There are indications that Rivers State Governor Siminalayi Fubara may have breached the number one item in the resolution recently reached in Abuja as part of efforts to find a lasting solution to the ongoing faceoff between the governor and the minister of the Federal Capital Territory (FCT), Nyesom Wike.

Part of the resolution directed Fubara and his team to withdraw all court cases instituted against the Rivers State House of Assembly.

However, at the resumed hearing of the suit brought by the Governor against House before a State High Court sitting at Isiokpo, yesterday, Fubara’s counsel, D.O. Okoro, SAN, told the court that he does not have any instruction from his client to withdraw the matter.

Okoro was responding to an information brought before the court presided over by Justice O. Ben-Whyte by the counsel to the House of Assembly, Chief Ferdinand Orbih, SAN.

Orbih had informed the court that that he had the instruction of his clients to withdraw the matter from court as a result of the development arising from the agreement of the parties in this suit.

The court, after hearing from the duo, directed Fubara’s counsel to confer with his client with respect to the recent development as submitted by the defence counsel.

The case was adjourned to January 31, 2024 for report of settlement.

SIM should not until supreme court pass tribunal judgement 20th January, him doing so automatically means his already approved budget is illegal,in a situation his election nullify for new election Wike faction (speaker) will takeover to conduct election that won't favour him.

The governor was ambushed in that meeting hence two things are very much expected, he may be decamping to APC in a matter of months and continue slaving for his emperor or he will be impeached. Nothing can save him.

If he has not signed that document he would have been killed. David Briggs interview was eye opening.

The action of Governor Siminalayi Fubara not to withdraw the suit against Rt. Hon. Martins Amaehwule and his 25 friends before the Rivers State High Court today, and the subsequent adjournment of the suit till January 31, 2024 by the Hon. Justice Ben Whyte, already explains that the Governor will not take any step to erase the trust placed on him by the people of Rivers state.

Irrespective, it is my informed belief that the Governor will pursue the path of peace but such peace will not be at the expense of Rivers people who he swore to serve.

25 former members of Rivers State House of Assembly loyal to former Governor Nyesom Wike withdraws their 'impeachment' proceedings against Governor Siminalayi Fubara.

Their counsel Ferdinand Orbih SAN also withdrew their case filed by Governor Siminalayi Fubara against these former Assembly members against the impeachment.

Governor Fubara counsel told the Court that he was not given any instruction to withdraw the suit filed by the Governor. Case adjourned to January 31.

The fact of the matter is that the ship has already sailed! I will break it down!

1. The Rivers State High Court has already stopped the so-called impeachment plot by Martins Amaehwule House in November 2023.

2. The Rivers State High Court has already affirmed Rt. Hon. Edison Ehie as the Speaker of the Rivers State House of Assembly.

3. The former Speaker Hon. Martins Amaehwule and his 24 friends already ceased to be members of Rivers State House of Assembly following their defection to the APC, the declaration of the vacancy of their seats by Rt. Hon. Edison Ehie, the Speaker of the House of Assembly, and the notice communicated to INEC by the Speaker on the vacant 25 seats. Their sitting and resolution is no known to law.

4. Governor Fubara and the House of Assembly are already and smoothly running the state as per the 1999 constitution provided.

5. Rivers People, the Constitution and the law are already in favor of Governor Siminalayi Fubara and Rt. Hon. Ehie led House of Assembly.

6. While sympathizing with the Amaehwule and his friends, I enjoin them to lobby their new party for renomination at the pending Byeelection in their respective constituencies.

7. The ship has already sailed. Everyone have moved on!

Sure.

The agreement does not mention the party status of the decamped lawmakers. Infact one of them said today that they will not return to PDP. On its part, PDP has told them to get ready to contest the bye election on any other party platform of their choice.
As it stands, they are no longer legislators, going by the constitution. How will that be resolved? Or are we getting more into a lawless state?

Rivers state may be another test case of our courts and constitution. We should know if we have finally arrived at the level of total disregard for our constitution and setting aside the decisions of the courts, by the tap of the finger.

Which is troubling. Does the governor truly want peace as he keeps saying? If so, then he should match his words with action.

He should know that he was not in the negotiation with amateur politicians. He should not try to punch above his weight.
