Kano is less harder to me than Plateau. If the Supreme Court goes against the Appeal Court, all the lawmakers who were earlier sacked will revolt. The only way PDP will fight back is because the Appeal Court dwelt only on the qualifications issue. That is to say it conceded that PDP won the election but for the qualifications issue. So once the PDP wins Ground 1 which is this, then it's all over.

For Kano, it is the party that determines her members and sponsors them. It is not the business or responsibility for anybody who is not a member to begin the probe of membership of another. It is the NWC that determines that.

Again, like I have said continuously; this path been taken by the Court of Appeal is not in consonance with precedents.

This Plateau Congress was accepted by PDP members. After the repeated Congress, no PDP member went to Court again on it, so why will another Party, a meddlesome interloper, a busybody, a hired mourner paid to cry more than the bereaved begin to pry their eyes into the personal and domestic affairs of another Political Party. This is wrong on all fronts.

For Kano.. even though, the lawyers for Abba messed up their case at the tribunal, what is the business of an APC Candidate on the membership of an NNPP Candidate? The Party is registered by law as a body corporate to carry out its activities as our laws demand.

In the case of a former lawmaker in your State House of Assembly who is now Deputy-Governor, Peter Odey, who resigned as a PDP member whilst been Majority Leader of the CRSHA. He told the Court he didn't defect to the APC and remained a member of the PDP and didn't resign. However, Justice Taiwo held that the lawmaker announced it himself before the sitting of the House and hence cannot prevaricate before the Court. The Court sacked him and others as lawmakers. However the same Odey Agbe Peter appealed the judgement telling the Appeal Court that he remained a bonafide member of the PDP and his name is in the register of the PDP.

At the tribunal and now Appeal Court, the PDP has continued to argue that Odey cannot belong to two parties at the same time. The Tribunal and Appeal Court held that it is non-justiciable. They held that the PDP had no business to dabble into who is a member of the APC and who is not, infact they fines the PDP for instituting the suit.

Lastly is the case between Tarfarya Asarya of the APC and PDP's Midala Balami in a Federal Constituency in Borno State. Balami of the PDP won.

The APC approached the tribunal to challenge the fact that the Supreme Court nullified the Primary that brought up Balami and ordered a fresh Primary be held within 14 days. However, the PDP conducted this same Primary well after 15 days. They stretch on the fact that the PDP disobeyed a Supreme Court order.

The tribunal affirmed the PDP Candidate and held that the issue surrounded pre-election matters and the tribunal had no jurisdiction. APC went to the Appeal Court as expected.

On Oct 20, 2023; the panel led by Nwosu-Iheme JCA held that the Court had no jurisdiction.

She held that Section 285(1) of the 1999 constitution, the tribunal had jurisdiction only to determine the validity of an election.

She averred that the scope of the tribunal’s jurisdiction cannot be expanded to include the determination of the validity or conduct of primary election or nomination of candidates by political parties.

This Judgement is not new as we saw in Akinlade v. Dapo Abiodun where the Court per Ejembi Eko JSC (as he then was), made strict judgements towards that.

The Court narrowed down where the qualification criteria might come in but who proves who is a member of the political Party?

In Jegede v Akeredolu, the Supreme Court was clear that APC made Buni their Chairman despite Article 17 of the APC Constitution so it's a Party affair. The Court has no jurisdiction on that.

The second respondent (APC) allowed him (Buni) to be its Chairman in the interim in spite of Article 17 of its constitution.

The vires of this decision of the party is non-justiciable. This appeal fails and it is hereby dismissed per Agim JSC

Just finished reading,the judgment was well written and unassailable.like I told you,pdp failed to obey the justice gyang order.even latest records at the appeal court is a disaster for pdp
