Strange that some people clamouring for a new Nigeria seems to forget that one of the basis for this is a justice system that treats everyone fairly and judges by the rule of law - not based on whether you like someone's face or not. I think a good number of my fellow Nigerians are either big fools or actually Zombies,how can a sane man rejoice over supreme court proceedings when a dollar is now over N1300,the food is gradually exceeding the purchasing power of most Nigerians,unemployment and insecurity,poor power supply,bad or no motorable roads etc. I have concluded that most Nigerians are psychiatric patients and not rational human beings. The Supreme court has shed more light on the quoted section of the 1999 constitution. The Supreme Court as ruling in Chief Gani Fawehinmi vs. Inspector General of Police (2002) 23 WRN 1 “That a person protected under section 308 of the 1999 Constitution, going by its provisions, can be investigated by the police for an alleged crime or offence is, in my view, beyond dispute. To hold otherwise is to create a monstrous situation whose manifestation may not be fully appreciated until illustrated… The evidence may be useful for impeachment purposes if the House of Assembly may have need of it. It may no doubt be used for prosecution of the said incumbent Governor after he has left office. But to do nothing under the pretext that a Governor cannot be investigated is a disservice to the society.” I hope you have learnt something new. Please feel free to counter it but avoid the use of derogatory words so that i can respond. And mind you, looking away from this i hope you undestand that the legal immunity of a sitting president typically applies within the borders of their own country and does not extend to immunity from prosecution in foreign jurisdictions. International law generally does not grant immunity to heads of state from prosecution by other countries' legal systems. So even if the Nigeria courts refuse to start any process, Atiku can take his battle outside Nigeria as he is currently doing anyways. |

Just want to put a question out here for any right-thinking Judge amongst them to answer: "If a relation of yours was maimed by a person and there were no evidence worthy enough to put him/her in jail, he/she was discharged and acquitted; after maybe some years when the case has been closed, an evidence clearly showing how the crime was committed, would you accept the initial ruling on the case or would you seek for justice to be served?" DO NOT LET ANYONE STOP YOU FROM REASONING CRITICALLY! |
