South Africa's genocide case against Israel may have ruffled feathers in the capitals of vital Western trading partners, but it has boosted the country's standing as a champion of the downtrodden Global South.

That gamble is likely to pay off, thanks to renewed rivalry for Africa's minerals and U.N. votes between the West, China and Russia, turbocharged by Russia's war on Ukraine.

The International Court of Justice (ICJ) rejected Israel's petition to throw out the case on Friday, telling it to prevent its troops committing genocide against Palestinians, although it stopped short of ordering the ceasefire South Africa demanded.

It did not decide the merits of the genocide allegations, which could take years.

"It was reasonably damning," said Susan Booysen, Director of Research at the Mapungubwe Institute for Strategic Reflection.

"It was quite unambiguous ... in highlighting the abuses ... so I think it gives them (South Africa) quite a bit of esteem as an international spokesperson for human rights," she added.

And while Israel's allies in Washington, Brussels and London might grumble, they can scarcely afford to alienate Africa's industrial and diplomatic heavyweight - especially with the United States' main superpower rival, China, wooing the continent with money, railways and tech transfers.

"If you're going to start punishing South Africa for going to the International Court of Justice, then you're going to have to start punishing a lot of other African countries (for supporting the Palestinians)," Steven Friedman, director of South Africa's Centre for the Study of Democracy, said. "If you do that, then you might as well send (Chinese President) Xi Jinping a letter saying 'You've won'."

Underscoring the point, on a visit to Angola on Thursday, U.S. Secretary of State Antony Blinken said of South Africa's ICJ case, "whether or not we have a disagreement, one particular matter doesn't take away from the important work that we're doing together in so many other areas."

'POINT OF PRIDE'

The Gaza war has displaced some 1.9 million Palestinians, killed at least 26,000, according to Gaza officials, and inspired global outrage. But in a world so bitterly divided over the issue, moral backing from the World Court goes a long way.

"The ICJ didn't give South Africa all it wanted, but this ruling is a resounding vindication of Pretoria's decision to bring the case, and a powerful indictment of Israeli policy," Human Rights lawyer Reed Brody said.

South Africa projects itself as critic of a world order it sees as mainly serving the interests of the United States and its rich-country allies, who promote international norms they enforce on foes but often not on friends nor even on themselves.

During the COVID-19 pandemic, it was South Africa's President Cyril Ramaphosa who denounced the rich world for hogging all the vaccines, noted Chris Ogunmodede, analyst and editor of World Politics Review.

South Africa was instrumental in marketing BRICS - the forum led by Brazil, Russia, India, China and itself - as an alternative to Western hegemony, with 40 nations queuing to join last year.

"(The ICJ case) is ... another indication of the important place South Africa seeks to occupy as (one of) the continent's leading voices on global affairs," Ogunmodede said.

South African officials often compare their erstwhile struggle against white minority rule to the Palestinian cause - a comparison Israel strongly disputes.


That they take no such unequivocal moral stance on Russia has raised eyebrows. Last year, the government unsuccessfully sought a waiver from its obligation to arrest President Vladimir Putin for alleged war crimes in Ukraine so he could attend a BRICS summit.

"(An) elementary principle of morality is that it canโ€™t be selective. South Africa did not do right by the Ukrainian people," author and columnist Ferial Haffajee wrote in the national Daily Maverick this month, but she praised South Africa for picking a first-rate legal team to fight the ICJ case.

South Africans are proud of the strong rule of law that emerged from their anti-apartheid struggle, which often resolves rancorous domestic political disputes.
"Seeing their judges on the bench of the ICJ wearing South African scarves is like watching the Springboks (national rugby team) win the world cup," Chris Vandome, a senior southern Africa researcher at Chatham House, said.

"It's a point of pride."

I don't understand. South Africa went to the Icj, accused Israel of doing a genocide but their case got binned with the judge agreeing that Hamas killed Israeli people on October 7 and the Icj couldn't make Israel stop fighting, or call for ceasefire, only said Israel should try to avoid civilian casualties.

So basically, South Africa was faffing about in the Icj, while Israel is still chasing Hamas lot in Gaza, Khan yunis while Hamas Supporters are blubbing on the media. Haha

Their jurisdiction extends to Southafrica, to the point that the ICC almost got Putin arrested in Southafrica last summer. Who would have carried out the arrest? Southafrica. So, they advised Putin not to come.

SA is stuck in the 1970's worldview. It's foreign policy is a mish mash of contradictory affairs. Instead of leading Africa it stands alone with no one following.

SA foreign policy is still mirred in the cold War and it centres around its gratitude to Russia during the fight against apartheid. Very much like Zimbabwe. Strangely, it ignores all the " front line" African states that helped it fight the same war. Nigeria was also heavily supported by Russia during its civil war but Nigeria has maintained its non aligned reciprocity based foreign policy making it a centre of competition between East and west rather than a vassal state of the Russia-Cuba - Venezuala triangle.

Apart from theatrics what follows? Does Russia have the technology SA needs to keep growing? Does it have agricultural know how? What is the global distribution of SA diaspora? Does it have more citizens living in Russia than live in the West?

In my opinion and as an outsider with an opinion and no vote, I believe the ANC has passed its sell by date. It is fascinated by the strong man theory of Russia and China. It has no new ideas and has been marginalised outside of the SADC zone. It is unwelcoming to African businesses though it wants to dominate other countries. If you track the retreat of shoprite from several countries and the fines laid upon its MTN flagship in different places where it does business, you get a sense that there is a kick back against country which is still learning what it means to be a truly African.

Yes it has gleaming buildings, roads, electricity and all but Rome was also a giant in its day before it fell. SA implosion is coming from within from a sub par workforce battling arpartheid PSD and drunk on colour affirmation economics. Its famed xenophobia has ensured it has precious few friends in Africa.

So maybe it does have good reason to look East after all.

I am not going to enter into a long winded argument here - I have put my view across. Others may too and we set them side by side. Time will tell

You're not following coz you're highly indebted puppets. Some francophone parliamentarians even asked for the Pan-African Parliament to be moved from Johannesburg to Paris, live on tv - can you believe it?

What's Nigeria's foreign policy if i may ask? Atleast SA stands for something - sits in BRICS and G20, while Nigeria is even bullied by coup leaders in Niger and Burkina Faso.

Oh really debt South Africa's external debt reached over 170 billion U.S. dollars in 2021, which corresponded to the highest stock of foreign debt in Sub-Saharan Africa. Nigeria and Angola followed, each with debts of 76.2 billion and 67.3 billion U.S. dollars. When you factor in population on a debt per head basis SA indebtedness is even more glaring.

Think - what strategic interest / alliance does NG have with Hamas? How many Nigerians live there? What can they do for us? Even the Palestine Authority doesn't want Hamas. We don't support Iranian proxies anywhere - so we condemn violence - we even voted for Israel to stop attacks on civilian pop but we don't stick our neck out for militant Islam.

Ukraine - check the UN vote. NG voted for Russia to stop aggression and withdraw but also abstained with other African countries when the resolution was to simply condemn Russia.

We helped earn you your freedom on the world stage. We funded freedom fighters, nationalised BP, housed your students in our country and starred down Magaret Thatchers racist foreign policy. SA has nothing to teach NG about foreign policy. We've been at it longer and we know how it works better.
