Greetings,

I'd appreciate your insights on the following matter:

If someone has already received approval for their National Interest Waiver (NIW), would it be deemed inappropriate or classified as visa fraud if that individual pursues a Ph.D. in the USA and applies for a student visa? It's worth noting that, during the NIW petition, the person initially submitted a Ph.D. as part of his exhibit; but now wishes to pursue a Ph.D. in a related yet distinct field.

Him and his family will still undergo consular processing but he his afraid that going ahead with this plan may cause some complication.Please your sincere opinion/advise is needed.

Hello guys. My EB2-NIW got approved recently within 75 days. My questions are: (1) what is the next step?(though accompany message says I should wait for 30 days for the department to contact NVC) and (2) How long from now (an estimate) can I wait to get the immigrant visa approved?
Note: I'm applying from Nigeria.

You can use Chen. They usually work best for people with articles and reasonable citations. I used Chen and got approval in 101 days without RFE. Remember, approval is case dependent.

It cost me around 40k at Q-life, but cost depends on the number and type of vaccines you take.

Thanks. I actually found someone on family group that paid 28k for vaccination. Guess the prices vary based on shots given.

Yes it does. I had to get most of the shots again, is probably why it was more expensive.

Congratulations on the NIW approval! That is a huge deal and the toughest hurdle to cross. If you did not do concurrent filing, why not just wait till you finish the green card process and then apply for the PhD. You are almost at the end of your journey.You can defer the PHD. In my opinion its best to avoid overexplanation, and complicating matters. Keep things simply and wait till you get your green card, then can pursue 10 different phDs if needed.

You can do anything you want after you get your green card.
You don't need a student visa with a green card

Thank you for your response. Did you do WES evaluation of your credentials for Equivalency? If yes, is it CxC or DxD?

I read on their website (Chen) that they'll write the letters of recommendation for you; did they actually keep to that promise? How many letters did you submit?

I use WES for my evaluation; I do not know what you mean by CxC or DxD. Chen will write the recommendation letter; recommendation letter number is dependent on how solid your case is; I suggest you contact them, let them confirm they will take your case and you can proceed to ask them ANY questions that you want. CR1/IR1 categories in Lagos has been receiving steady IL. They even sent out IL to them today, even though today is Thanksgiving holiday in the US. Even the EB categories they sent IL since Sept 1, they are yet to have the interview.

Is this an intentional way of slowing down the EB visa processes. Guess they will send next batch of EB IL after those with ID have had their interviews. Till then, we just keep speculating while we keep our minds distracted with other things.

grin grin grin sometimes the best thing to do in the face of ridiculous situation is to laugh it off. For those heading out ahead of us, two things study the politics of the new country you are relocating to : educate your ignorance on finance and politics (whatever you do, don't vote or register to vote till you are a citizen else na one nyash you don enter for future naturalisation smiley for some weird reason this is on my mind to remind the house all day today.
