Once there are conflicting letters/reports, it's a recipe for throwing out the suit.

Fraud or forgery is a criminal matter and must be proven beyond any reasonable doubts. 1+1 must be 2 and not 11. As it is said in criminal cases, it is better to free an accused than convict an innocent.

If for example, CSU was cross-examined then it could have slightly made some difference, nonetheless in the face of conflicting certificates, it's already otilo.

That's exactly what happened in the LP-Mbah case.
The difference here is there are no conflicting certificates. Jamal Orr wrote a letter saying Tinubu graduated. But that's not the bone of contention is it?

Election petition is a non criminal case
Anybody bringing up "beyond reasonable doubt standard" is misleading himself.

Is forgery a civil case?
Can the Supreme Court rule on a forgery case that is just surfacing at the last appeal level?
Is the Supreme Court the court of first instance?

Chicago State University registrar, Carl Westberg stated under the penalty of perjury that (1) Bola Tinubu graduated from the school, (2) Bola Tinubu never picked up his certificate since he graduated from the school and (3) that any certificate found with Bola Tinubu was forged because the school does not issue certified certificate. So, to answer justice John Inyang Okoro questions, i would send a letter to Chicago State University, along with a certificate that Bola Tinubu submitted to INEC to make the declaration themselves as whether Bola certificate submitted to INEC comes from the Chicago State University.

Anything short of Chicago State University declaring that the certificate submitted by Bola Tinubu to INEC is from the institution will be unfair to both Bola Tinubu and Atiku Abubakar.

So, I plead with Nigeria Supreme Court to send to Chicago State University a Certificate submitted to INEC by Bola Tinubu to determine its authenticity. That is the best way to solve this problem.

Hearsay is if you say Mr X told you he saw something.
If you bring Mr X written and properly notarized testimony to the court of judgement. It is not hearsay.

Of course we know where it is going..

But there is no doubt anywhere talkless of reasonable doubt!...

There is a clear distinction between "attended CSU" and "submitted a forged certificate to INEC..."

Except the Supreme Court is telling us that the letter from CSU authoritatively declares that "Tinubu did not forge the certificate he SUBMITTED TO INEC"

I imagine the letter from CSU only states that Tinubu attended their school.

The truth is that all those things Atiku placed before the Court, they will not touch it. They won't even open it @ all.

In as much as I understood that the ruling of judges is beyond parochial sentiment and interest, I think Justice Okoro just put himself and other judges over there in a tight corner by his statement "which one do we use". If the document lacks merit completely, what he would have done was to dismiss it, but in this case, he is in confusion as there are two conflicting papers like he said. Now, if a document was submitted to the electoral body (INEC), then that document remains a legal tender or exhibit for or against who submitted it. Simply put, Tinubu's document that was submitted to INEC was discredited by Chicago State University and should be an exhibit against him.

A deposition under oath is not a letter, infact it gives clearer view to anyone's sworn statement, which the Judge is trying to create technicality for.

If your written statement is yes and during cross examination your yes turns no, then you're not saying the truth.

When you remember this is Nigeria and not Netflix then you will understand this statement from a judge.

We know justice okoro's antecedents, he should go on to approve certificate forgery. Nigerians will remember him for that.



The Justice left the documents and the deposition, and started talking about Letters.

But election petition is a civil case. So civil standards rule.



The supreme court has accepted evidence at terminal stages in both criminal and civil (eg land) cases.

Speaking at the hearing on Monday, Justice Okoro said criminal matters have to be proved beyond reasonable doubt.

“But in this case, there are two conflicting letters from the CSU – one authenticating the president’s certificate and another discrediting it. Which do we rely on?,” he asked.



This statement will give you a clue as to what the judgement is going to look like.

Thrown out? .... why? Not anyone's fan .... but I think Atiku has a very tight case ... he is very specific ... and the law on that is also very specific... there are no loop holes nor room for dancing around the law. The court needs to do the right thing and remove Tinubu and not set a precedent.

Forgery in this case is not a criminal case because its election petition which is a civil case. Proving beyond reasonable doubt is not necessary in civil case. The Supreme Court is trying to hide under technicality

There no way he is going to prove certificate forgery against Tinubu.
I don't know what evidence you are relying on but if it was the judgement in Chicago then there's no case.

Without proving at the high court that there was truly a forgery, the SC Justices will not touch those documents tendered by Atiku's lawyers... Same thing the Tribunal did with Obi/LP's buckets of evidences...

You people don't understand something, deposition was made on the stand that he attended their university. So you can't say someone forge certificate when he actually attended the university.. abeg make una rest
