certificates, it's already otilo.

That's exactly what happened in the LP-Mbah case.

Witnesses do lie in different ways. Any unscrupulous entity can write a letter of exoneration. That's why the only evidence admissible for interpretation is the one under oath made under threat of perjury.

You arrived late.

SC already pronounced that forgery is criminal in nature and must be proven beyond reasonable doubt in election petition cases though SC did not comment on the part where the "proven criminal" walks out free from court and goes on to contest another election grin grin

Very clear that whoever posted this is an operative of the PDP or LP. But, you know what, you have failed very publicly.

CSU’s depositions were clear beyond any doubt:

1. Tinubu graduated from CSU
2. The diploma he presented resembled replacements issued to others at around the same time

Even a school-boy judge would know that DEPOSITION UNDER OATH carries more weight than any letter that may have emanated from anywhere.

It’s clear you’re masturbating on this matter, thinking that because the name OKORO has links with the SadEast and BIAFRA, you can lean on the judge to do the evil that you so desperately wish for!

May God punish you and your entire co-conspirators.

You may think that Justice Okoro will dovetail to the BIAFRA agenda and do something that favours you CHILDREN OF HATE but even if he does, he can only issue a minority judgement - that’s the best case scenario for Atiku and his co-conspirators from BIAFRA land.

Shame on you for even trying to raise this nonsense!!!

Unfortunately for you, the law uses the thinking of a reasonable man in non criminal cases.
Election petition is a non criminal case
Anybody bringing up "beyond reasonable doubt standard" is misleading himself.

Let me educate you.

The issue you raised was never part of the initial petitions. It came up after a search so it becomes part of new issues Atiku want the Court to consider.

Supreme Court is not a Trial Court. It's a Court of Policy.
