Can a speaker or any other person for that matter refuse to obey a court order?

Everyone knows Appeal court has bleeped Up, but that is where the cases of the legislators end. He should not start another problem, 2027 will right all the wrong.

It cannot end there

Something has to be done to undo the miscarriage of justice perpetuated by the appeals court justices.

His fear is that he may be removed by the 16 APC members. Otherwise, a Speaker of a State House of Assembly should know that even if a drunk judge gives a ruling, it's binding until vacated by a higher court.

It doesn't play like that on the Plateau. The APC law makers(Monica boys) are also our brothers and they know what not to try. They are already been seen as traitors who caused pain to the people and they won't want to reinforce that at this critical time.

It has. See S. 246 (3) of the 1999 Constitution (as amended).

The decision of the Court of Appeal is final in respect of such matters.

The earlier judgment can be reviewed by the Appeal Court. Let them apply for a review of the cases.

The supreme court has said the judgment of the appeal court is incorrect so i belive the speaker is right for not recognising the apc lawmakers for now
The judgement given by the Supreme court is on the gubernatorial election and is not related to that of the lawmakers.

We can all talk till tomorrow about the flaw of Appeal Court but no matter the discrepancies, they have sealed the faith of those lawmakers.

The Speaker is just trying to be smart by half though I understand his fears.

Lol 🤣🤣🤣🤣
Prison don dey hungry dis illiterate speaker so.

Tinubu is the president not Buhari. He's a core politician who protects his party's members. That's obvious in the way he sided with the 27 APC lawmakers in Rivers even against court orders, let alone when the court judgement is in their favour. Lol 🤣🤣🤣

That ypp mugu should be advised accordingly before he's strip naked.

As for the other ignoramus members of nairaland exposing their ignorance here, there's no review anywhere. All assembly matters both state and national ends at the appeal court. The supreme court lacks jurisdiction to even hear it at all.

The speaker has a choice to either leave there peacefully or be disgraced out of the seat. He may even be suspended sine die by the new speaker if he's not careful.

Finally, it's a painful and unfair judgement by the appeal court but there's nothing anybody can do about it. It remains binding as unjust and painful as it is.

Why wait till 2027 ? Robbery is robbery. If they judiciary thinks they are mad ,the legislature should show them they are useless too .

Some of your points are valid but I found one there laughable. In paragraph 5, you claimed the speaker can be suspended sine die by the new speaker. Please who is this new speaker? Remember these 16 lawmakers cannot function except they are inaugurated by the clerk and it is when they function, they can choose speaker among themselves and then do what you claimed there.
They need doing their home work very well so that the house clerk can inaugurate them into the house and make them to function as lawmakers, else they can do but nothing.

Meanwhile, the 16 lawmakers ousted can apply for review of the cases and address it to the appeal court president. They need not apply to the supreme court because legislative election ends at the appeal court. Where justice is the focal point, I think something need to be done about it. If they advanced the same prayer on their appeal but the judges looked other way, it would make their argument for review tenable and sensible.

You wonder the kind of foolish people we elect into power. The pronouncement of the Supreme Court on the governorship election is unfortunately not binding on the earlier pronouncement of the lower court on the lawmakers elections. It's really unfortunate that the Appeal court decided to tow the path of shame. Mr speaker should just rest before he starts doing illegal things.

Don't be emotional; nothing else can be done. The judges can later be sanctioned but that is the highest that can be done. The pronouncement can no longer be reversed or appealed based on the law. I think a constitutional review is needed to forestall this kind of unfortunate event from repeating itself.

You answered your question yourself. He can't stop their inauguration. They'll eventually get inaugurated and deal with the ypp speaker later. He should have sense.

By the way appeal court doesn't review judgement. Even the supreme court that does, is very rare and very difficult to do.

They'll soon file form 48 and 49 against him. The court will summon him to come and show course why he should not be sent to prison.

What I want you to know is, the house can rock the bolt against them by not allowing the clerk to inaugurate them for months while the lawmakers concerned/ousted filed frivolous case in the court. But as a person, I am of the opinion that the ousted lawmakers should file for a review at the appeal court and direct same to the president of the appeal court. The judges that delivered the judgements erred in law because there are several supreme court precedence they should have followed but they just went to manufactured their own law and robbed it on the legitimately voted lawmakers.
